Address: 208 Fairway East Tequesta, Florida 33469 Legal Description: TEQIJESTA LOT 228 PCN: 60-42-40-26-01-000-2280 The Special Magistrate appointed by the Village Council to heax code compliance cases �or the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Cade Compliance Hearing held on the 20�' day of October, 2011, and based on the evidence and testimony presented, entered an Order Assessing Fine for Abatement. The following Findings of Fact, Conclusi�ns of Law and Order are hereby entered; FINDINGS 4F FACT l. The Respondent was not present at the hearing; however, there was a finding that proper notice was given. 2. In the Septernber 26, 2011 "Order Finding Violation and Permitting Village Abatement," the Special Magistra,te found health, safety and welfare violations of Sections 30-33 and 78-585 and permitted Village abatement of these violatians. 3. Based upon the evidence, pictures and testimony presented at the hearing on October 20, 2011, the Special Magistrate found that the Village had abated the nuisance conditions and that the property was now in compliance with Sections 30-33 and 78-585. Page 1 of 2 � CONCLUSIONS OF LAW The above-stated facts allow a fine to be assessed against the property based upon the Village's abatement of the violations of Sections 30-33 and 78-585 of the Code of Ordinances of the Village of Tequesta. Q�IdI)ER It is the Order of the Special Magistrate that administrative costs in the amount of $496.71 be assessed against the property in order ta recover the costs of abatement taken by the Village as well as additional administrative costs incurred by the Village prior to the October 20, 2011 hearing. Responden� further is assessed previous administrative costs of $258.27 incurred by the Village prior to the September 22, 2011 hearing. Should you violate the same Section of the Code again, you may be subject to a fine of up to five hundred dollars ($50�.00) per day for such repeat violation. Additionally, the Code Inspector is not required to give a reasonable time to correct the repeat violation and the case may be presented to the 5pecial Magistrate even if the repeat violation has been corrected prior to the Special Magistrate hearing. A certified copy of this Order may be recorded in the Public Reeords of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property upon which the violation exits and upon any other �eal or personal property owa�ed by the Respondents, pursuant to Chapter 1 b2, Florida Statutes.
