Thanks for the follow-up. Attached �s the draf� letter that 1 previously prepared prior to discussing with Mike his
suggestion that a resolution may have great force. The letter has not been sent and is stili in draft form. Mike
has not previously seen a draft as the letter's progress was held up once we started discussing the concept of a
resolution.
We have a speciai meeting on Monday at 6:00 and look forward to learning of the Council's views.

Re: The Village of Tequesta/Island Way, L.C./Request for Zoning Change
Dear Commissioner Weberman:
This letter is written on behalf of my client, The Vitlage of Tequesta, and pertains to a
hearing set for Thursday, October 6, 2005, before the Martin County Local Planning
Agency, relative to Island Way.
Specifically, the Village of Tequesta is in receipt of a Public Notice advising of the
referenced hearing. It is understood that at the hearing, a request will be made
regarding Island Way that certain zoning be changed from RE-2A to PUD with
Certificate of Public Facility Exemption and Master Site Plan and Planned Unit
Development Zoning Agreement Approval, etc. Moreover, the requested approval
seeks permission for a proposed development consisting of thirty=nine (39} singte family
units on 78.59 acres. The proposed gross residential density is 0.48 unites per acre.
The Village of Tequesta wishes to express its concerns that the requested approval
seeks permission to develop the subject property in a manner that the Village of
Tequesta considers too dense for the area: Moreover, the Village has grave concems
that if permitted, the density of the project wifl cause severe and adverse impacts to the
roadway system that is currently overburdened. As has been noted previously, it is the
position �f the Village of Tequesta that it bears a disproportionate share of adverse
tra�c impacts associated with traffic em�nating from Martin County. The subject
approval would exasperate an already difficult problem absorbing traffic flow emanating
from Martin County.
The Village of Tequesta strongly urges the Martin County Commission to not approve
the requested change or to request significant modificafiions in order to materially

reduce the density associated with the proposed project, Such a proposed change
would of course necessitate a further public hearing.
If you or a member of your staff would like to discuss this further, please contact me
directly. This a matter of serious concern to the Village and I look forward to hearing of
the County's actions in this regard.

Dear Council, Per Michael's request he has asked me to respond to you regarding this request (as noted
below}. As a reminder he has been at the State Ethics Conference in Jacksonvitfe since Tuesday, and wilt
return this la#e afternoon. He has kept in touch will Staff and is aware of the impact this informa#ion will have on
Tequesta.
Note: Due to the sensifiive nature Staff was instructed to immediately send Council the information regarding
the public notice of proposed change in zoning for Island Way on Tuesday of this week. �'ou recieved this
notice by mail distribution to Council on Tuesday. Unfortunately Staff was unaware that Council Member Genco
would be out of Town this week. In the meantime, Michael asked Rttorney Hawkins to send a letter becasue he
feft it would have more weight coming from the Attomey than from him.
This email is supplemental to the letter that Attroney Hawkins has drafted outlining the objectives associated
with increased density caused by the zoning change and the result that could have adverse traffic impacts to
Tequesta.
Michael and Scott Hawkins has asked that we schedute a Special Meeting regarding this issue if it is
Council's desire. The Martin County hearing is Thursday at 7:00 pm. f am laoking at 6:00 pm on Monday
or Tuesday to give Scott time to prepare a Resolution and get it delivered to Martin County.

Mike Couzzo asked me to contact you regarding your concerns relative to a request pending before Martin
County to have the zoning changed with respect to a project on Isfand Way. ({ did try to reach you earlier in the
week by phone and Mike advised he thought you were out of town.)
I have reviewed the notice scheduling a public hearing on this matter and have drafted a possible brief fetter
outlining objections associated with increased density caused by the zoning change and resuf#ing adverse traific
impacts. As an alternative to a letter, Mike and 1 have discussed whether Teq should issue a resolution setting
forth its concems. Since the Martin County hearing is 1016, a special meeting would be required to have such a
resolution considered. Mike suggested that I get your input in this regard. Specifically, I am interested in your
thoughts on whether a speciaf mtg shouid be calted relative to a possibte resoiution. Further, I would fike to
discuss your concerns about the proposed zoning change.
