The applicant will submit to the Village of Tequesta Department of Conunuruty Development vvith the following
docuinents for Planxung & Zoning Board review, forty-�ve (45) days prior to the nieeting date:
1) For new construction or additions, Fifteen (15) sets of professionally prepared site plans showing all
existing and proposed structures, setbacks, parking and loading layout, ingress and egress, sidewalks
and walkways, exterior lighting layout, dixnensions of street frontages and property lines and all
signage.
2) Fifteen (15) sets of Landscaping Plans in accordance with Village of Tequesta Code of Ordinances,
Division IV, Landscaping.
3) Fifteen (15) sets of multi-dimensional color renderings and/or photographs are to be provided. The
Planning & Zoning Board needs to see an exact rendering of what is to be placed on the site. Color
photographs or prints as close to the actual colors to be used must be supplied. Since color printers
often do not display the correct color, it is recommended that samples of the paint chips, as well as a
sample of the support materials (i.e., canvas, wood, metal, etc.) Ue provided.
4) One (1) set of Plans 11x17 size and One (1) disk.
5) Any other documents that may help clarify the position of the applicant.

Dear Mr. Baruch:
This letter is provided in response to your recent request concerning sanitary sewer service availability
for the subject project.
Please be advised that, as of this date, sanitary sewer service can be made available to the subject
property upon the payment of certain costs in accordance with the District Rules. Recent plans indicate
2 additional toilets (2.0 equivalent connections) for the subject building. The connection charge for each
toilet is $2,4Q0.26, for a total cost of $4,800.52. Prior to pian approvals or connection to the system an
Application for Service and payment must be received by this office.
Consistent with District policy, the Developer will be responsible for all costs associated with
connecting to the existing wastewater system of the District.

Mr. Baruch — I reviewed the preliminary site plan and other information submitted on �
May 13, 2011 for the proposed demolition of the existing paol building and the
construction of the proposed 2,900 sq. ft. 2 story fitness facility at the Tequesta Towers
Condominium. Based on the information provided indicating that the site is less than 10
acres in size and will still have less than 2 acres of impervious surface with no work in
and no impacts to wetlands or other surface waters, the work qualifies for a No Notice
General Permit for Activities in Uplands according to Section 40E-400.315, FAC of the
District's rules. Basically, this means that no application to the District is required and
the work is authorized by rule. Please iet me know if you have any questions.

FPL does not have an issue with the plans you sent over on 5/11/11 concerning the new pool building at
Tequesta Towers. The present pool building is being sub fed fram the main distribution panel.
I would check with the customer ta make sure they have enough load to feed the new building. It may
have to have its own power source.
If that is the case I will n2ed the electrical plans to determine how FPL will provide service.

TRAFFIC PERFORMANCE STANDARDS REVIEW
Dear Carol:
The Palm Beach County Traffic Division has reviewed the traffic statement for build-out
extension of the previously approved residential improvement project entitled Tequesta
Towers, pursuant to the Traffic Performance Standards in Article 12 of the Palm Beach
County Land Development Code. The project is summarized as follows:
Location: 400 Beach Road.
Municipality: Village of Tequesta
PCN #: 60-43-40-32-04-001-0000
Existing Uses: 44 MF residential Units, and 830 SF Pool & Fitness Room (to
be demolished).
New Proposal: Addition of 2,900 SF Pool & Fitness Room

Build-Out: Year End 2013
Based on our review, the Traffic Division has determined that the build-out extension for
the previously approved residential improvement project does not generate new trips and
therefore meets the Traffic Performance Standards of Palm Beach County. No building
permits are to be issued by the Town after the build-out date specified above. The
County traffic concurrency approval is subject to the Project Aggregation Rules set forth
in the Traffic Performance Standards Ordinance.

Statement of Compliance with Comprehensive Plan
Chief Weinand,
Below is the requested statement indicating how the proposed facility meets or exceeds each level
of service standards: Traffic, Sanitary Sewer, Drainage, Potable Water.
1. Traffic (roads and rights of way)- the project does impact traffic, roads or rights of
way. See attached letter from Palm Beach County Traffic Engineering stating that the
project does not generate new trips and therefore meets the Traffic Performance
Standards of Palm Beach County.
2. Sanitary Sewer- See attached letter from ENCON regarding sanitary service availability
for the proposed project.
3. Drainage- The proposed project has minimal iinpact and change to existing drainage
characteristics and drainage infrastructure currently in place (less than 1%).
4. Potable Water- The proposed project has no additional impacts to the existing potable
water service. See the attached letter from the Village of Tequesta Utilities Department.
Statement of Compifance with Comprehensive Plan:
The Tequesta Towers Pool/ Fitness Building is consistent with the goals, objectives, and all other
provisions of the Village Comprehensive Development Plan, Policy 1.1.Z. Its projected use will
also be specifically authorized by development ordinances and regulations, and all permits are
concurrently being sought from all applicable county, state and federal agencies.

The proposed application to demolish existing 410 Sq. Ft. pool cabana and construct a new Pool/Fitness
Building in the R-3 zoning district was filed at the Village May 27, 2011. The Development Review
Committee (DRC) reviewed the appiication in terms of compiiance with Village's Code, law enforcement,
fire safety, and public works requirements �June 8, 2011).
Also, the applicant had previously submitted a different application to build a pooiJfitness building in
December 2008. The fol�owing is a summary of the previous application timeline:
� January 8, 2009- Planning and Zaning Board Advisory Board (P&ZABi held a meeting to hear
appiication. Board recommended that additional information be provided.
�,4pril 30, 2009- Applicant met with residents and neighbors to discuss plans at Tequesta Towers.
� luly 2, 2009- Af�er a discussion by P�ZAB, the a��nlications v��as 9:al�ie�1 tc� a time certain of 8/20j09.
� August Z0, 2009- P&ZAB approved the application with a condition "Village staff scrutinize the
information presented by both Counsels and affirming that Viflage standards were met, to be
determined by Viilage sta�'".
The "Condominium J�ssociations" (Cliveden Jupiter Island Condominium ,4ssaciation, Inc.; Island �4ouse
Southwest Condominium Association , Inc.; Island House Nor�heast Condominium Association, Inc.; and
LaMar Condominium Association, Inc.) retained Lewes, Longman � Walker, P.A. to represent them and to
review the proposed site plan previously filed in 2008. The "condominium associations" fflled for an
appeal to challenge P&ZAB approval.
The applicant withdrew the previous application, and fiiled a new ap�lication that is par� of the current
petition which was scheduled to be heard by P�ZAB at the July 2011 public meeting. Erin L. Deady, Esq.
filed an appeai on behalf of the Condominium Associations July 7, 2011. The appeal was to be heard by
Village Council at the August 11` Public Hearing. The appeal was withdrew August 8, 2011.
