SUBDIVISIONS. ARTICLE V. DESIGN STANDARDS. DIVISION 1. GENERALLY. BY AMENDING SUBSECTION (G)(3) OF SECTION 66-161. GENERAL STANDARDS; LEVEL OF SERVICE STANDARDS. TO CORRECT THE STATED PUBLIC DR.AINAGE FACILITIES LEVEL OF SERVICE STANDARD FROM A THREE-YEAR FREQUENCY STORM EVENT TO A TWENTY-FIVE YEAR FREQUENCY STORM EVENT IN CONFORMANCE WITH THE VILLAGE' S COMPREHENSIVE PLAN; PROVIDING THAT EACH AND EVERY OTHER SECTION AND SUB-SECTION OF CHAPTER 66. SUBDIVISIONS. SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the Village Council of the Village of Tequesta desires to correct the stated level of service standard for stormwater drainage facilities from a three-year frequency storm event to a twenty-five year frequency storm event in order to be consistent with other sections of the Village's Code of Ordinances and the Village's Comprehensive Plan; and WHEREAS, the Village Council believes that these revisions to the Village's Code of Ordinances are in the best interests of the Village of Tequesta, and will promote the public health, safety and welfare. NOW THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, THAT: Section 1: Chapter 66. Subdivisions. at Article V. Design Standards. at Division 1. Generally. of the Code of Ordinances of the Village of Tequesta, Florida is hereby amended at Subsection (g)(3) of Section 66-161. General Standards; Level of Service Standards. to correct the stated public drainage facilities level of service standard; providing that Sec. 66-161 sha11 hereafter read as follows: Sec. 66-161. General standards; level of service standards. (a) —(� (Shall remain the same as previously adopted) 1 (g)(1) —(g)(2) (Shall remain the same as previously adopted) (3) Drainage. A public drainage facilities level of service standard of a t�e� � twentv-five (251 vear frequency, 24-hour duration storm event is hereby adopted, and shall be used as the basis of estimating the availability of capacity and demand generated by a proposed development project. As a general drainage requirement, each proposed project and/or site shall maintain 95 percent of all stormwater runoff on-site. (g)(4) —(g)(5) (Shall remain the same as previously adopted) (h) —(n) (Shall remain the same as previously adopted) Section 2: Each and every other section and sub-section of Chapter 66. Subdivisions. of the Code of Ordinances of the Village of Tequesta. sha11 remain in full force and effect as previously enacted. Section 3: All Ordinances or parts of Ordinances in conflict herewith be and the same are hereby repealed. Section 4: Should any Section or provision of this Ordinance or any portion thereof, any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder of this Ordinance. Section 5: Specific authority is hereby granted to codify this Ordinance. Section 6: This Ordinance shall become efFective immediately upon passage.
