I will keep my private life unsullied as an example to all; maintain courageous calm in the face of danger, scorn or ridicule; develop self-restraint; and be constantly mindful of the welfare of others. They are for the management, control and efficiency of the members and employees of the department and violations or neglect of these Policies, Procedures and General Orders may serve as basis for disciplinary action. These Policies, Procedures and General Orders are not meant to be all inclusive, as there is no way to cover every possible action of every police officer in every conceivable situation. Tequesta Police department employees are, however, expected to use tact, common sense, good judgement and mature reasoning while adhering to the directives contained herein. These Policies, Procedures and General Orders are designed to conform with related objectives in the Village of Tequesta Employees Handbook. Previous Policies, Procedures and General Orders issued by the police department are hereby revoked. If any member of the department is in doubt as to the meaning of any Policy, Procedure, General Order or Directive Memo, they shall seek interpretation forthwith from a superior. Roderick VILLAGE OF TEQUESTA POLICE DEPARTMENT INSTRUCTIONS FOR OPERATIONS MANUAL To assist the department in the operation of its written directive system, the following series of guidelines and instructions have been prepared. RESPONSIBILITY FOR MAINTENANCE The Administrative Division will be responsible for the maintenance of the manual. This function will include periodic review of all active General Orders, Policies and Procedures; processing and dissemination of newly issued documents; update and control of the issuance of all manuals to department employees. ISSUING AND CANCELLING ORDERS, POLICIES AND PROCEDURES When a new General Order, policy or procedure is issued, it will be placed in the appropriate section of the manual. The necessary indexing data entered, and replaced Orders, policies and procedures referenced. When a General Order, Policy or Procedure is cancelled, a copy will be retained in an inactive file held by the Administrative Division for reference purposes. All other copies are to be removed from the employees manual and related indexing data will be deleted. The Administrative Division will maintain all original, hand signed, General Orders, Policies and Procedure documents in a secure location within the police department. Access to this file of original documents will be limited to only those individuals responsible for the maintenance of the manual. Each copy of the manual will contain the header title: VILLAGE OF TEQUESTA POLICE DEPARTMENT along with the information titles as follows. TYPE: -Denotes a General Order, Policy or Procedure as defined. TITLE: - Represents the actual title of the document as written by the author. DATE: - Represents the effective date of the document. NUMBER: - Represents a unique number assigned to the document that also denotes type (e.g. General Order 01 or Policy 12, etc.). - Represents the date and document number that is superseded by the statement at hand. - A brief directive statement of the document. And finally, the signature of the Chief of Police and Village Manager will appear on the bottom of each General Order, Policy c-- Procedure. GENERAL INFORMATION Each employee who is issued an Operations Manual, shall be responsible for maintaining current information in the binders provided. Each employee is responsible for the safe keeping of their manual. All manuals and materials contained therein are department property and must be returned upon an employees separation or retirement. For security reasons, some of the contents of the manual are not for public view and therefor should be kept in a secure place. Any lost, stolen, misplaced or destroyed manuals should be brought to the attention of the Chief of Police. VILLAGE OF TEQUESTA POLICE DEPARTMENT TYPE : PROCEDURE TITLE : PL0NNINS DATE : NUMBER : AMENDED: SUBJECT: RESEARCH, PLANNING AND DEVELOPING OF NEW IDEA'S FOR POLICY, PROCEDURE OR GENERAL ORDERS When a member of the department recognizes the need for a new policy or procedure that would benefit the operation of the department, the need should be brought to the attention of the Chief of Police. This may be done in letter form describing the policy or procedure, how it will benefit the department, and what has been done in the past. An example will be sent through the chain of command to the Chief of Police, who may designate personnel to review and investigate this police or procedure. If the policy or procedure is adopted, all personnel will be notified officially and a copy of the policy or procedure will be placed in the individual~s manual. Roderick VILLAGE OF TEQUESTA POLICE DEPARTMENT TYPE : POLICY TITLE : POLICIES., PROCEDURES AND GENERAL ORDERS DEFINED DATE : NUMBER : AMENDED: SUBJECT: DEFINITIONS OF POLICIES, PROCEDURES AND GENERAL ORDERS GENERAL ORDER: A General Order is a specific prohibition or requirement which is stated to prevent deviation from policy or procedure. General Orders allow little deviation other than +or stated exceptions. POLICY: A Policy is the principle on which any measure or course of action is based. Since policy is objective rather than situation oriented, it is broad enough in scope to encompass most situations. Policy, therefore, must be stated in general terms, and based upon police ethics and experience, the desires of the community, and the mandate of the law. PROCEDURES: A Procedure is ax method of performing an operation or a manner of proceeding on a course of action. It differs from a policy in that it directs action in a particular situation to perform a specific task within the guidelines of policy. Village Manager Chief of Police Thomas G. Bradford Carl R. Roderick VILLAGE OF TEQUESTA POLICE DEPARTMENT TYPE : GENERAL ORDER TITLE : COMMUNICATIONS WITHIN THE DEPARTMENT DATE : NUMBER : GENERAL ORDER # 1 AMENDED: SUBJECT: CHAIN OF COMMAND FOR COMMUNICATIONS WITHIN THE POLICE DEPARTMENT The Police Department of the Village of Tequesta is operated as a para -military organization responsible for the efficient and professional protection of the public health and safety of all citizens within the Village limits of Teouesta. To that end, employees are directed to address all complaints or grievances to the appropriate superior officer and through the chain of command. Bypassing any step in the chain of command or failing to utilize any applicable grievance procedure, is a breach of this department order. At no time may a member of the Tequesta Police Department, civilian or sworn, engage in scandalous, libelous or inflammatory speech concerning the operation of the department, its employees, administrators or governing officials. Employees are expected to conduct themselves in a respectful manner when dealing with each other and any acts or speech which detracts from the professional attitude or morale of the department or constitutes disloyalty to fellow officers or superiors is a breach of this department order. Roderick VILLAGE OF TEQUESTA POLICE DEPARTMENT TYPE : GENERAL ORDER TITLE : COMMUNICATIONS OUTSIDE OF DEPARTMENT MEMBERS DATE NUMBER : GENERAL ORDER # 2 AMENDED: SUBJECT: CHAIN OF COMMAND FOR COMMUNICATIONS TO INDIVIDUALS OUTSIDE OF THE POLICE DEPARTMENT The Police Department of the Village of Tequesta is operated as a para -military organization, responsible for the efficient and professional protection of the public health and safety of all citizens within the Village limits of Tequesta. To that end, employees are directed to address all questions, complaints or grievances to the appropriate superior officer and through the chain of command. Bypassing any step in the chain of command or failing to utilize any applicable grievance procedure by bringing any questions, complaints or grievances directly to the Village Manager, Village Clerk, Village Finance Director, Village Council or individual Council Member or any member of the general public, is a breach of this department order. At no time may a member of the Tequesta Police Department, civil or sworn, engage in scandalous, libelous or inflammatory speech concerning the operation of the department, its employees, administrators or governing officials. Employees are expected to conduct themselves in a respectful manner when dealing with any Village Official or any member of the general public and any acts or speech which detracts from the professional attitude or morale of the department or constitutes disloyalty to fellow officers or superiors is a breach of this General Order. Roderick VILLAGE OF TEQUESTA POLICE DEPARTMENT TYPE : POLICY TITLE : VACATION LEAVE DATE NUMBER AMENDED: SUBJECT: VACATION LEAVE ACCRUAL AND USE The Village of Tequesta offers its employees an allotment of paid vacation time each year. The allotted amounts and how they are accrued are dictated within the employees handbook. The police department receives extra days for converting annual holidays and these are added in by the administrative office and reflect on your payroll stub. It shall be the policy of the Tequesta Police Department to allow only One individual per shift, to take vacation leave at any given time, provided the shift is at full strength and the departments operation will not be disrupted. Vacation selections will be approved by seniority on each shift, projected through the year, at the beginning of each calendar year until March 31 of that year. The seniority counts only for your scheduled shift. After March 31, any member may sign up for a vacant slot within the shift projection regardless of seniority. Vacation request slips must be filled out and submitted to your immediate supervisor for approval who will then submit the approved slip to the scheduling officer. The commander of the Detective Bureau will be responsible for that division and providing the best possible on call status while a detective is on vacation. Roderick VILLAGE OF TEQUESTA POLICE DEPARTMENT TYPE : POLICY TITLE : MILITARY LEAVE DATE NUMBER AMENDED: SUBJECT: MILITARY LEAVE, SERVILE IN THE U.S. ARMED FORCES, RESERVES OR NATIONAL GUARD The Village of Tequesta grants military leave for personnel who are members of the U.S. Military, Reserves or National Guard, and policy is dictated within the employees handbook. Roderick VILLAGE OF TEQUESTA POLICE DEPARTMENT TYPE : POLICY TITLE : SICK LEAVE DATE NUMBER AMENDED: SUBJECT: SICK LEAVE ACCRUAL AND USE The Village of Tequesta provides all regular employees with sick leave. The accrual, use, conversion, abuse of, and termination payoff, is dictated in the employees handbook. Village Manager; Chief of Police; Thomas G. Bradford Carl R. Roderick VILLAGE OF TEQUESTA POLICE DEPARTMENT TYPE : POLICY TITLE : FUNERAL LEAVE DATE NUMBER AMENDED: SUBJECT: FUNERAL LEAVE, ABSENCE IN THE EVENT OF A DEATH OF A FAMILY MEMBER The Village of Tequesta allows regular employees up to Three (3) days of paid absence in the event of a death of a family member to include parent, grandparent, child, grandchild, brother, sister or spouse and spouses child, brother, sister, parent grandparent or grandchild. Roderick VILLAGE OF TEGUESTA POLICE DEPARTMENT TYPE : POLICY TITLE : BREAK TIME DATE NUMBER : AMENDED: SUBJECT: MEAL BREAKS AND COFFEE BREAKS Each member of the department is allotted a half (1/2) hour meal break and Two (2), Ten minute breaks during each shift if conditions permit. A11 officers and dispatchers will clear through his/her shift supervisor before taking any break. All members of the department will be subject to call out during these breaks. Officers will check out leaving a phone number, or maintain radio contact during meal and coffee breaks. If a cover car is available, that unit will cover the zone vacated by the officer on break. If no cover car is available, the second zone car will move to a central location and will answer calls for both zones. If a serious call is received, (accident, theft in progress, etc.), the officer on break will be called out to handle the case if it is in his zone or backup if it is in the other zone. If the officer on the road arrives at the scene first, and it is not his/her zone, that officer will start the investigation and turn it over to the proper zone car when it arrives. If both officers agree that the first officer on scene will handle the investigation no matter which zone it is in, that will be permissible, however the officer assigned to that zone will be held responsible for the report. Dispatchers will leave a phone number where they may be contacted if they take a meal break outside the station. Dispatchers will only be allowed to leave the station on meal breaks if there are three officers on duty, one of whom will relieve the dispatcher. If there are only two officers on duty, the dispatcher will be required to remain in the building for meal breaks while being relieved by an officer. Village Manager Chief of Police Thomas G. Roderick VILLAGE OF TEQUESTA POLICE DEPARTMENT TYPE : POLICY TITLE : JURY DIJTY DATE : NUMBER : AMENDED: SUBJECT: JURY DUTY, ABSENCE FROM WORK The Village of Teouesta will allow up to Five (5) days of absence with pay for authorized jury duty. Proof of the jury duty must be submitted for the time being paid. Certified Police Officers are exempt from jury duty upon filing the proper form when served with a notice. Roderick VILLAGE OF TEQUESTA POLICE DEPARTMENT TYPE : PROCEDURE TITLE : PROMOTION REQUIREMENTS (SERGEANT) DATE NUMBER AMENDED: SUBJECT: CONSIDERATIONS FOR PROMOTION TO THE RANK OF SERGEANT To qualify for the consideration of promotion to the rank of Sergeant, an officer must have. 1. A minimum of Five (5) years of total police experience. 2. A minimum of Two (2) years with the Tequesta Police Department. 3. An associates degree in Criminal Justice/Law Enforcement. OR A. The minimum of 240 hours of certified law enforcement courses. ( Eighty (80) of these hours in supervision courses. ) Qualified officers will be required to pass a written exam of selected questions on Local Ordinances, State Law, Tequesta Police Policy, Procedures, General Orders and General Information questions, compiled by the Chief of Police and Two other designees. Qualified officers passing the written exam, will be required to pass an oral review board comprised of Three (3) members. One member to be selected by the Chief of Police, One member to be selected by the Sergeants and the Third member to be selected by the Patrol officers vying for the position. The Chief of Police will then recommend One of the top Three scoring officers for the position of Sergeant, to the Village Manager for the final decision. If a case arises where there are no officers with the qual if ications for the rank of Sergeant, the Chief of Police wil l make the selection based solely on merit. Any officer feeling he or she has been discriminated against because of personality or other irregularity may plea their case by following regular grievance procedures. Roderick VILLAGE OF TEQUESTA POLICE DEPARTMENT TYPE : POLICY TITLE : FIREARMS DATE NUMBER AMENDED: SUBJECT: FIREARMS USE AND SPECIFICATIONS The Tequesta Police Department places a greater value on the preservation of life than on the protection of property. It is in the best interest of the public, the Tequesta Police Department, and the officers of the Tequesta Police Department, that the use of deadly force by the police balance the safety of the community and its police with the constitutional principle of due process. It is the policy of the Tequesta Police Department that officers will use deadly force only as a last resort and when the officer(s) have reasonable belief that deadly force action is required and if, where feasible, some warning has been given: A. To prevent death or substantial harm to the officer or another person. B. To prevent the escape of a fleeing felon who would pose a real threat or substantial harm to the officer or another person. 1. Every officer of the Tequesta Police Department will become completely familiar with the State Statutes pertaining to the use of deadly force. C. Definitions 1. FELON - a suspect who the officer has probable cause to believe has committed, or is committing a crime that is punishable under Florida State law by death or imprisonment in excess of one year in a state penitentiary. 2. DEADLY FORCE - any force likely to cause death or great bodily harm. 3. LAST RESORT - all practical means available to the officer to avoid using deadly force have been exhausted. 4. REASONABLE BELIEF - a state of mind supported by circumstances strong enough to warrant a cautious and prudent officer to make a similar judgement. The elements of reasonable belief include the officer's own experience and training, as well as the facts of the situation known to the officer at the time of the application of deadly force. 5. SUBSTANTIAL HARM - any injury likely to result in death, permanent disability, permanent disfigurement, or considerable or extensive injury to a person. I. FIREARMS SPECIFICATIONS All officers will carry a revolver or semi-automatic pistol pursuant to the following conditions. Any firearm carried as a duty weapon will be a standard factory issue. The only modifications allowed are a change in grips, sights, and finish. Cutting springs and altering internal parts is strictly forbidden. Officers will designate a handgun as their primary duty sidearm at the beginning of the fiscal year. A. REVOLVER 1. Must be double action of reputable manufacture. 2. Barrel length will have a Four (4) inch minimum to a Six(6) inch maximum. Detectives and administrative personnel may carry a Two (2) inch minimum. 3. Holsters must department approved. 4. Revolvers must be .38 caliber and be able to chamber Six (6) cartridges. detectives and Administrative personnel must be able to chamber Five (5) cartridges. a. Uniformed officers must carry Twelve (12) extra rounds in approved speed loaders on the uniform gun belt. b. detectives and Administrative personnel must carry at least one weapon reload amount. B. SEMI-AUTOMATIC PISTOLS 1. Must be double action of reputable manufacture. 2. Must have an internal firing pin safety and hammer de -cocking system. 3. Barrel length will have a minimum of Three & one half (3-1/2) inches to a maximum of Six (6) inches. 4. Holsters must be department approved. 5. Semi -Automatic Pistols most be of a minimum of 9mm to a maximum of a .45acp caliber. a. Uniformed officers must carry Two (2) extra magazines in department approved holders. b. Detectives and administrative personnel must carry at least one reload magazine. C. BACKUP OR SECONDARY FIREARM 1. The firearm must be registered with the department. 2. The firearm must be inspected and certified safe by departments firearms training officer. 3. The officer must demonstrate proficiency annually on a course appropriate for the firearm. a. This will be at the officers expense if the ammunition required is not maintained by the department. b. Any ammunition not maintained by the department that is purchased by an individual, must conform with department guidelines and be registered with the department. D. USE OF FIREARMS 1. The following practices are forbidden: a. Firing warning shots. b. Firing from a moving vehicle. 2. The following practices are forbidden except when personal or citizen safety is in jeopardy. a. Shots to destroy animals. b. Firing at moving vehicles. c. Firing into buildings. E. USE OF SUPERIOR FIREARMS 1. Personally owned firearms used for duty will first be approved by the departments firearms instructor and then registered with the department. 2. Any officer desiring to carry a high-power rifle must first be certified by a department firearms instructor. a. The officer must complete a formal training class of at least Twenty -Four (24) hours and must demonstrate proficiency quarterly with the firearm. 3. The senior officer in charge will be responsible for authorizing the deployment of the departments high- power rifle. The designated rifleman will the be responsible for the proper use of the firearm. F. REGISTRATION OF FIREARMS 1. All duty firearms, backup firearms and special use firearms must be registered with the department. 2. Any sale, exchange or loss of a registered firearm must be recorded with the department. 3. Any new firearm must be registered with the department before being carried on duty. G. INSPECTION OF FIREARMS 1. Duty firearms, ammunition and related equipment may be inspected at random by the Firearms Training officer or an officers immediate supervisor. Firearms found to be functionally questionable shall be reported immediately to the Firearms Training Officer. 2. All firearms will be inspected for safety on the range prior to training sessions. 3. A firearm found to be un -serviceable will not be carried on duty until the officer shows proof of repair by a competent gunsmith. A record of this repair will be kept by the department. H. REPORTING AND INVESTIGATING DISCHARGE OF WEAPON 1. Any department member discharging a firearm accidentally or intentionally (except during training), must make a verbal report to his supervisor as soon as practical, and must submit a written report to the Lieutenant of Police, describing in detail the circumstances surrounding such discharge 2. When personal injury or property damage results from the discharge of a weapon, the supervisor will notify the Lieutenant and the Chief of Police. 3. The assigned investigating team is responsible for conducting a complete investigation of the circumstances as soon as possible. 4. Copies of all statements, facts, and written reports related to the discharge of a firearm, must be forwarded to the Chief of Police without delay. 5. Any departmental discipline as a result of a shooting will be delayed until after any pending criminal charges against the officer are cleared. b. The department has the option of requiring a psychological debriefing for any officer involved in a shooting resulting in injury or death. Village Manager Chief of Police Thomas G. Bradford Carl R. Off-duty officers within the Village of Tequesta limits, who must take police action due to exigent circumstances will be immediately placed on an on -duty status and must follow all department policies, procedures, and rules. Officers who chose to carry a concealed weapon outside the Village of Tequesta limits are doing so at their own risk. The Village of Tequesta Police Department will not be responsible for any damages resulting from the actions of any officer carrying a concealed weapon outside of his/her jurisdiction. TRAINING All officers are required to attend periodic firearms training sessions and must maintain an average of Eighty Percent (80 ;G) on designated qualification courses. Holsters and related equipment carried on duty will be used during all training sessions. Each officer must shoot a passing score on an approved course with a department issued shotgun at least once a year. All newly hired officers must pass the designated qualification courses with both handgun and shotgun within Fourteen (14) days of hire. Any officer desiring to carry a semi-automatic pistol as a duty firearms will first pass a department approved transition class of at least Sixteen (ib) hours. This class will be at the officers expense. FAILURE TO PASS QUALIFICATION At each training session, each officer will shoot a designated qualification course. Any officer failing to shoot the required number of passing scores after a reasonable number of attempts, will be given Seven (7) days to pass the course. Any officer failing to pass within the Seven (7) day time period will be given intensive remedial training during the next Seven (7) days. Officers failing to qualify after this Fourteen (14) day period will be placed on suspension without pay until a passing score is fired. This suspension shall not exceed Thirty (30) days. If passing scores are not achieved by this time, possible termination shall take place after due process. Officers will not be paid for time spent in re-training during this Forty -Four (44) day period. It is the officers responsibility to schedule range time with one of the departments firearms instructors to meet the requirements of this section. Village Manager Chief of Police Thomas G. To insure unity of command, clearly defined lines of authority must be drawn so that there exists a structural relationship between each employee, their supervisor, and the chief. This includes a dispatch / desk operator and Two (2) road patrol officers. The only exception to this rule is during the day shift (SAM to 4PM), where officers are scheduled for court or other police functions for a reasonably short period of time, and there is an administrative officer or detective on duty to backup a road patrol officer if the need arises. It will be the responsibility of the shift supervisor to insure that the oncoming shift is fully staffed. That is, when an employee calls in sick or is unable to work due to an emergency situation, that on duty supervisor will make an attempt to contact off duty personnel to fill the shift. Persons of the same job classification should be notified first, sergeant for sergeant, officer for officer, and dispatcher for dispatcher. If an off duty employee can not be located, then arrangements must be made with the duty shift for someone to hold over for half a shift and a member of the oncoming shift to come in early. In the event that an evening shift needs to transport a prisoner out of town or an officer is needed to conclude an investigation out of town i.e. hospital or Martin County Sheriff's Office, and the officer is expected to be longer then an hour, an officer should be called in to cover and maintain the minimum Two man road coverage. Any time there is an emergency situation within the village, and the shift supervisor feels additional help is needed, that supervisor will contact the Lieutenant or Chief of Police prior to calling in off duty personnel. When two employees of the same job classification agree to trade shifts, the agreement must be in writing and presented for approval to both shift supervisors at least Twenty-Four(24) hours in advance. An exception to the rule of job classification may be submitted for approval with a valid emergency reason and must be approved by both shift supervisors, the administrative officer in charge of scheduling and the Chief of Police. All requests will be submitted to the administrative officer in charge of scheduling. This policy procedure does not preclude shift scheduling to maintain department operation either by the administrative officer in charge of scheduling or emergency coverage by a shift supervisor. Roderick VILLAGE OF TEQUESTA POLICE DEPARTMENT TYPE : POLICY TITLE : TARDINESS DATE NUMBER AMENDED: SUBJECT: TARDINESS, DISCIPLINARY ACTION FOR REPEATED TARDINESS It will be the policy of the police department, that all employees who work scheduled shifts that relieve other employees, will report to work on or before the hour of that scheduled shift unless: A. There is an agreement between two employees for a late relief. B. There is an agreement between a group of employees for a different relief time. 1. This agreement must be accepted by all employees involved and a written statement should be submitted to the administrative officer in charge of scheduling. Road patrol officers will begin the shift and be on the road as soon after the hour as possible. If the officer does not arrive for work in time to allow reading of reports etc., that action may be done at a later time during the shift. If an employee arrives for work after the hour of the scheduled shift, a late slip will be turned in by the shift supervisor, to the administrative officer in charge of scheduling. The late slip will show the employee's reason for the tardiness whether it has been excused by the shift supervisor or not. If that tardiness is not excused, it will become part of the employees file. If an employee has Two (2) unexcused tardy slips within a Six (6) month period, a written warning will be issued and become a part of the employees file. If a third tardy is reported within the Six (6) month period, punitive action will be taken after due process, by a One day, (Eight 187 hour) suspension without pay. If a Forth tardy is reported within the same Six month period, punitive action will be taken after due process, by a Three day, (Twenty -Four 1243 hour) suspension without pay. If the Forth tardy is reported within Six months after the Third tardy was reported, punitive action will be taken after due process by a One day (Eight 183 hour) suspension. Progressive punitive action will be taken for excessive tardiness within any Six month period and continued abuse may result in that employees termination. Any employee charged with an unexcused tardy will have the right to rebuttal. The final determination of an excused or unexcused tardy will be made by the Chief of Police. All reprimands and disciplinary actions will be in accordance with the Village of Tequesta Employees Handbook. All late time will be deducted from the employee's accumulation of compensatory time. If the the lights are not working the flag will be lowered at sunset and raised again at sunrise. Vehicles which are towed as a result of an accident, abandoned, seized, incident to arrest, State Statute violation or local ordinance violation or otherwise detained in storage, and not in the possession of the owner become the responsibility of the impounding officer. The officer is liable for the vehicle, its parts and contents. The contents of the vehicle include, but is not limited to, all packages and containers located within the passenger compartment, the trunk, or any other secured area of the vehicle. To insure that liability does not attach for property located within any package or container, the contents of said package or container, whether it is opened or closed, is to be ascertained and inventoried. A vehicle impound record must be filled out with a property list supplement if needed, (use rear of form). All damage must be noted on the record. The wrecker driver must sign the form as acknowledgment for receipt of the vehicle, its condition, and the contents therein. The police department may tow vehicles under the following conditions. 1. Violations of Florida State Statute 316.1945 (as a last resort if the owner can not be located). 2. When ax vehicle has been found in violation of a local ordinance and after due process has been taken. 3. When a vehicle removal is in the interest of public safety due to an immediate emergency. 4. When the driver of a^ vehicle is taken into custody by the police and such v~ehicle would be illegally parked if left in the position of the stop. If legally parked, the driver may request to leave the vehicle where it is, or the driver may designate an authorized person to drive the vehicle, after 5. When the vehicle is being seized pursuant to Florida State Statute. 6. When a vehicle itself is evidence. 7. When a vehicle is recovered as stolen. Wreckers will be dispatched from the desk on a rotating basis and logged, unless a special request is made from a driver / owner of a vehicle. The department will not tow vehicles from private property or semi -private property open to the public, such as shopping center parking lots, unless the vehicle is subject to one of the previous condition. Complaints of private property parking should be referred to State Statute 715.07. The only involvement of the department will be to keep the peace between involved parties.
