This cause came on to be heard upon the above application and the Tequesta Village Council having
considered the evidence presented by the applicant and other interested persons at a hearing called and
properly noticed, and the Tequesta Village Council, being otherwise duly advised,
THEREUPON, THE TEQUESTA VILLAGE COUNCIL F1NDS AS FOLLOWS:
1. The subject property is located in the R-3 Multiple Family Dwelling Zoning District in
the Village of Tequesta.
2. The applicant has submitted all documents required by the Village's Code of Ordinances
for site plan review.
3. The application and all supporting documentation and presentation materials as
reviewed by the Village Council at its October 13, 2011 meeting, and as kept on file by
the Village, are made a part hereof and are hereby incorporated by reference.
4. According to Section 78-331, site plan approval is required.
5. The applicants have applied for a site plan review to allow the demolition of the existing
410 s.f. pool cabana, and construction of a new 2904 s.f. pool cabana and fitness
building in accordance with the site plan and application attached hereto as Exhibit "A".
6. Under the provisions of the Village Code of Ordinances, the Village Council has the
right, power and authority to act upon the request herein made.

IT IS THEREUPON CONSIDERED, ORDERED AND ADJUDGED BY THE VILLAGE
COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS:
The application for Site Plan Review, Case No. SPR 3-11 with reference to the above described
property within the Village of Tequesta, Palm Beach County, Florida, to permit the following:
demolition of the existing 410 s.f. pool cabana, and construction of a new
2904 s.f. pool cabana and fitness building in accordance with the site plan
and application attached hereto as Exhibit "A"
is hereby APPROVED since the Village Council hereby finds that the applicants have met the standards
set forth in Section 78-331 of the Tequesta Zoning Code for site plan review, with the following special
condition:
The applicant shall comply with all conditions of its DEP permit prior to the issuance of a building
perinit.
* The term Aapplicant(s)@ as used herein shall include all successors and assigns.
* The applicant's site plan approval shall expire in twelve (12) months unless a building permit has
been obtained in accordance with Sec. 78-334(9). If the building permit expires or is voided, the site
plan approval also expires or becomes void.

Zoning Board. The Planning & Zoning Board meets the first Thursday of every month at 5:34 p,m., as
needed in the Villa:ge Hall Cauneil Chambers, 345 Tequesta Drive. The applicant will be informed by letter
of their scheduled meeting date. Due to administrative review, the meeting date the applicant is scheduled to
attend, may not be the closest meeting to when the application is submitCed.
The Planning & Zoning Board is an Advisory Board only. After review and recommendation by the
Planning & Zoning Board, applications will be heard at the next available Council Meeting of the

doctunents for Planning & Zoning Baazd review, forty-five (45) day�s pzior to the meeting date:
1) For new construction or additions, Fifteeu (15) sets of professionally prepared site plans showing all
existing and proposed structures, setbacks, parking and loading layout, ingress and egress, sidewalks
and walkways, exterior lighring layout, dimensions of street frontages and property lines and all
signage.
2) Fifteen (15) sets of Landscaping Plans in accordance with Village of Tequesta Code of Ordinances,
Division IV, Landscaping.
3) Fifteen (15) sets of multi-dimensional color renderings and/or photographs are to be provided. The
Planning & Zoning Board needs to see an exact rendering of what is to be placed an the site. Color
photographs or prints as close to the actual colors to be used must be supplied. Since color printers
often do not display the correct colar, it is recommended that samples of the paint chips, as well as a
sample of the support materials (i.e., canvas, wood, metal, etc.) be provided.
4) One (1) set of Plans 11x17 size and One (1) disk.
5) Any ather documents that :may help clarify the position of the applicant.

This letter is provided in response to your recent request concerning sanitary sewer service availability
for the subject prajec�.
Please be advised that, as of this date, sanitary sewer service can be made available to the subject
property upon the payment of certain costs in accordance with the Distsict Rules. Recent plans indicate
2 additional toilets (2.0 equivalent cannectians) for the subject building. The connection charge for each
toilet is $2,400.26, for a total cost of $4,800.52. Prior to plan approvals or connection to the system an
Applica�ion for Service and payment must be received by this office.
Consistent with District poiicy, the Developer will be responsible for all costs associated with
connecting to the existing wastewater system of the District.

Mr. Baruch — I reviewed the preliminary site plan and other information submitted on
May 13, 2011for the proposed demolition of the existing pool buiiding and the
construction of the proposed 2,900 sq. ft. 2 story fitness facility at the Tequesta Towers
Condorninium. Based on the information provided indicating that the site is less than 10
acres in size and will still have less than 2 acres of impervious surface with no work in
and no impacts to wetlands or other surFace waters, the work qualifies for a No Notice
Genera! Permit for Activities in Uplands according to Section 40E-400.315, FAC of the
District's rules. Basically, this means that no application to the District is required and

Scott,
FPL does not have an issue with the plans you sent over on 5/11J11 concerning the new pool buiiding at
Tequesta Towers. The present pool building is being sub fed from the main distribution panel.
I would check with the customer to make sure they have enough load to feed the new building. It may
have to have its own power source.
If that is the case I will need the electrical plans to determine how FPL will provide service.

Please be aware of the following requirements under Florida Administrative Code (F.A.C.) Chapter
64E-9 covering public swimming pools.
1. The restroom facilities provided must comply with the requirements of F.A.C. 64E-
9A06(2)(f)(3)•
2. Relocation of the pool equipment to an area outside the building will require a
modification permit. Please cantact me regarding permitting the relocation when
appropriate.

Dear Carol:
The Palm Beach County Traffic Division has reviewed the traffic statement for build-out
extension of the previously approved residential improvement project entitled Tequesta
Towers, pursuant to the Traffic Performance Standards in Article 12 of the Palm Beach
County Land Development Code. The project is summarized as follows:
Location: 400 Beach Road.
Municipality: Village of Tequesta
PCN #: 60-A�3-40-32-04-Q01-0000
Existing Uses: 44 MF residential Units, and 830 SF Pool & Fitness Room (to
be demolished).
New Proposal: Addition of 2,900 SF Pool & Fitness Room
New Daily Trips: None
New PH Trips: None
Build-Out: Year End 2013
Based on our review, the Traffic Division has determined that the build-out extension for
the previously approved residential improvement project does not generate new trips and
therefore meets #he Traffic Performance Standards of Palm Beach County. No building
permits are to be issued by the Town after the build-out date specified above. The
County traffic concurrency approval is subject to the Project Aggregation Rules set forth
in the Traffic Performance Standards Ordinance.

Below is the requested statement indicating how the proposed facility meets or exceeds each level
of service standards: Traffic, Sanitary Sewer, Drainage, Pota.ble Water.
1. Traffic (roads and rights of way)- the project does impact traffic, roads or rights of
way. See attached letter from Palm Beach County Traffic Engineering stating that the
project does not generate new trips and therefore meets the Traffic Performance
Standards of Palm Beach County.
2. Sanitary Se��er- See attached letter from ENCON regarding sanitary service availability
for the proposed project.
3. Drainage- The proposed project has rminimal impact and change to ex.isting drainage
characteristics and drainage infrastructure currently in place (less than 1%).
4. Potable Water- The proposed project has no additional impacts to the existing potable
water service. See the attached letter from the Village of Tequesta Utilities Department.
Statement of Compliance with Comprehensive Plan:
The Tequesta Towers Pool/ Fitness Building is consistent with the goals, objectives, and all other
provisions of the Village Comprehensive Development Plan, Policy 1.1.2. Its projected use will
also be specifically authorized by development ordinances and regulations, and all perznits are
concurrently being sought from all applicable county, state and federal agencies.
