B�►CKGROUIVD The proposed application to demolish existing 410 Sq. Ft. pool cabana and construct a new Pool/Fitness Building in the R-3 zoning district was filed at the Village on May 27, 2011. The Development Review Committee met on June 8, 2011, to review the proposal in terms of compliance with Village's Code, law enforcement, fire safety, and public works requirements. Also, the applicant had previously submitted a different application to build a pool/fifiness building in December 2008. The following is a summary of the previous application timeline: ■ January 8, 2009- Planning and Zoning Board Advisory Board (P&ZAB) held a meeting to hear application. Board recommended that additional information be provided. ■ April 30, 2009- Applicant met with residents and neighbors to discuss plans at Tequesta Towers. ■ July 2, 2009- After a discussion by P&ZAB, the applications was tabled to a time certain of 8/20/09. ■ August 20, 2009- P&ZAB approved the application with a condition "ViHage staff scrutinize the information presented by both Counsels and affirming that Village standards were met, to be determined by Village staff". The "condominium associations" (Cliveden lupiter Island Condominium Association, Inc.; Island House Southwest Condominium Association , lnc.; Island House Northeast Condominium Association, Inc.; and LaMar Condominium Association, Inc.) retained Lewes, Longman & Walker, P.A. to represent them and to review the proposed site plan previously filed in 2008. The "condominium associations' fiHed for an �ppeal to challenge P&ZAB approval. The applicant withdrew the previous application, and �l/ed a new aaplication that is part of the current petition and analysis to be heard by P&ZAB at the upcoming July 7, 2011, public meeting. 4. Based on the information provided indicating that the site is less than 10 acres in size and will still have less than 2 acres of impervious surface with no work in and no impacts to wetlands or other surFace waters, the work qualifies for a No Notice General Permit for Activities in Uplands according to Section 40E-400.315, FAC of the District's rules.
