BACKGROUND Good Shepherd Episcopal School proposed to construct a 1,997 square foot addition to the existing school, which includes two (2) resource rooms and two (2) offices. Per Village's Code Section 78 -705 (28) (b) Required number of parking spaces, the proposed addition required the provision of an additional eight (8) parking spaces. Good Shepherd Episcopal School applied for a Variance from Code Section 78 -705 (28) (b) Required number of parking spaces so that it does not have to provide the required additional parking. Village Council approved the Variance application at the June 9, 2011, Public Hearing (See attached Variance Order). Since Good Shepherd Episcopal School is located on the R -1 zoning district, they needed to apply for a Special Exception Use to allow the expansion of their existing school. Village Council approved the Special Exception Use application at the June 9, 2011, Public Hearing. The Special Exception order includes conditions of approval that were imposed by the Village Council for this application. The applicant needs to meet those conditions before site planning approval (See attached Special Exception Use Order). Good Shepherd Episcopal School submitted its application for Planning and Zoning Advisory Board public hearing in June, 2011. DRC (Development Review Committee) met July 13th and provided comments to the applicant. The application was heard by the Planning and Zoning Advisory Board on August 4, 2011. The Board recommended approval 5 -0, and provided recommendations to the applicant (See attached meeting minutes). The current site plan analysis was conducted based on compliance with Village Code, conditions of approval imposed by the Special Exception Use order and recommendations of the Planning and Zoning Advisory Board. 4. Department of Community Development - Staff Report — Good Shepherd Episcopal Church and School 2 • • • Special Exception Use Conditions of Approval On June 9, 2011, Village Council approved a Special Exception Use for the addition to the existing Good Shepherd Episcopal School. The following conditions of approval were imposed by the Village Council: 1. "In the event that the applicant's student enrollment reaches 169 students, the applicant shall immediately implement a three (3) tiered system for student's pick -up ". On May 19, 2011, the elementary school started implementing a "tiered" dismissal schedule with 15t tier release at 2:55 pm and 2nd tier release at 3:05 pm. This strategy has improved the negative stacking situation at elementary school dismissal time. Additionally, the school has staggered releases times as follows: Early Learning dismissal at 11:30 am; Pre - School dismissal at 2:10 pm. The current 2011/2012 student enrollment is 115; with 18 full -time staff and 1 part -time staff. At this time, the applicant does not need to implement a three (3) tiered system. Also, staff has been monitoring stacking condition after classes started this school year. Currently, staff has observed no problems with stacking at the site. The site planning application meets this condition. 2. "The applicant shall enhance the hedge line on the south property line so that it is code compliant; the applicant shall also install, operate and maintain an irrigation system" The proposed landscape plan includes the following information regarding this condition: "210 Myrsine to replace southern property line hedge, remove existing mixed Ligustrum hedge, install a continuous native Myrsine hedge from Tequesta fire department fence corner (east) to utility box (west), fertilize, mulch, maintain, and water with a fully operational and maintained irrigation system ". The site planning application meets this condition. 3. "The applicant shall provide the Village with its student enrollment and faculty numbers on an annual basis. This shall be coordinated with the Community Development Department and the Village Clerk's Office." The current 2011/2012 student enrollment is 115; with 18 full -time staff and 1 part -time staff. The site planning application meets this condition. Planning and Zoning Advisory Board Recommendation The application was heard by the Planning and Zoning Advisory Board on August 4, 2011. The Board recommended approval 5 -0, and provided recommendations to the applicant (See attached meeting minutes). The PAZB recommendations were as follows: Coordinate with Gallery Square North property owner a mutual agreed solution regarding the southern property line hedge. The applicant provided a letter indicating that Gallery Square North agreed with the proposed landscape and irrigation system (See attached letter). Integrate supplemental rainwater harvesting with the irrigation system. Department of Community Development -Staff Report — Good Shepherd Episcopal Church and School 3 • • • FINAL REMARKS • This development application met the requirements set on Section 78 -334 notice of hearing. The notice of hearing was advertised in the Jupiter Courier on August 28, 2011. • This development application was reviewed by the Development Review Committee (DRC) including Community Development, Law Enforcement, Public Works and Fire Safety. • Palm Beach County Traffic Division has determined that "the proposed school facility expansion project does not include any addition to the number of students and will not generate any new daily or peak -hour trips, and therefore meets the Traffic Performance Standards of Palm Beach County ". • The applicant is proposing to demolish the current 8' wall located on the rear of the property. Village's law enforcement recommended to demolish this wall to provide clear sight that will foster a safe environment for the school activities. The original intent of the wall was to screen the landscaped courtyard, while also minimizing any noise that might affect the adjacent properties. Considering the current location of the playground area, the wall is not accomplishing its initial intent and it is becoming a potential hazard or unsafe area that it is difficult to monitor. • Per this application, it is assumed that there will not be an increase of students, and not additional impact on water consumption. "ov.,9411C".‘e.1 MAYOR TOM PAT)jNO, VILLAGE OF TEQUESTA Page 2 • • • DRAFT PLANNING AND ZONING ADVISORY BOARD MEETING MINUTES August 4, 2011 CALL TO ORDER AND ROLL CALL The Village of Tequesta Planning and Zoning Advisory Board held a regularly scheduled meeting at the Tequesta Village Hall, 345 Tequesta Drive, Tequesta, Florida, on Thursday, August 4, 2011. The meeting was called to order at 5:30 p.m. by Acting Community Development Director James Weinand. A roll call was taken by Lori McWilliams, Village Clerk, who noted the following were present: Chair James Hackett, Vice Chair Michael Schmidt, Board Members Elizabeth Schauer, Steve Okun, and Eric Jolly, and Alternate Edward Gigante. Also present were Acting Community Development Director James Weinand, Village Attorney Keith Davis, and Village Clerk Lori McWilliams. APPROVAL OF AGENDA MOTION Board Member Schauer moved to approve the agenda as submitted. Board Member Okun seconded the motion, which carried by unanimous 5 -0 vote. APPROVAL OF PREVIOUS MEETING MINUTES MOTION Board Member Jolly moved to approve the minutes of the July 7, 2011 meeting as submitted. Board Member Okun seconded the motion, which carried by unanimous 5 -0 vote. SWEARING IN OF WITNESSES Attorney Davis swore in all those intending to offer testimony in tonight's case. EX -PARTE COMMUNICATION Board Member Jolly disclosed his son had enrolled at Good Shepherd for the fall; he had checked with Palm Beach County Ethics Commission and found since he paid normal fees and received normal discounts this did not meet the special financial benefit. Chair Hackett reported he had had a brief conversation with a parent about this application coming before the Board. No other ex -parte communication was reported. OLD BUSINESS — There was no old business to come before the Board. • • PLANNING AND ZONING ADVISORY BOARD MEETING MINUTES August 4, 2011 " Page 2 of 4 NEW BUSINESS P &Z 5 -11 Application for site plan development review to construct a 1,997 sq. ft. addition to the existing Good Shepherd Episcopal School. The application includes a proposed landscape plan. The address of the proposed site plan review is 400 Seabrook Road, Tequesta, FL 33469. Acting Community Development Director James Weinand introduced the application. Consultant Nilsa Zacarias presented the staff report. The project had been reviewed by the Development Review Committee (DRC). Staff had reviewed the project for compliance, and project details were provided in the staff report. On June 9, 2011, the Village Council had approved the proposed Special Exception Use and imposed the following condition of approval: `The applicant shall enhance the hedge line on the south property line so that it is code compliant; the applicant shall also install, operate and maintain an irrigation system ". The landscape plan included the following in regard to this condition: "100 Myrsine to be installed along southern property line and irrigated (remove all dead /exotic plant material)" Jim Stergas made a presentation on behalf of the applicant, providing background information and describing the project. Board Member Okun urged the applicant to integrate supplemental rainwater harvesting with the irrigation system. Board Member Schauer asked about replacing the oak trees instead of transplanting due to their age; Mr. Stergas indicated transplanting should not be a problem but if so, the applicant would be agreeable to replacement. Staff provided a traffic performance standards review handout from Palm Beach County Traffic Engineering Division. The applicant responded to Vice Chair Schmidt's concerns regarding enclosing more space and concerns about water collection in large roof valleys, which he explained would flow into the courtyard. Public Comment Cyrese Colbert, 11663 Banyan Street, Palm Beach Gardens, explained she was Property Manager for Gallery Square North which was located adjacent to the subject property. Ms. Colbert reported Good Shepherd was a good neighbor and they got along well, but expressed concern regarding proposed replacement plantings for the alleyway, which were described to be the same kind of plants as those existing. She provided a handout of what the proposed Myrsine plants were supposed to look like, which was different than the existing plants. There had been problems with the existing tree roots growing into the sewer system, and the sod had had to be replaced numerous times. She asked if there would be berries and bugs, and advised these plants could grow to a height of 50 feet, so they should be maintained properly, and commented she would prefer a different plant and proper maintenance. Chair Hackett indicated there were better plant material choices. Mr. Stergas noted an irrigation system was encumbent upon Good Shepherd, and suggested the applicant work with the adjacent property owner to come up with an agreeable hedge material. Ms. Colbert requested to meet with the landscape company. Acting Community Development Director Weinand requested the two come to agreement and report the results to him before the Village Council meeting. MOTION Board Member Okun made a motion to approve the site plan for application P &Z 5 -11. Motion was seconded by Board Member Schauer. The vote on the motion was as follows: James Hackett Yes Michael Schmidt - Yes Steve Okun Yes Elizabeth Schauer - Yes Eric Jolly - Yes The motion therefore carried by unanimous 5 -0 vote. The 3.91 acre parcel is currently developed with two parking lots, a 12,500 SF church sanctuary, a 2,600 SF thrift shop, a 5,200 SF church office building, a 4,700 parish hall, and•a 13,622 SF school building.
