The Special Magistrate appointed by the Village Council to hear code compliance cases
for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard
testimony at the Code Compliance Hearing held on the 20�' day of October, 2011, and based on
the evidence and testimony presented, entered an Order Finding Repeat Vialation and Assessing
Fine. The following Findings of Fact, Conclusions of Law, and Order are hereby entered:
FINDINGS OF FACT
1. The Respondent was not present at the hearing; however, there was a finding of
proper notice.
2. Based upon evidence and testimony presented, the Special Magistrate finds that
the Respondent was in violation of 5ection 30-33 of the Code of Ordinances of the Village of
Tequesta. from October 3, 201 l, through October 20, 20i l, a period of eighteen (18) days, and
that the violation continues to exist.
3. This is a repeat violation of the same Village Code section fram an "Order
Assessing Fine" dated June 28, 2010.

CONCLUSIONS OF LAW
Based on the above�stated facts, Respondent is in repeat violation of Chapter 30 Article II
Section 30-33 of the Code of Ordinances of the Village of Tequesta.
ORDER
It is the Order of the Special Magistrate that a�in� of One Thousand Eight Hundred
Dollars ($1,800.00) is hereby assessed for this repeat violation, at a daily amount of One Hundred
Dollars ($100.00) per day for the violations which have existed on the p�operty from October 3,
2011 through October 20, 201 l, a period of eighteen (18) days, and such amount will continue to
accrue at One �-Iundred I�oliars ($100.00) per day until compliance is achieved.
Respondent also is assessed the Village's administrative costs in the amount of $252.31.
A certified copy of this Order may be recorded in the Public Records of Palm Beach
County, Florida, and, once recorded, shall constitute a lien against the property upon which the
violation exits and upon any other real or personal property owned by the Respondents, pursuant
to Chapter 162, Florida Statutes.
Upon complying in any code compliance matter, it is always the responsibility of the

inspection of the property.
