The last page of the Staff report ("Final Remarks”) submitted as part of Council package summarized the outstanding issues regarding the GMH application as August 1 (See attached document). Since then, the applicant has presented to the Village the attached evidences of submittal to the following agencies: Palm Beach County, Loxahatchee River Environmental Control District and South Florida Water Management District. Even though this applicant has made tremendous improvements from their original project design, one issue remains outstanding. That is the landscaping along the exterior perimeter fence line adjacent to Old Dixie Highway and Village Boulevard. This was a condition of approval imposed by the Village Council at the Special Exception Use hearing on May 12, 2011, and it was a recommendation of approval by the Planning and Zoning Advisory Board on July 7, 2011. The condition is as follows: Condition 2"The applicant shall be permitted to utilize all existing fencing material surrounding the subject property, despite the fact that the fence height in some locations is between five feet (5'J and six feet (6'J tall. The applicant shall provide sufficient landscaping to conceal the fence. The applicant shall work with the Village's landscaping consultant in order to accomplish this waiver/approval condition and the proposed landscaping shall meet with the approval of the Village's landscaping consultant in terms of quality and lacation." The outstanding comments, and our responses, follow: Staff Analysis Comment 1: At the P&Z meeiing (7.7.11), the applicant expressed that they will provide evidence that the plan was submitted to the County by Village Council Public Hearing. As of today (8.1.11), the applicant did not submit to the Village a letter of approval from Palm Beach County, or evidence that the plan was submitted to the County. RESPOIVSE: Plans were submifted to Palm Beach County Land Development ancl a submiftal receipf was providec! to fhe Village via e-mail on August 3, 2019. Coinment 2: As of today (8.1.11), the applicant did not submit to the Village a permit or evidence of this requirement re�arding LRECD. RFSP�IVSE: Plans were submitted to LRECD on July 29, 2091. The submittal receipt �vas provided fo the Vi!lage via e-mail on Augusf 3, 2091. Comment 3: As of today (8.1.11), the applicant did not submit to the Village a permit or evidence of this requirement re�arding SFWMD. RESPONSE: Plans were submitted to SFWMD on Augusf 2, 2011. The submittal receipf was provided Yo fl�e Village via e-mail on /�ugusf 3, 2071. I 0003A. staifreport. resp.080511.jcf Landscapina Comment 1: I agree with the majority of the applicant's response letter. However, previous responses raised the concern that there was not sufficient growing room between the fence and the sidewalk and I addressed my comments as such. As the applicant's approach to this matter has changed, I feel we need to go back to the original intent of this request. A waiver was granted by the Village Council at the Special Exception Hearing for the perimeter fence height. As a condition of the waiver, the Order Approving Application states, "The Applicant shall provide sufficient landscaping to conceal the fence." The proposed 4' ht., 7 gal. shrubs will not sufficiently conceal the fence, nor will they fill the planting space along Old Dixie Highway. In addition, along Village Boulevard, there will be no right of way plantings, leaving the hedge as the sole perimeter buffer. Native and non-native hedges (the plan is above the native count) are available in 15 gal. containers, 5'6" to 6'0" o.a. The spacing between hedges can increase versus the 7 gal. containers to help defray costs. RESPONSE: The appllcant requests ihat the VUlagre Councll accept the landscaping proposed along the exterior of the exisfing fence locateaf a/ong O/d Dixfe Highway and Vll/age Boulevard as presented. The proposed 7gallon shrubs wll/ grow fo a height of 5 to 6 ft.—the height of fhe existing fence—withln one to two yesrs and will be maintained at the maximum allowed height of 6 ft A recommendatlon for i5 to 2D gallon materia/ was made by the Planning and Zoning Advlsory Bosrd on Ju/y 7, 2011; howrever, aur research in the June 15, 2011 Betrocks's Plant Finder, a standard for Florida p/anf selection, pricing and locating, indlcafes that i5 gallons specles currently available wll/ not meet the Vil/age's specificafions. Removing fhe native hedge and using a non-native species as suggested would not allow us to meet the Village's native plant regulrement, as our current plan exceeds the requirement for nafive species by only 3%. To meef the requested 5 to 6 ft. heighf at the esfimated puantities proposed, 25 gallon material will need to be obtained. This size maferial is foo large for the 4 ff. and 2 fo 3 ft. wide plantfng areas along O/d Dixie Highway and Village Boulevard, respective/y; wfll encroach /nfo ihe sldewalk area which must be malnfalned clear per Palm Beach Counfy Streetscape clear zone requJremenfs; and wlll likely need fo be rep/aced because ot dTe out due to Insufficienf growing room. In general, newly planted shrubs should be allowed sufficient room fo expand instead of undergo/ng the lmmediate pruning thaf would be reguired for maintenance of a larger hedge in these areas. The p/anring width along Village Boulevard is currently barely sufflclent to accommodate the proposed 7 gallon hedge. The increase requesfed by the Village, 10003A. staffreport.resp.080511.jcf factoring in spacing adjustments for fhe larger material, also amount �o a threefold increase in perimeter landscaping cosfs, nof including the cost of future installations. As mentioned previously, because of fhe result of cooperafion with Village staff and officials fhroughout the special exception and si?e plan approva! proc�ss��, u,ngrades to landscaping have been provided throughout the property. �ubstantial landscaping has aJso been proposed within right-ot way outside of fhe property, a condition ofi the specia! �xception approval requested specifically for O!d Dixie hlighway. The applicant has proposed landsca,ning sufficient fibr �he purposes of screenrng and layering as well as infernal site decorafion, boPh wel! e�rceeding current cod� reqc►irements. Comment �: The ambulance transport area has still not been noted on the plans, nor has the symbol for the Wax Myrtle been changed to match the plant list (MCE). 9���PaNS�: The lancJscape plans wiU be revised to �how the ambulance fransporf a�ea locafion. JC F/adr I 0003A.s la(6�eport. resp.080511.jcf FINAL REMARKS (from Staff Report submitted as part of Villaqe Council Packaqe) • The applicant provided finished materials boards including color samples (floor, walls, roof, etc.). • This development application met the requirements set on Section 78-334 notice of hearing. The notice of hearing was advertised in the Jupiter Courier on July 31, 2011. • The follawing is a summary of outstanding comments that the applicant needs to provide as part of the site plan approval process: i. Provide letters of approval from various agencies indicated in the Site Planning Review Form when applied for Village Council site plan approval. a. Level of Service- DRAINAGE: The applicant indicated that SFWMD had issued a permit for the Crossing project (See attached letter from applicant and SFWMD permit). The applicant states that "the site drainage system exceeds the required leve! of service standards and the impact of the proposed development is substantially less than what was previously approved". The applicant needs a permit from SFWMD for thts proposed development. At the P&Z meeting (7.7.11), the applicant expressed that they will provide support documents regarding this condition by Village Council Public Hearing. Level of Seroice -SANITARY SEWER: The proposed application does not exceed the maximum flows of 19,530 gallons/day or 21,000 gallons/day. The applicant needs a permlt from LRECD for this proposed development. At the PB�Z meeting (7.7.11), the applicant expressed that they will provide support documents �egarding this condition by Village Council Public Hearing. The eveni that the applicant fails to secure county approval for said landscaping and landscape mainienance, then rhe applitant shall be solely responsible to Install and mainioin additional landscaping on their property adjacent io Old Dixie Highway without county assistance; such main[enance shall NOT be the responsibility of the Village of Tequesta. The attached permit application is being submitted in order to get the county's app�oval.for landscaping and irrigation that is being proposed for the ROW along Old Dixie Highway in Tequesia in relation with a development project located at the N.E. corner of Old Dixie Hwy. and Village Blvd. Currently there is no specific conditfon of approval from the Village of Tequesta requiring this landscaping, however, our client (GMH Capital) has requested that we attempt to provide additional buffering along the roadwey wlth the Village's blessing. We have also attached a letter from Russell White at the Village of Tequesta Utilities Dept. stating that the Village has no issues with the proposed landscaping and that they have no issues with the proposed landscaping being located near the Village's utilities which are locaied in the R/W.
