A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, LIFTING AN 18% SURCHARGE CURRENTLY
IMPOSED ON ALL WATER BILLING FOR VILLAGE CUSTOMERS;
PROVIDING THAT SAID SURCHARGE SHALL BE RE- INSTITUTED
SHOULD THE SOUTH FLORIDA WATER MANAGEMENT DISTRICT
ADOPT MORE RESTRICTIVE IRRIGATION LIMITATIONS THAN
THE MODIFIED PHASE II RESTRICTIONS CURRENTLY IN PLACE
PURSUANT TO ORDER NO. 2011 -046- DAO -WS; PROVIDING AN
EFFECTIVE DATE; AND FOR OTHER PURPOSES.
WHEREAS, South Florida Water Management District (SFWMD) Order No. 2011-046 -
DAO-WS implemented modified phase II restrictions for landscape irrigation on March 21,
2011; and
WHEREAS, the said restrictions were geared toward achieving the goal of a 30%
cutback in demand; and
WHEREAS, Sec. 74-74 of the Village of Tequesta Code of Ordinances provides that if
the SFWMD imposes guidelines to be followed which result in a 15% reduction in water usage
at a minimum, then the consumption charge for Village customers shall be increased by 18 %;
and
WHEREAS, the said 18% surcharge was implemented by the Village in accordance with
Sec. 74 -74 of the Village Code of Ordinances; and
WHEREAS, Sec. 74 -74 further provides the Village Council with the discretion to
reduce said surcharge so long as sufficient revenue will still be generated in order to comply with
utility system debt covenants or to meet other requirements of the water system; and
WHEREAS, the Village Council has determined that at this time, sufficient revenue will
be generated in order to comply with utility system debt covenants and all other requirements of
the water system, even in the total absence of said surcharge; and
WHEREAS, pursuant to action taken at the October 13, 2011 Village Council meeting,
in accordance with Sec. 74 -74 of the Village Code of Ordinances, the Village Council desires to
remove said 18% surcharge from all Village customer billing, effective with the October 14,
2011 billing cycle, until such time as the SFWMD may adopt more restrictive irrigation
limitations than the Phase II restrictions currently in place; and
WHEREAS, the Village Council believes that said removal of the 18% surcharge is in
the public interest and will benefit both residents and businesses in the Village of Tequesta,
without jeopardizing the water system.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF
THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1 Pursuant to action taken by the Village Council at its October 13, 2011
Village Council meeting, the Village Council hereby removes the 18% surcharge from all
Village customers effective with the October 14, 2011 billing cycle.
Section 2 In the event that SFWMD adopts more restrictive irrigation limitations
than the Phase II restrictions currently in place pursuant to Order No. 2011- 046- DAO -WS, then
the 18% surcharge shall be re- imposed on all Village customers on the next billing cycle
thereafter.
Section 3 This Resolution shall take effect immediately upon adoption.
The foregoing Resolution was offered by Council Member Humpage who moved its adoption.
The motion was seconded by Council Member Brennan and upon being put to a vote, the vote
was as follows:

The Mayor thereupon declared the Resolution duly passed and adopted this 10 day of
November, 2011.
