HomeMy WebLinkAboutMinutes_Special Master_04/28/2011 VILLAGE OF TEQUESTA SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES April 28, 2011 PRESENT: Special Master Kevin Wagner; Code Enforcement Officer Joe Petrick, and Village Attorney Jennifer Gardner Ashton. The hearing was called to order at 10:00 A.M. The Pledge of Allegiance was led by Special Magistrate Kevin Wagner. The following cases were heard by the Special Master: Status Hearings - None Fine Assessment Hearings 1. Case Number: 2011 -00043 Helena Wang 383 Norfolk Ave Tequesta, FL 33469 P C N : 60- 42- 40- 25 -06- 018 -0080 Legal Description: JUPITER IN THE PINES SEC B LT 8 BILK 18 Chapter 30 Article X Section 30 -361 Prohibited Noise Generally Chapter 30 Article II Section 30 -33 Prohibited Conditions Chapter 78 Article X Section 78 -693 Paving of Parking Spaces; Obstructions in Parking Area Chapter 78 Article IX Section 78 -399 Irrigation International Property Maintenance Code 301.2 General Requirements This case was withdrawn. Repeat Violation Hearings - None April 28, 2011 Page 2of5 Violation Hearings 2. Case Number: 2011 -00064 Hamdi Elfarghali 148 Intracoastal Circle Tequesta, FL 33469 P C N : 60- 43- 40- 30 -39- 000 -0130 Legal Description: KEY WEST VILLAGE LOT 13 Chapter 78 Article IX Section 78 -585 Child Restraint Barrier Required Findings of fact were that the Respondent was not present at the hearing; however, there was a finding of proper notice. Special Magistrate Wagner ordered that this matter be tabled until May 26, 2011. Notice was given to Respondent to appear at the Violation Hearing which will be held the 26 day of May, 2011 at 10:00 a.m. at Village Hall, Council Chambers, 345 Tequesta Drive, Tequesta, Florida 33469 unless the Code Enforcement Officer certifies that Respondent has timely brought his property into compliance. 3. Case Number: 2011 -00025 Susan Anderson 3 Pine Tree Circle Tequesta, FL 33469 PCN: 60- 42- 40- 25 -09- 000 -0410 Legal Description: RIDGEWOOD HOMES LOT 41 Chapter 78 Article IX Section 78 -643 R -1 Violation Findings of fact were that the Respondent was not present at the hearing; however, there was a finding of proper notice. Code Enforcement Officer Joe Petrick provided testimony and evidence of the violations, as contained in the Village's evidentiary case file which was accepted into evidence. As of the hearing on April 28, 2011, based on testimony presented by the Code Enforcement Officer, the property was not in compliance with Section 76 -643 of the Code of Ordinances of the Village of Tequesta. Conclusions of law were that the above - stated facts constitute a violation of Section 76 -643 of the Code of Ordinances of the Village of Tequesta. April 28, 2011 Page 3 of 5 Special Magistrate Wagner ordered that Respondent comply with Section 76 -643 of the Code of Ordinances of the Village of Tequesta on or before May 25, 2011. If Respondent fails to achieve compliance on or before May 25, 2011, a daily fine of $50.00 per day may be imposed for each day the violation continues to exist. It further was the Order of the Special Magistrate that Respondent shall be assessed $269.55 in administrative costs incurred by the Village prior to April 28, 2011. Notice was given to Respondent to appear at the Fine Assessment Hearing which will be held the 26 day of May, 2011 at 10:00 a.m. at Village Hall, Council Chambers, 345 Tequesta Drive, Tequesta, Florida 33469 unless the Code Enforcement Officer certifies that Respondent has timely brought his property into compliance 4. Case Number: 2010 -00103 JMZ Properties Inc. John Zuccarelli 1 Main Street #101 (Connor Moran Wellness Center) Tequesta, FI 33469 PCN: 60- 43- 40- 30 -47- 004 -0000 Legal Description: TEQUESTA VILLAGE CENTER PAR 4 Chapter 14 Article VI Sections 14 -152 and 14 -157 Building Permits and Double Fee for Job Started Without Permits Findings of fact were that the Respondent was represented at the hearing by Greg Gordovitch. There was a finding of proper notice. Code Enforcement Officer Joe Petrick provided testimony and evidence of the violations, as contained in the Village's evidentiary case file which was accepted into evidence. As of the hearing on April 28, 2011, based on testimony presented by the Code Enforcement Officer, the property was not in compliance with Sections 14 -152 and 14 -157 of the Code of Ordinances of the Village of Tequesta. Conclusions of law were that the above- stated facts constitute a violation of with Sections 14 -152 and 14 -157 of the Code of Ordinances of the Village of Tequesta. Special Magistrate Wagner ordered that Respondent comply with Sections 14- 152 and 14 -157 of the Code of Ordinances of the Village of Tequesta on or before June 29, 2011. Specifically, Respondent shall apply for and obtain a April 28, 2011 Page 4 of 5 building permit for the work done, shall provide the Building Official for the Village of Tequesta with sealed plans from a licensed architect or engineer for the work done, and shall meet all other requirements of the Building Official for the Village of Tequesta. If Respondent fails to achieve compliance on or before June 29, 2011, a daily fine of $250.00 per day may be imposed for each day the violation continues to exist. It further was the Order of the Special Magistrate that Respondent shall be assessed $467.31 in administrative costs incurred by the Village prior to April 28, 2011. Notice was given to Respondent to appear at the Status Conference /Fine Assessment Hearing which will be held the 30th day of June, 2011 at 10:00 a.m. at Village Hall, Council Chambers, 345 Tequesta Drive, Tequesta, Florida 33469 unless the Code Enforcement Officer certifies that Respondent has timely brought his property into compliance Foreclosure Authorizations - None Fine Reduction Hearings - None Approval of Minutes Special Master Wagner approved the minutes of the February 24, 2011 hearing as submitted. Adjournment There being no further cases, the meeting was adjourned.
