RESOLUTION NO. 60-03/04
A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, AUTHORIZING THE VILLAGE COUNCIL TO
WAIVE THE CAPITAL CONNECTION CHARGE TO THE
WATER SYSTEM, AS TO NON-RESIDENTIAL AND NON-
COMMERCIAL USES, WHEN THE COUNCIL, AFTER
PUBLIC HEARING AND COUNCIL DELIBERATION,
' DETERMINES SUCH WAVIER IS IN THE BEST INTEREST
OF THE VILLAGE, AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the Village of Tequesta provides in Chapter 74 of the Village Code
of Ordinances, at Section 74-66, that each new connection to the water system shall
pay a capital connection charge as established by resolution of the Village Council ; and
WHEREAS, the Village Council of the Village of Tequesta, Florida, has
determined that the capital connection charge may be waived or modified fior non-
residential and non-commercial uses, when it has been determined, after public hearing
and deliberation, that the benefit to the public of waiving the capital connection charge
outweighs the loss of revenue resu{ting from such waiver.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, as follows:
Section 1. The Village Council is hereby authorized, upon majority vote, to
waive the capital connection charge as to non-residential and non-commercial uses
when the Council, after public hearing and deliberation, determines such wavier is in
the best interests of the Village.
Section 2. This Resolution shall become effective immediately upon pass.age.
THE FOREGOING RESOLUTION was offered by Councilmember

by Councilmember and upon being put to a vote, the
vote was as follows:

Members of the Council
The residents of Bayview Terrace Homeowner Association and Shady Lane Homeowner
Association jointly own a triangular piece of land that is between the two subdivisions
(see attached). As you can see, this piece of property goes from the street to the
riverfront. The homeowners have been trying to improve this area. Several years ago,
this area was cleaned up at the expense of the two associations. We installed two park
benches and a sidewalk from the street to the water. . �
Now we would like to irrigate and sod this area. The village owns the easement on each
side of the property as well as the easement by the road. We respectfully ask the village
to provide the following:
• Sod for the easements
• Labor on in�tallation of the meter for city water
• Waiver of the monthly sewer fee for the water
• Any trees, shrubs and landscaping that you may be able to provide
We estimate the cost of the sod for the easements to be approximately $2000.00, which is
for 9060 sq. ft. of St. Augustine sod at 22 cents per square foot installed.
The two HOA's have voted for a$10,000.00 assessment for this improvement to be done
in 2004. If the village would sod their easements we feel we can accomplish our goals,
stay within our budget and be able to use city water as opposed to well water.
We appreciate all the village has done in its beautification efforts and are very grateful
for any assistance that you may be able to offer us.
