• AN ORDINANCE OF THE VILLAGE COUNCIL �F THE VILLAGE OF
TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF
ORDINANCES AT CHAPTER 66. SUBDNISIONS. ARTICLE V. DESIGN
STANDARDS. DIVISION l. GENERALLY. BY AMENDING SUBSECTION
(G)(3) OF SECTION 66-161. GENERAL STANDARDS; LEVEL OF SERVICE
STANDARDS. TO CORRECT THE STATED PUBLIC DRAINAGE
FACILITIES LEVEL OF SERVICE STAI�tDARD FROM A THREE-YEAR
FREQUENCY STORM EVENT TO A TWENTY-FIVE YEAR FREQUENCY
STORM EVENT 1N CONFOR:MANCE WITH THE VILLAGE' S
COMPREHENSIVE PLAN; PROVIDING THAT EACH AND EVERY OTHER
SECTION AND SUB-SECTION OF CHAPTER 66. SUBDIVISIONS. SHALL
REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED;
PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE AND
AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR
OTHER PURPOSES.
WHEREAS, the Village Council of the Village of Tequesta. desires to correct the stated
level of service standard for stormwater drainage facilities from a three-year frequency storm
event to a twenty-five year frequency storm event in order to be consistent witth other sections of
the Village's Code of Ordinances and the Village's Comprehensive Plan; and
WHEREAS, the Village Council believes that these revisions to the Village's Code of
Ordinances are in the best interests of the Village of Tequesta, and will promote the public
health, safety and welfare.
NOW THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, FLORIDA, THAT:
Section 1: Chapter 66. Subdivisions. at Article V. Design Standards. at Division l.
Generally. of the Code of Ordinances of the Village of Tequesta, Florida is hereby amended at
Subsection (g)(3) of Section 66-161. Generai Standards; Level of Service Standards. to correct
the stated public drainage facilities level of service standard; providing that Sec. 66-161 shall
hereafter read as follows:
Sec. 66-161. General standards; level af service standards.

(3) Drainage. A public drainage facilities level of service standard of a�ee-
� twentv-five (251 vear frequency, 24-hour duration storm event is hereby
adopted, and shall be used as the basis of estimating the availability of capacity
and demand generated by a proposed develapment project. As a general drainage
requirement, each proposed project and/or site sha11 maintain 95 percent of all
stormwater runoff an-site.

Section 2: Each and every other section and sub-section of Chapter 66. Subdivisions.
of the Code of Ordinances of the Village of Tequesta shall remain in full force and effect as
previously enacted.
Section 3: All Ordinances or parts of Ordinances in conflict herewith be and the same
are hereby repealed.
Section 4: Should any Section or provision of this Ordinance or any portion thereof,
any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid,
such decision sha11 not affect the validity of the remainder of this Ordinance.
Section 5: Specific authority is hereby granted to codify this Ordinance.
Section 6 : This Ordinance shall become efFective immediately upon passage.

Upon Second Reading this 9 day of June 2011, the foregoing Ordinance was offered by Council
Member Brennan who moved its adoption. The motion was seconded by Council Member
Turnquest and upon being put to a vote, the vote was as follows:

The Mayor thereupon declared the Ordinance duly passed and adopted this 13 day of October
