AN ORDINANCE OF THE VILLAGE COUNCIL OF TI-� VILLAGE OF
TEQUESTA, FLORIDA, AMENDING TI-� VILLAGE CODE OF
ORDINANCES AT CHAPTER 62. PLANNING AND DEVELOPMENT.
ARTICLE N. ADEQUATE FACILIT'IES AND CONCURRENCY
MANAGEMENT. DIVISION 1. GENERALLY. BY AMENDING
SUBSECTION (3) OF SECTION 62-92. LEVEL OF SERVICE STANDARDS.
TO CORRECT THE STATED PUBLTC DRAINAGE FACILITIES LEVEL OF
SERVICE STANDARD FROM A THREE-YEAR FREQUENCY STORM
EVENT TO A TVVE�NTY-FIVE YEAR FREQUENCY STORM EVENT IN
CONFORMANCE WITH THE VILLAGE'S COMPREHENSIVE PLAN;
PROVIDING THAT EACH AND EVERY OTI�R SECTION AND SUB-
SECTION OF CHAPTER 62. PLANNING AND DEVELOP1VIElVT. SHALL
REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED;
PROVIDING A CONFLICTS CLAUSE, A SEVERABII,ITY CLAUSE AND
AUTHORTI'Y TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR
OTHER PURPOSES.
WHEREAS, the Village Council of the Village of Tequesta desires to con+ect the stated
level of service standard for stormwater drainage facilities from a three-year frequency storm
event to a twenty-five yeaz fiequeacy storm event in order to be consis�tent with other s�ctions of
the Village's Code of Ordinances and the Village's Comprehensive Plan; and
WHEREAS, the Village Council believes that these revisions to the Village's Code of
Ordinances are in the best interests of the Village of T�uesta, and will promote the public
health, sa.fety and welfare.
NOW THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VII.LAGE OF TEQUESTA, FLORIDA, THAT:
Section 1: Chapter 62. Planning and DeveZopment. at Article N. Adequate Facilities
and Concurrency Management. at Division 1. Generally. of the Code of Ordinances of the
Village of Tequesta, Florida is hereby amended at Subsection {3) of Section 62-92. Level of
Service Standards. to correct the staxed public drainage facilities level of service standard;
providing that Sec. 62-92 shall hereafter read as follows:
Sec. 62-92. Level of service standards.
(First paragraph shall remain the same as previously adopted)

(3) Drainage. A public drainage facilities level of service standard of a�ee-
� entv-five (25) veaz frequency, 24-hour duration storm event is hereby
adopted, and shall be used as the basis of est�at;ng the availability of capacity
and demand generated by a proposed development project As a general drainage
requirement, each proposed project and/or site sha11 ma.intain 95 percent of all
stormwater ninoff on-site.

Section 2: Each and every other section and sub-section of Chapter 62. Planning and
Development. of the Code of Ordinances of the Village of Tequesta sha11 rema.in in full force and
effect as previously enacted.
Section 3: All Ordinances or parts of Ordinances in conflict herewith be and tb.e same
are hereby repealed.
SecNon 4: Should any Section or provision of this Ordy.nance or any portion thereof,
any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid,
such decision sha11 not affect the validity of the remainder of this Ordinance.
Section 5: Specific authority is hereby granted to codify this Ordinance.
Section 6: This Ordinance shall become effecrive immediately upoi� passage.
