• 3. BACKGROUND
The proposed application to demolish existing 410 Sq. Ft. pool cabana and construct a new Pool/Fitness
Building in the R-3 zoning district was filed at the Village May 27, 2011. The Development Review
Committee (DRC) reviewed the application in terms of compliance with Village's Code, law enforcement,
fire safety, and public works requirements (June S, 2011).
Also, the applicant had previously submitted a different application to build a pool/fitness building in
December 2008. The following is a summary of the previous application timeline:
■ January 8, 2009- Planning and Zoning Board Advisory Board (P&ZAB) held a meeting to hear
application. Board recommended that additional information be provided.
■ April 30, 2009- Applicant met with residents and neighbors to discuss plans at Tequesta Towers.
■ July 2, 2009- After a discussion by P&ZAB, the application was tabled to a time certain of
8/20/09.
■ August 20, 2009- P&ZAB approved the application with a condition "Village staff scrutinize the
information presented by both Counsels and affirming that Village standards were met, to be
determined by Village stafF".
The "Condominium Associations" (Cliveden Jupiter Island Condominium Association, Inc.; Island House
Southwest Condominium Association, Inc.; Island House Northeast Condominium Association, Inc.; and
LaMar Condominium Association, Inc.) retained Lewes, Longman & Walker, P.A. to represent them and
to review the proposed site plan previously filed in 2008. The "Condominium Associations" filed for an
appeal to challenge P&ZAB approval.
� The applicant withdrew the previous application, and filed a new application that is part of the current
petition which was scheduled to be heard by P&ZAB at the July 2011 public meeting. Erin L. Deady, Esq.
filed an appeal on behalf of the Condominium Associations July 7, 2011. The appeal was to be heard by
Village Council at the August 11 Public Hearing. The appeal was withdrawn August 8, 2011.
The application was heard by the Planning and Zoning Advisory Board on September 1, 2011. The Board
recommended approval 5-0 (See attached meeting minutes). Also, please see attached power point
print out presented at P&Z meeting. Graphics include detail analysis of Village Code height provisions
related to this application in the R-3 zoning district.
4. STAFF REVIEW
The proposed structure is a pool/fitness building which is an accessory structure in the R-3 Multiple-Family
Dwelling Zoning District.

MEETING MINUTES
September 1, 2011
CALL TO ORDER AND FtOLL CALL
The Village of Tequesta Planning and Zoning Advisory Board held a regularly
scheduled meeting at the Tequesta Village Hall, 345 Tequesta Drive, Tequesta, Florida,
on Thursday, September 1, 2011. The meeting was called to order at 5:30 p.m. A roll
call was taken by Deanna Mayo, Assistant to the Village Clerk, who noted the following
were present: Chair James Hackett, Vice Chair Michael Schmidt, Steve Okun, Eric
Jolly, and Alternate Edward Gigante. Also present were Acting Community
Development Director James Weinand, Village Attorney Keith Davis, and Village Clerk
Lori McWilliams. Board Members Elizabeth Schauer was absent from the meeting.
APPROVAL OF ACENDA

Board Member Okun moved to approve the agenda as submifted. Board Member Jolly
� seconded the motion, which carried by unanimous 5-0 vote.

EX-PARTE COMMUNICATION
Chair Hackett reported he shared an office with the landscape architect but had not
seen any of the plans for this project. No other ex-parte communication was reported.
Consultant Nilsa Zacarias presented the staff report and provided background
information. The project had been reviewed by the Development Review Committee
(DRC) and was in compliance with Village of Tequesta codes.
Conrad Damon provided a history of Tequesta Towers, explaining the project had been
previously approved by this Board with conditions and direction to staff to ascertain that
complaints made by neighbors in a power point presentation were really non-issues.
The objecting condominium associations had �led an appeal; staff had conducted an
exhaustive review process and they believed the project to be code compliant. Mr,
Damon stressed it was important to bear in mind that all the technical objections were
red herrings, and the real issue was a perceived impact on the view which would be
caused by this two-story building. Mr. Damon commented there was no legal right to
any view, and explained the Village of Tequesta Code requirements on how to calculate
building height. The applicant had filed a new apptication and the neighbors had filed
• an appeal on the staff report, arguing that the code was unclear regarding accessory
building height. The building height presenfied tonight was slightly less than that
allowed by Tequesta Code, and all other code conditions had been met.
Public Comment
Bob Berns, resident of Tequesta Towers for eleven years, expressed his opinion that
since the votes for this project had taken place three years ago, they should be verified,
and that this project was too costly to build in the current economy. Village Attorney
Davis clarified the Board was obligated to process the appfication that was before them.
Board Comments
Board Member Gigante expressed his opinion that staff had been very diligent in
reviewing this application. Board Member Jolly asked about square footage, which was
clarified by staff. Board Member Okun stated he had no questions. Vice Chair Schmidt
commented there could be a problem with floor height if DEP were involved, since for
property east of the coastal control line the measurement of building height was
different than in Tequesta's code. Mr. Scott, architect for the applicant, indicated a
conditional permit had been received from DEP and there had been no issues.

1) For new construction or additions, Fifteen (15) sets of professionally prepared site plans showing all
existing and proposed structures, setbacks, parking and loadii�g layout, ingress and egress, sidewalks
and walkways, exterior lighting layout, dimensions of street frontages and property lines and all

2) Fifteen (15) sets of Landscaping Plans in accordance with Village of Tequesta Code of Ordinances,
Division N, Landscaping.
3) Fifteen (15) sets of inulti-dimensional color renderings and/or photographs are to be provided. The
Planning & Zoning Board needs to see an exact rendering of v��hat is to be placed on the site. Color
photographs or prints as close to the actual colors to be used must be supplied. Since color printers
often do not display the correct colar, it is recommended t1�at samples of the paint chips, as well as a
sample of the support materials (i.e., canvas, wood, metal, etc.) be provided.
4) One (1) set of Plans 11x17 size and One (1) disk.

for the subject project.
Please be advised that, as of this date, sanitary sewer service can be made available to the subject
property upon the payment of certain costs in accordance with the District Rules. Recent plans indicate

Mr. Baruch — I reviewed the preliminary site plan and other information submitted on
May 13, 2011for the proposed demolition of the existing pool building and the
construction of the proposed 2,900 sq. ft. 2 story fitness facility at the Tequesta Towers
Condominium. Based on the information provided indicating that the site is less than 10
acres in size and will still have less than 2 acres of impervious surface with no work in
and no impacts to wetlands or other surface waters, the work qualifies for a No Notice
Genera! Permit for Activities in Uplands according to Section 40E-400.315, FAC of the
District's rules. Basically, this means that no application to the District is required and
the work is authorized by rule. Please let me know if you have any questions.
