� WHEREAS. Florida Statute. Section 163.01 ( 1991), known
as the "Florida Interlocal Gooperation Act of 1969," authorizes I
lacal governments to m�ke the most efficient use of their gowers !
�bp enabling them to cooperate with other localities or► a basis
�of mutual advantage and thereby to provide services and '
ifacilitiss that will harmonize geographic, economic, papulation ,
iand other factors influsncing the needs and devslogments of !
ilocal communities; and
,� WHEREAS, the Florida Interlocal Coogsration Act af 1969 �
;germits public agencies, as defined therein, to enter into ,
!interlocal agreements with each other to jointly exercise any ,
�'power, privilege, or authority which such agencies share in
I lcommon and which each might exercise segarately; and ;

; WHEREAS, Section 18 of Ghapter 93-206, Laws of Florida, i
il Greated Flarida �tatute. Section 171.046, providing fQr the
iannexation of enclaves puzsuant tv interlocal agreements between ,
'municipalitiss and the �ounty which have 7urisdiction over such
�i enclaves; and 'I

!� WHEREAS. Florida Statute, Section 171.04C�, limits �,
�annexation by interlocal agresment to snclaves of ten {10) acres ��
or less in size; and ,
! WHEREAS, Flor ida Statute. Sect ion 171. 031( 13> < a} and I
�'<b), as amended by Chapter 93-206. Laws of Florida. defines �,
( enclaves as developed ar imgroved propert� bounded on all sides
by a single municipality, or bounded by a single municigality �
and by a natural or manmade obstacle that allows gassage af
j',vehicular traffic to that unincorporated area only through the
municipality; and
WHEREAS, the County and the Village have determined
i ithat it is appropriate and will promate efficient provision of
�Igovernmental services for the Village to annex certain enclaves; ,

�'i WHEREAS, the County and the Village have determined �
that the parcels to be annexed pursuant to this interlocal �i
��agresment are improvEd property based ugan the availability of
��water and sewer systems; the availability and access to public
��right-of-way; that the lots have greviausly besn cleared; and '
��that the lots have been subdivided and recorded or unrecorded !,
�plats; and ,

�� WHEREAS, it has been determined by the Village that the '

I �parcels to be annexed via this interlocal agreement meet the
i reguirements set out in Flor ida Statute. Sect ion 171. 031( 13> t a>
,and <b>, and Section 171.046, as such enclaves are developed or �
i�imgroved, are less than ten (10> aares in size and are !
�'�'cQmpletely surrounded by the Village or are surrounded by the '
��Village and a natural or manmade obstacle that allows gassage or ;
�jvehicular traffic to the enclaves only through the Villaqe. i

NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL
,� OF THE VILLAGE OF TEQUESTA, FLORIDA, as foilows: ',

' Section 1. That the Village Council is hereby i
!authorized and directed to execute an interlocal agreement ;
j�tattached hereto and incorporated herein as Exhibit "A"> with
IiPalm Beach �ounty on behalf of the Village of Tequesta. j
,j Section 2. Upon execution of the interlocal agreement. �
�the Villags Clerk is hereby directed and authQrized to transmit ,
I suff icient copies of same to the appropriate off ices of Palm ,
! Beach County for Falm Beach County's consideration of execution !

political subdivisiori oi the State of Florida, and �th� Village of
Tequesta, providiriq for the annexatiQn of enclaves �ursuant ta
Section 171.046. Florida Statutes.

of �P� �____�/���°___ _. 1994, between the Villaqe of Tequesta, a
rnunicipal ity 1QGated 'in Palm Beach Gounty. Florida, hereinafter
referred to as "Village", and PALM BEACH COUNTY, a political
subdivision of the State of Florida, hereinafter referred to as
"COUNTY", each one constitutinq a public agency, as defined in
Part 1 of Chapter 163, Florida Statutes.
WHEREAS. Section 163.01, Florida Statutes < 1991), known
as the "Florida Interlacal Caaperation Act of 1969," authorizes
local qovernments ta make the most efficient use of their powers
by enabling them to coaperate with other localities on a basis of
mutual advantage and, thereby, to provide services and facilities
that will harmonize g�ographic, economic, gopulation and other
factors influencing the nesds and development of local
communities; and
WHEREAS. The Florida Interlocal GooperatiQn Act of 196!
permits public agencies, as defined therein, to enter into
Interlocal Aqreements with each other to 7air�tly exercise any
pvwer, grivile,qe, or authority which such agencies share in
cammon and which each miqht exercise separately; and
WHEREAS, Section 18 of Chapter 93-206 of the Laws of
Florida created Section 171.046, Flor�ida Statutes, providinct for
annexation of certain enclaves by entering into an Interlocal
Agreement between the M��nicigality and the �ounty having
jurisdiction over such enclave; and
WHEREAS, Sect ian 171. 04h, Flc�r ida �tatutes, 1 imits
annexation by Interlocal Agreement to enclaves of ten (10? acres
or less in size; and
WHEREAS, Sect ion 171. 0� 1< 13> < a) and ( b> , as amended by
Chapter 93-206. Laws of Florida, defines enclaves as developed or
improved property bounded on all sides by a sinc�le municigality.

WHEREAS, the Cour�ty and the Viliaqe have detsrmined that�
the parcels to be annexed pursuant to this Interlocal Aqresment
are improved progerty based upon the availabilitX of water and
sewer Systems; the availability and access to a public right-of-
way; that the lots have previausly besn cleared; and that the
lots ha•�e baen subdivided in recorded or unrscorded plats; and
WHEREAS, it has bsen determined b,y t2ie Villa,qe and b� the
Covnty that the garcels to �e annexed via this Interlocal
Agresment meet the reguirements set out in Ssction 171.031i 13)ta)
and tb) and 171.046, Florida Statutss, as such enclaves are
developsd or are improved, are ten t14> acres or less in size,
and are completel�r surrounded bp the Village or are surrounded by
ths Villaqe and a natural or manmade obstacle that allows passaqe
of vehicular traffiG to the enclaves only throuqh the Village;
and
WHEREAS, the Gounty and the Village agree that the
parcels to be annexed via this Interlocal Aqreement are sub7ect
to the Land Use Atlas of the Falm Beach County Comgrehensive Plan
and County zoning and subdivision requlations until the Village
adopts a Comprehensive Plan amendment to include the parcels t4
be annexed in the Comgrehensive Plan.
NQW THEREFORE, in cansideration of the mutual
representations, terms, and covenants hezeinafter set forth, the
parties herebX aqree as follows:
Section 1. Purposa.
The purgose of this Aqreement is to allaw annexation by
the Villa,qe of certain unincorporated enclaves which are
identitisd in Exhibit "A" which is attached hereto and made a
part hereof.
Sec ion 2. Def init ions.
The follvwing definitians shall agply to this Aqreement:
1. The term "enclaue" shall be defined as set forth in
Section 171.031( 13)ta> and tb), Florida Statures as
adopted by the Leqislaturs in Chapter 93-205, Seation 25,
Laws of Florida.
2. "Act " means Fart 1 of Chapter 163, Florida Statutes.
3. "Agresment" means this Interlocal Aqresment,
including any amendments or �upplements hereto, sxecuted
and deliversd in acaordance with the terms hereof.
SeGtion 3. Annexation.

The unincorgorated enclaves ident if ied iii Exhibit "A",
which is attached hereto and made a part hereof, are hereby
annexed into and are included in the corgorate boundariss of the
Village of Tequesta.
Sec tion 4. Effective Date.
This Agreement shall take effect upon execution b� both
parties.
Seotion 5. Filing.
. Upon execution by both partiss, a copy of this Agreement
shall be filed with the Clerk of the Circuit Caurt in and for
Palm Beach County.
Sect i on 6. Not if icat ion.
The Villaqe herebp acknowledqes that it has provided
written notice to all owners of real propertk located in the
enclaves identified in Exhibit '•A" whose names and addresses are
known by reference to the latest published ad valorem tax records
of the Palm Beach Gaunty Property Agpraiser. The written r►otice
shall describe the purgose of the Interlacal Agreement and shall
state the date, time and place of the meeting of the Villaqe
Council of the Villaqe of Tequssta where this Interlocal
P,qreement shall be cansidered for adoption. The written notice
shall also indicate the name and telephone numbsr of a Palm Beach
County staff person to contaat reqardiriq the date, time and place
when the Palm Beach County Board of County Commissioners shall
consider the adaption of this Interlocal Agresment.
Section 7. Captions. '
The captions and section designatians herein set f orth
are for convenience only and shall have no substantivs msaning.
Section 8. Severability.
In the event that anX section, paragraph, sentence,
clause, or provision hereof be held by a court of competent
jurisdiction to be invalid, such shall not affect the remaininq
portions of this Aqreement and the same shall remain in full
f orce and ef f ect .
Section 9. Entiret,y of Agreement.
This Aqreement represents the entire understandinq
betwesn the parties, and supersedes all other negotiations,
representations, or aqresment, either written ar oral, relatinq
to this Aqreement.
