January 27, 2005 PRESENT: Special Master Paulette Torcivia; Code Enforcement Officer Jason Fleming, and Recording Secretary Betty Laur. The hearing was called to order at 10:00 A.M. Code Enforcement Special Master Torcivia approved the minutes of the May 27 and July 22, 2004 Special Master Hearings as submitted. Violation Hearings: Case No. 05-1539 Daniel R. Robillard 140 Country Club Drive Tequesta, FL 33469 Legal: Country Club Point PT of . GOVLTS2&51N P C N : 60-42-40-25-12-005-0010 Violation of Code Chapter 10 Article II Sec 10-34 Pg CD 10:5 Dogs Running at Large The Respondent, Daniel R. Robillard, was not present at the hearing; however, there was a finding of proper notice. Dixie Virgil, Respondent's tenant, was present and testified that he had already paid the fine and was putting in an additional fence to contain the dog. The Tequesta Code Enforcement Officer testified to the violation. Recycled Paper Special Master Hearing January 27, 2005 Page 2 Conclusion of law was Respondent Daniel R. Robillard is in violation of Section Chapter 10, Article II, Sec. 10-34 Pg. CD 10:5, of the Code of Ordinances of the Village of Tequesta. Special Master Torcivia ordered that Respondent Daniel R. Robillard shaN continue to comply with immediately comply with Section Chapter 10, Article II, Sec. 10-34 Pg. CD 10:5, of the Code of Ordinances of the Vilfage of Tequesta. If Respondent does not continue to comply, Respondent may be assessed a fine up to five hundred dollars ($500.00) per day as a repeat violation. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florid�, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes, for the original amount. Case No. 04-234412 Juli-Ann Kovacs 372 Church Ave. Tequesta, FL 33469 Legal: Jupiter in the Pines Sec B IN 60-42-40-25-06-032-0030 Violation of Village of Tequesta Code Chapter 30 Article IX Sec 30-331(a) Page CD30:18-19 Abandoned/Storing Vehicle The Respondent, Juli-Ann Kovacs, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the violation. Conc{usion of faw is that Respondent Juli-Ann Kovacs is in violation of Section Chapter 30 Article IX Sec. 30-331(a) Pg. CD30:18-19, of the Code of Ordinances of the Viilage of Tequesta. Special Master Torcivia ordered that Respondent Juli-Ann Kovacs shall comply with of Section Chapter 30 Article IX Sec. 30-331(a) Pg. CD30:18-19, of the Code of Ordinances of the Village of Tequesta by January 29, 2005. CD78:114 R1A Boat Parking The Respondent, Therese Dwyer, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law is that Respondent is in violation of Section Chapter 78 IX Division 11 Sec. 78-644(3) (4) Pg. CD78:114 of the Code of Ordinances of the Vilfage of Tequesta. Special Master Torcivia ordered that Respondent Therese Dwyer shall comply with Section Chapter 78 IX Division 11 Sec. 78-644(3)(4) Pg. CD78:114 of the Code of Ordinances of the Village of Tequesta by the 29 day of January, 2005. If Respondent does not comply within the time specified, a fine of seventy-five dollars ($75.00) per day shall be assessed for each day the violation(s) continue to exist. CD78:97- 98 Property Maintenance The Respondent, Jeanne Zimmerman, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law is that Respondent is in violation of Section Chapter 78 Sec. 78-409 Pg. CD78:97-98 of the Code of Ordinances ofi the Viflage ofi Tequesta. Special Master Torcivia ordered that Respondent Jeanne Zimmerman shall comply with Section Chapter 78 Sec. 78-409 Pg. CD78:97-98 of the Code of Ordinances of the Village of Tequesta by the 29 day of January, 2005. If Respondent does not comply within the time specified, a fine of seventy-five dollars ($75.00) per day shall be assessed for each day the violation(s) continue to exist. CD30:5 Excessive Accumulation Prohibited The Respondent, FL1, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the violation. . Conclusion of law is that Respondent FL1 is in repeat violation of Section Chapter 30 Article II Sec. 30-33(a)(b) Pg. CD30:5 and Chapter 30 Article I1 � Sec. 30-32 Pg. CD30:5 of the Code of Ordinances of the Village of Tequesta. Special Master Torcivia ordered that Respondent FL1 shall immediately comply with Section Chapfier 30 Article II Sec. 30-33(a)(b) Pg. CD30:5 and Chapter 30 Article II Sec. 30-32 Pg. CD30:5 of the Code of Ordinances of the Village of Tequesta. If Respondent fails to maintain the property and is found. in repeat violation again then Respondent shall be assessed a fine of five hundred dollars ($500.00) per day until the property is in full compliance. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes, for the original amount. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law is that Respondent is in violation of Section Chapter 30 Article IV Sec. 30-113 Pg. CD30:9 and Chapter 30 Article 1 Sec 30-33 Pg. CD30:5, of the Code of Ordinances of the Village of Tequesta. Special Master Torcivia ordered that Respondent Alvin Bergerman shall comply with of Section Chapter 30 Article IV Sec. 30-113 Pg. CD30:9 and Chapter 30 Article 1 Sec 30-33 Pg. CD30:5, of the Code of Ordinances of the Village of Tequesta by the 22" day of February, 2005. A Status/Fine Assessment Hearing will be held before the Special Master on the 24 day of February 2005 at 10:00 a.m. at the Vilfage of Tequesta, Code Compliance Division, 357 Tequesta Drive, Tequesta, Florida. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes, for the original amount. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law is that Respondent is in violation of Section Chapter 78 Article IX Division 11 Sec 78-642(a) Pg. CD 78:112 of the Code of Ordinances of the Village of Tequesta. Special Master Torcivia ordered that Respondent Paul Claremont shall comply with Section Chapter 78 Article IX Division 11 Sec 78-642(a) Pg. CD 78:112 of the Code of Ordinances of the Village of Tequesta by the 28 day of January, 2005. If Respondent does not comply within the time specified, a fine of seventy-five dollars ($75.00) per day shall be assessed until the property is in full compliance. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law is that Respondent is in violation of Section Chapter 78 Article IX Division 11 Sec 78-642(a) Pg.
