PETITION DESCRIPTION APPLICANT: Poe Poe's Precinct, Inc., d /b /a Clown Town P.O. Box 1232, Port Salerno, FL 34992 REQUEST: The applicant is requesting a Special Exception Use approval for a recreational indoor amusement facility pursuant to Sec. 78 -177 (d) (6) of the Village of Tequesta Code of Ordinances. LOCATION: County Line Plaza 668 N. US Highway 1 Tequesta, FL 33469 2. LAND USE AND ZONING The subject property is located in the County Line Plaza on the C -2 zoning district. 3. STAFF ANALYSIS Section 78 -361 of the Village Code states that certain uses because their unique characteristics can not be classified or regulated in a particular zoning district without consideration in each case of the impact of such uses upon neighboring uses and the surrounding area, compared with the public need for them at particular locations. Such uses and features are treated as special exceptions, and the application needs to comply with a set of criteria and standards. Department of Community Development - Staff Report — Special Exception Application — Poe Poe's Precinct, Inc., d /b /a Clown Town • CRITERIA FOR GRANTING SPECIAL EXCEPTION Per Section 78 -362 of Village Code, special exception use shall be permitted only upon authorization of the Village Council provided that such uses comply with the following requirements: 1. The proposed use is a permitted special exception use. In compliance with Section 78 -177 (d) (6) Special Exception Uses permitted in the C -2 district. "Indoor amusements" for recreational use is a permitted special exception use. Please see attached description and lay -out of activities to be held at the proposed recreational facility. 2. The use is so designated, located and proposed to be operated so that the public health, safety, welfare and morals will be protected. In compliance. Bounce -U, a youth and children recreational facility, has been operating at the Plaza since 2009. The proposed use is compatible with the overall character of the Plaza in terms of existing youth and children amusement activity. 3. The use will not cause substantial injury to the value of other property in the neighborhood where it is to be located. In compliance. The proposed use will not cause injury to the value of the other property in the Plaza where the subject property will be located. 4. The use will be compatible with adjoining development and the proposed character of the district where it is to be located. In compliance. The proposed use is compatible with adjoining commercial properties located at the County Line Plaza, and the overall character of the commercial Plaza. 5. Adequate landscaping and screening is provided as required in this chapter. In compliance. The subject property is located in an existing commercial Plaza that complies with this provision. Also, the proposed use does not add or modify the existing square footage of the facility. 6. Adequate off - street parking and loading is provided and ingress and egress is so designed as to cause minimum interference with traffic on abutting streets. In compliance. Per Code Section 78 -705 (29) since the subject property is located in an existing commercial Plaza, and the application does not involve increasing square footage, the proposed use meets the required parking. Also, since the subject property is located in an established Plaza loading area is provided in the rear of the building. 7. The use conforms with all applicable regulations governing the district where located, except as may otherwise be determined for planned developments. In compliance. The proposed use is located on a C -2 Community Commercial Use district, and conforms with all applicable regulations governing the district. FINDINGS REQUIRED FOR APPROVAL Per Section 78 -363 of Village Code, before any special exception is granted, the Village Council shall apply the standards set forth in this division and shall determine that satisfactory provision and arrangement of the following factors have been met with the applicant, where applicable: Department of Community Development - Staff Report — Special Exception Application — Poe Poe's Precinct, Inc., d /b /a Clown Town 2 • 1. Compliance with all elements of the Village Comprehensive Plan The subject property is located on an established Plaza in a Commercial future land use district. Policy 1.1.2 of the Village Comprehensive Plan states that Commercial district uses shall conform to "Activities related to the sale, lease or distribution of products /and /or the provision of services ". The proposed use "indoor amusement" meets this provision of the Comprehensive Plan. 2. Ingress and egress to property and proposed structures thereon with particular reference to automotive and pedestrian safety and convenience, traffic flow and control, and access in case of fire or catastrophe. The subject property is located in an existing commercial Plaza, ingress and egress to the property with particular reference to automotive and pedestrian safety, and access in case of fire or catastrophe are factors that are met. The proposed use "Indoor Amusement" meets this provision. 3. Off - street parking and loading area, where required, with particular attention to the items in subsection (2) of this section. Per Code Section 78 -705 (29) since the subject property is located in an existing commercial Plaza, and the application does not involve increasing square footage, the proposed use meets the required parking. Also, since the subject property is located in an established commercial Plaza a loading area is provided in the rear of the building. The proposed use "Indoor Amusement" meets this provision. 4. Refuse and service areas, with particular reference to subsections (2) and (3) of this section. As stated in subsections (2) and (3), the proposed use "Indoor Amusement" meets this provision. 5. Nuisance factors detrimental to adjacent and nearby properties and the village as a whole. Nuisance factors shall include but necessarily be limited to noise, odor, smoke, glare, electrical interference and /or mechanical vibrations. The proposed use is compatible with the overall character of the Plaza in terms of existing youth and children amusement activity. Bounce -U, a youth and children recreational facility, has been operating at the Plaza since 2009. The proposed use will not be detrimental to adjacent and nearby properties and the village as a whole. 6. Utilities, with reference to location, availability and compatibility. Since the subject property is located in an existing commercial plaza, utilities, with reference to location, availability and compatibility requirements are met. 7. Screening and buffering, with reference, to type, dimensions and character. This standard is not applicable to this application. Also, the proposed use does not add or modify the existing square footage of the facility. 8. Signs and proposed exterior lighting, with reference to glare, traffic safety, economic effect and compatibility and harmony with properties in the district. Since the subject property is located in an existing commercial plaza, signs and proposed exterior lighting will be in compliance with Code requirements and aesthetics provisions. The applicant will need to apply for permit for window and wall signs. Since the proposed use does not add or modify the existing square footage of the facility, this standard does not apply to this application. Also, the proposed use is part of an existing commercial Plaza that is in compliance with this provision. 10. General compatibility with adjacent properties and other property in the district. The proposed use is compatible with the overall character of the Plaza in terms of existing youth and children amusement activity. Bounce -U, a recreational facility, has been operating at the Plaza since 2009. 11. Whether the change suggested is out of scale with the needs of the neighborhood or the village. The proposed use is compatible with some of the existing uses that are currently located at the commercial plaza. 12. Any special requirements set out in the schedule of site regulations in 78 -143 for the particular use involved. The proposed use is located in C -2 Community Commercial District, since it is located in an existing commercial plaza is in compliance with the regulations requirements presented in 78- 143. This application does not involve special requirements. 8. FINAL REMARKS This special exception use application met the requirements set on Section 78 -368 notice of hearing. The notice of hearing was advertised in the Jupiter Courier on 8.28.11; and, it was also mailed to all property owners located within a 300 -foot radius of the property for which a special exception is requested. Per Code Section 78 -367, a special exception shall commence with 12 months from approval date; and only one extension shall be permitted by the Village Council up to six months. Hallway: Concession area which includes a hot dog roller, refrigerator, popcorn maker, tabletop vending box (chips & crackers) & gumball machine. • • Kitchen: Dining table The children's membership (daily, weekly or monthly) will include a member's yellow t -shirt, a yellow rose for friendship, a membership & identification card, fingerprints & drug awareness package. Once registered they will be escorted to a pretend jail where they will be fingerprinted, photographed and will receive their membership & identification card, t- shirt, yellow rose & drug awareness package. The fingerprints will go on file with Poe Poe's Precinct and the parents will receive a duplicate of the child's identification card which can be used in emergency cases to identify their missing or abducted child. Clown Town will also hold special monthly events such as Dance Fever, Costume Extravaganza, Movie Night with Poe Poe & Giggles, Game Jam & RC Hobby Spectacular. The club will also hold two events monthly called Bingo Bonanza and The Senior Jingle for the ladies & gentleman at the assisted living centers in Tequesta. Poe Poe and Giggles ultimate goal is to have safe place for youth to hangout. We want to help get them off the streets by educating them and providing them with a good, clean place to just hangout. We hope to help prevent them from drinking and using illegal substances and help the children currently using learn that you can have fun without them. Clown Town's rules will be enforced by Poe Poe & Giggles. The children will learn responsibility and how to take care of their own club. Rule breakers will first receive a warning, then probation and lastly suspension. SPECIAL EXCEPTION USES Sec. 78 -361. Purpose. The development and execution of a zoning ordinance is based upon the division of the village into districts, within which the use of land and structures and the bulk and location of structures in relation to the land are substantially uniform. It is recognized, however, that there are certain uses and features which, because of their unique characteristics, cannot be distinctly classified or regulated in a particular district without consideration in each case of the impact of such uses and features upon neighboring uses and the surrounding area, compared with the public need for them at particular locations. Such uses and features are therefore treated as special exceptions. A special exception is not the automatic right of any applicant. Sec. 78 -362. Criteria. Special exception uses and their related accessory uses or any expansion, enlargement, or modification of an existing special exception use shall be permitted only upon authorization of the village council provided that such uses shall be found by the village council to comply with the following requirements and other applicable requirements as set forth in this chapter: (1) The proposed use is a permitted special exception use. Indoor amusements is a permitted special exception use. (2) The use is so designed, located and proposed to be operated so that the public health, safety, welfare and morals will be protected. Yes. (12) Any special requirements set out in the schedule of site regulations in section 78 -143 for the particular use involved. Proposed use meets section 78 -143 in the C -2 district. Sec. 78 -368. Application; notice of hearing. (a) A written petition for special exception shall be submitted indicating the section of this chapter under which the special exception is sought and stating the grounds on which it is requested, with particular reference to the written findings under section 78 -363 and other specific conditions, if applicable, which the village council shall address. The pptjtion shall include all material necessary to meet the requirements of the development concept plan listed in subsection (b) of this section and any additional in formation that will demonstrate that the grant of special exception will be in harmony with general intent and purpose of this chapter. A petition for a special exception addressing 78 -363 and 78 -362 has been submitted. (b) A petitioner seeking special exception approval shall submit a development concept plan on one or more sheets of paper measuring not more than 24 by 36 inches and drawn to a scale not smaller than 100 feet to the inch. The following shall be provided on the development concept plan: • This is not a development concept. It is a business within an existing shopping center. (1) Scale, date, north arrow, vicinity sketch, title of the project and total gross • • acreage. Not required, existing shopping center. (2) The boundaries and dimensions of the property and its relationship to the surrounding road system, including the width of the existing travelway (pavement). Not required, existing shopping center. (3) The location and dimension of existing manmade features such as existing roads and structures, with indication as to which are to be removed, renovated or altered. Not required, existing shopping center. (4) The location of existing easements, watercourses, section lines, and water and sewer lines, well and septic tank location, and other existing important physical features in and adjoining the project. Not required, existing shopping center. (5) The location and delineation of existing trees and information as to which trees will be removed. Not required, existing shopping center. (6) Identification of surrounding land use, zoning and existing buildings within 100 feet of the petitioned site, as well as the zoning of the petitioned site. Not required, existing shopping center. (7) A layout of the proposed lots and /or building sites including the following site data: a. Finished floor elevation. b. Common open area. c. Generalized landscaping and buffer areas. d. Internal circulation patterns including off- street parking and loading facilities. e. Total project density. f. Percentage of building coverage. g. Percentage of impervious surface coverage. h. The owner of the property for which special exception is sought or his agent or attorney designated by him on the submitted petition shall be notified by mail of the date and time of the hearing. Notice shall be given by mail to all owners of property within a 300 -foot radius of the boundary lines of the property for which a special exception is requested. The list of property owners within the stated radius shall be provided by the applicant from the most recent tax roll information as provided by the county appraiser's office. The applicant must furnish an affidavit signed by the person responsible for providing the list. Clown Town will be visited by Tequesta Police Officers, Firefighters and other professionals who will speak about their jobs & responsibilities; Room #2: Movie theatre with 60" television and set up to comfortably fit 15 children. Hallway: Concession area which includes a hot dog roller, refrigerator, popcorn maker, tabletop vending box (chips & crackers) & gumball machine. • • Kitchen: Dining table The children's membership (daily, weekly or monthly) will include a member's yellow t -shirt, a yellow rose for friendship, a membership & identification card, fingerprints & drug awareness package.
