Dear Mr. Holeman:
This is to confirm the action of the Village Council at their September 9, 2010, meeting
approving your application for a monument sign measuring nine (9) feet in height by 5.5'
at the base graduating up to 7.83' at the top, Kansas Grain color with Soft Sapphire
accents and lettering, to be located at the above-referenced address, contingent upon
an acceptable method of irrigation of the surrounding landscape.
At this time you may pull a permit for the sign work to proceed. The permit fee is 2% of
the contract price of the job, plus $75.00. Please be advised a copy of a signed
contract is required. In addition, your original application is already on file with this
department and you have a$75.00 credit from this initial application, so only the 2% will
be due, along with the signed contract in order to complete the permitting process.

considered the evidence presented by the applicant and other interested persons at a hearing called and properly
noticed, and the Tequesta Village Council, being otherwise du(y advised,
THEREUPON, THE TEQUESTA VII,LAGE COUNCIL FINDS AS FOLLOWS:
1. The subject property is located in the MLJ Mixed Use Zoning District in the Village of Tequesta.
2. The applicant has submitted all documents required by the Village's Code of Ordinances.
3. The application and all supporting documentation and presentation materials as reviewed by the
Village Council at its September 9, 20I0 meeting, and as kept on file by the Village, are made a
part hereof and are hereby incorporated by reference.
4. According to Section 78-331, site plan approvat is required prior to issuance of a building permit
since the proposed project is not located in an R-1 or R-lA zoning dishict.
5. The applicants have applied for a site plan modification to construct a replacement monument
sign on the property, in accordance with presentation materials as reviewed by the Village
Council at its September 9, 2010 meeting, and as kept on file by the Village.
6. Under the provisions of the Village Code of Ordinances, the Village Council has the right, power
and authority to act upon the request herein made.

WHEREAS, the Village Council believes the sign code amendments contained in
this ordinance wiil be in the best interests of the Citizens of the Viilage of Tequesta.
NOW, THEREFORE, BE iT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Se�tion 1: Chapter 78. Zoning. of the Code of Ordinanaes of the Village af
� Tequesta is hereby amended at Article XI. Signs. by updating this Article to provide that
the commercial portions of mixed use developments shall be subjeot to the same sign
code regulations as other commercial distriats in the Village; and that the residential
portions of mixed use districts shall be subject to the same sign code regulations as
other residential districts tn the Village; providing that Article XI. Signs. shall hereafter
read as fofiows:

The restriotions and maximum size of the signs in areas of the village sha{l be as
folfows:
(a) Off-pr�mises signs. Signs shaEl advertise oniy the structure or business or land
parael upon whioh the sign is erected or affixed. Off premises signs are p�ohibited
except for temporary open house directional signs and temporary development signs on
remote paraeis per sections 78-740(b)(1) and 743(a).
(b) Residential districts. Signs in residential disfiricts as w�ll a fihe residential qortions
of mixed use dis#�#� shail be subject to the foilowing:
(1) In residential districts R-1A, R-1, R-2, R-3 and in residenfiiai areas of a Mixed Use
("MU°) development no more than one sign per lot shall be permitted with an exposed
area of nat more than four square feet, and advertising only the sal�, fease or rental of
fihe lot or the improvements thereon. No off-site signs shali be permitted; exeept,
however, one open house di�ectional sign of not more than two square fee#, located on
the same block as an advertised open house, is permitted during daylight hou�s on
Saturday andfor Sunday only. Such sign shaii be exempt from any viilage permitting
�equ+rements.

{2) fn residentiai districts R-2 and ft-3, one sign shaN be aAowed attached to the
building or structure thereon, if any, provided that no signs in any case shall be larger
than 20 square feet.
(3) identification signs at entrances to driveways and/or paricing lots not to exceed two
square feet in size shail be allowed.
(4) Signs in any residential district which advertise the sale, rental, or lease of real
estate shatl be removed no later than three days subsequent to the sale, rental, or
lease. Sale, rental, or lease shali be deemed to be the date upon which a contract for
sweh sale, rental or lease is fully executed. Such sign shall be exempt from any village
permitting requirements.
(5) Signs in any WOP district shail be aliowed only after review by the planning and
i zoning advisory board and upon approval by the village council in accordance with the
site plan review process as esfiablish�d in article IX, division 2 of this chapter.
: (6) Churches or synagogues located in residentiai disfiricts shall be allowed signage as
. follows:
� a. Freestanding sign: One freestanding sign shall be ailowed, not to exceed 30 square
, feet in total area, with a maximum height of seven feet above finish grade. The sign
shall meet the setback requirement of section 78-739. Up to 50 peroent of the app�oved
sign may be used as a changeable letter reader sign. Any such freestanding sign shall
be allowed only after review by the planning and zoning advisory board and upon
approval by the village council in accordance with the site plan review process as
established in article IX, division 2 of this chapter.
b. Wali sign: One wall-mounted sign per building shall be allowed, not to exceed 20
square feet in tota{ area, to be aonstructed using individual raised letters and/or a metal
j plaque type sign.
I c. Monument sign: One ground-based monument sign shalt be allowed, not to exceed
: 20 square feet in area, with a maximum height of four feet above finish grade. The sign
� shall meet the setback requirement of section �8-739. Any such monument sign shall
be allowed on�y after revfew by the planning and zoning advisory board and upon
approvat by the viflage council in accordance with the site plan review process as
established in a�tiale IX, div�sion 2 of thi� chapter.
d. Multiple wall signs shall be allowed, providing that the total square foot area does
not exceed 20 square feet and the signs are uniform with respect to style, color and sign
material.
(c) Commercia! districts. Signs in C-1, C-2, and C-3 commercia! districts. as well as
�.h� cornmercial nortions of mixe.d use dist�icts shall be subject to the following:
� (1) In shopping centers, the size, design and location of wall signs shall meet the
� technical requirements as established by this Code and shalt be permitted after
approval by the building official. Uniformit�r and proportion of design shall be carried out
insofa� as is possible. 3tandard trademark signs may be permitted provided they meet
the technical requirements of this article and any applieabte requirements of the buifding
and electrical codes. Any freestanding signs shall meet the technical requirements of
this article and shall be allowed only after review by the planning and zoning advisory
board and approva{ by the village counail ir� aacordance with the site plan review
pcoaes� as established in article IX, division 2 0€ this chapter.

(2) In commercial districts C-1, C-2, and C-3. as we11 as the eommerciai n.ortions of
r�ixed use �istricts not inoluding properties within shopping centers, ali wa{I signs shall
meet the technical requirements as established by this article and shall be permitted
after approval by the building offciaL
(3) Fixed ceifing-mounted signs on shopping center walkways wil! be allowed provided
they are at right angles to the building and do not exceed five square feet in size and do
not exceed one per establishment.
(4) In buildings where establishments use a common doorway or doorways or do not
have individual door openings and frontage to a street o� parking area, the foliowing
altemative may be permitted after approval by the building official: A composite sign for
all tenants not to exceed 60 square feet or a design far display of individual signs not to
exceed three square feet each and not more than 60 square feet in aggregate.
(5) In commercial districts C-1, C-2, and C-3. as well as the commeccial oorti.ans o#
mixed use districts com�r structures of buildings with d'irect exposures to iwo or more
public streets or to a shopping center and a street shall be allowed a�ign on each side
of the building exposed to a street or shopping center.
{6) Signs in any commercial distriot which advertise the sale, rental or lease of real
estate shall not exceed a dimension of 20 square feet. Such signs shall be removed no
later than three days subsequent to the sale, rental or lease of the property advertised.
Sale, renta! or lease shall be deemed to be the date on which a con#ract for such sate,
rental or I�ase is fuNy executed.
Sec. 78-749. Technical requirernents.
The fotlowing technical requirements shall apply as set forth in this section:
(a) Resiclentia! districts. Signs in residenfial districts �oned R-1A, R-1, R-2, and R-3;
and residential areas of a MU Zoning District shall follow the provisions of section 78-
740(b).
(b) Commercial districts. Signs in commercial districts C-1, C-2, and C-3, as well as
t�� commercial n.octions_of mixe.d use �ii ri shall be subject to the following:
('I ) Stgns on buildings.
a. One sign per establishment shall be permitted on the building or structure, not to
exceed 60 square feet in area.
b. Mulfiiple wall signs on a building frontage or tenant area may be permitted upon
� approval by the building official that do not exceed the maximum square foo# area
: al1owed and have uniformity with respect to color, styfe and type of sign material.
(2) Freestanding signs.
a. Shopping centers within the C-1 neighborhood commercial district as well as the
�ommercial nortions of m-ueed use districts shall be allowed one freestanding sign, not to
exaeed 60 square feet in area and not to exaeed 16 feet in height from finished grade
and having a minimum �etbaak of ten feet . in accordance with section 78-739.
Landscaping and irriga#ion at the base of any such signage may be required by the
Communi#y Development Director, or may be recommended by the planning and zoning
advisory board and required by the village counci! as part of the site plan review
proeess as established in article IX, division 2 of this chapter whenever the landscaping

c. Shopping centers not utilizing additional freestanding signage or having approved
outparaels w'rth approved freestanding signage wlthin fhe C-2 community commercial
distnct having frontage along U.S. Highway 1 shall be allowed one freestanding sign,
not to exceed 100 square feet in area and not to exaeed 20 feet fi he'r�ht from fnished
grade and having a ten foot minimum setback in aceordanoe with seation 78-739.
� Landscaping and irrigation at the base of any such signage may be required by the
; Community Development Director, or may be recommended by the planning and zoning
' advisa .ry board and required by the village counoil as part of th� site plan review
� proaess as established in article IX, division 2 of this chapter whenever the landscaping
� and irrigation are considered desirable. Shopping centers within the C-2 community
: aomrnercial district having front�ge along U.S. Highway 1 utilizing freestanding signage
� in excess of 60 square feet in area but not to exceed the 10U square feet in area
' allowanae as provided in this subsection shall not be permitted any additional
� freestanding signs on any lot or parcel comprising the shopping center or on any
ou#parcel assoaiated therewith.
' d. Additional freestanding signs shall b� permitted in shopping centers within the C-2
aommunity commercial disfirict having U.S. Highway 1 frontage under the aonditions as
follows:
` i. Shopping centers with approved outparcels, not utilizing the €reestanding signage
allowanc:e in excess of 60 square feet in area but not to exaeed 100 square feet in area
' as provided for within this subsection, shall be permitted one freestanding sign for each
outparcel, not to �xceed 45 square feet in area and not to exceed eight feet in height
, from finished grade and having a minimum setback of ten feei in acaardance with
seotion �8-739. Landscaping and irrigation at the base of any such signag� may be
. required by the Community Development Director, or may be recommended by the
� planning and zoning advisory board and required by the village council as part of the
. site plan review process as estabfished in a�ticle IX, division 2 of this chapter whenever
the landscaping and irrigation are considered desirabte.
ii. Reserved.
iii. Shoppin� centers having U.S. Highway 1 frontage in exaess of 600 lineal feet, not
utilizfing the freestanding signage albwance in exces� of 60 square feet in area but not
to exeeed 100 square feet in area provided for in this subsection and not utilizing any
outparcel signage allowed in fihis subs�ction, sha{l be perm'rtted additional freestanding
signage not to exceed fiwo additional freestanding signs for each e(ig�ble shopping
center, provided that the additional signage shall be located a minimwm o# 300 lineal
feef from any other freestanding sign w'ithin the shopping center. Any proposed
additianal freestanding sign not separated by a distance of at least 300 lineal feet from

any other freestanding sign on the proposed shopping center site shali be prohibited.
Any such additional freestanding signage shail be of the same style and colors as #he
other freestanding signs. Any such additional freestanding signage shall not exceed 60
square feet in area and shatl not exceed 20 teet in height from finished grade and shall
have a minimum setback af ten feet in accordance with section 78-739. Landscaping
and irrigation at the base of any such signage may be required by the Community
Development Director, or may be recommended by the planning and zoning advisory
board and required by fhe viltage council as part af the site plan review process as
established in article IX, division 2 of this chapter whenever the landscaping and
irrigation are considered desirabte.
iv. Such additional frees#anding signs as may be allowed sha41 be constructed in
accordance with all other provisions of this subsection.
e. Establishmen#s not in shopping centers shall be allowed one freestanding sign
under the conditions as follows:
i. Establishments not in a shopping �enter and located within the C-1 neighbofiood
commerciaf district shall be atlowed one sign per building apart from the buil�ing not to
exceed 60 square feet in area and not exaeeding 16 feet in height f�om finished grade
and having a minimum setback of ten fee# in accordance with section 78-7'39.
Landscaping and irrigation at the base af any such signage may be required by the
Community Development Director, or may be recommended by the planning and zoning
advisory board and required by the village council as part of the site plan review
process as established in article {X, division 2 of this chapter whenever the landscaping
and irrigation are aonsidered desirable. The sign shall be located within the middle one-
third of the property fronfing on the public street.
ii. Establishments not in a shopping center, located within the C-2 community
commercial district or the C-3 general commercial district, shall be allowed one sign pe�
building apart from the building not to exceed 60 square feet in area and not exceeding
20 feet in height from finished grade and having a minimum setback of ten feet in
accordance with section 78-739. Landscaping and irrigation at the base of any su�h
signag� may be required by the Community Development Director, or ma�r be
recommended by the planning and zoning advisory board and required by the village
council as part of the si#e plan review proaess as established in artic4e IX, division 2 of
� th�s chapter whenever the landscaping and irrigation are considered desirable. The sign
shall be looated within the middte one-third of the property fronting on the public street.
; (3) Changeable letter �igns. Change�ble letter signs are proh�bited except for the
; reader po�tions of theater signs, rnenu boards for fast food restaurants and where
� spec�cally exempted or allowed by state law, this code or by spec�c recommendation
of the planning and zoning advisory board and approval af the village council as part of
the site plan �eview process as established in article IX, division 2 of this chapter.
Sec.78-742. Exemptions.
The following signs shall be exernpt from the permitting requirements set forth in this
arfiicle:
(a) Professional namepia#es.
(b) �igns on resid�ntiai property designating the owner's name or name ofi home not to
exceed one square foot in si�e.

(c) Control signs such as those designating exits, entrances or no trespassing, not to
exaeed two square feet in size; provided, however, signs of a larger size, which ciearly
serve the public interest and safety, may be permitted upon application to and appraval
by the building o�cial.
(d) Signs denoting the architect, engineer, contraator or developer when placed upon
work under construction, and not exceeding 16 square feet in area; provided, however,
such signs must be removed within thr�e days after the issuance of a cert�cate of
occupancy.
(e) Occupationa! signs on or near to a main entrance denoting only the name and
prafession of an occupant in a commercia! building or public institutional building and
not exaeeding six square feet in area.
(t� Memorial signs ortablets, names of buildings and date of erection when cut into any
masonry surf'ace or when construeted of bronze and other incombustible mat�rials.
(g) Lettering on windows not to exoeed three inahes in height per letter, indicating the
occupant of the office and the na#ure of busin�ss.
(h) Signs that may be required by any agency o# the sta#e oc federal government.
(i) Traffic or other municipal signs, legal notices, railroad crossing signs, danger and
other such temporary, emergency or non commercial signs.
{j) Safety or caution signs such as "No 8moking" signs near flammable materials.
(k) Paper or other temporary signs may be affixed or othen�rise attached to or
displayed w�thin glass display windows of commercial establishments or stores in
commerci�l d'istricts C-1, C-2, and C-3. as well .as the. rornmer.cial nortions of mixed use
�s�ri�ts without the requirement of a permit being obtain�d therefor; provided, hawever,
that not more than one such sign shali be permitted within or upon any such window
display, and further, that any such sign shall not exceed 500 square inches in size. The
foregoing shall not prohibit the use of tags or placards, when such are directly adjacent
to or attached to merchandise displayed for sale; provided, however, that the si�e and
number of such signs are �estheticalty in keepin� with the display window oc building.
(I) Those signs described in section 78-�40(b)(1), which permits one sign per lot in the
R-1A, R-1, R-2 and R-3 dist�icts, and in residential areas of MU Zoning Districts
advertising the sale, lease or rental of the lot on which the sign is located and so as to
allow one open house direction�l sign, all pursuant to the regutations set focth thecein.
� {m) Ternporary signs announcing a new business, a maximum �ize of six square feet,
� to be placed in store-front windows, for a maximum period of 30 days from date of
application for a permanent sign. Such temporary signs are required to be removed
when the permanen# sign is installed or na [at�r than 30 days after instaltation of the
temporary sign, whichever is sooner. .
Sec. 78-743. �ubdivision and development signs.
[This section �hal! remain in fult force and effect as previousty adopted]
Sec. 78-744. Unsafe, unlawful or nonconforming signs.
[This section shall remain in full force and effect as previously adoptedj
Sec. 78-745. Prohibitions in all zoning categories.

(a) Blinking or r�eflective signs. No blinking, flashing, intermittent, animated or
reflective type signs shall be permitted. Each light must be consfiant in intens'ity of
iliumination with a soft and muted effect.
(b) Signs extending above roof height. No sign shall extend above the roof height
unless backed by a parapet wall extending the entire length of the building and with the
same or greater height than the sign.
tc) Out/ine lighting. No neon tubing or other lineal use of lighting in ou#lining either the
sign or the building or structure shali be permitted.
(d) Painted wall signs. No painted wall signs shal! be permitted. Lettering on walis
must b� of raised design.
(e) Signs on vehicles. Signs attached to or placed on a vehicie (including trailers) that
are parked on public or private property shall be prohibited. This provision is not to be
construed as prahibiting the ident�ication of a firm or its pr�ncipal products on a
; aommercial vehicte operating during the normal hours of business; provided, however,
� that no such vehicle shall be parked on public or private property with signs attached or
� ptaced on such vehicte primarily foc #he purpose of advertising a business or f rm or
� calling atte- ntion to the loc�tion of a business or �rm.
(� Political signs. Politicat signs are regulated as follows:
(1) No temporary political sign shall exceed six square feet pe- r sign face in area;
{2) No temporary political sign shatl be ptaaed in a�y public right-of-way or on any
public property;
. (3) No temporary political signs shall be plaaed in a location, as determined by the
village manager or his designee, in such a manner as to constitute a safety hazard, or
, hindrance to p�destrian or vehicular traffic;
(4) Temporary political signs shall not be erected more than �0 days prior to the date of
the elecfion, referendum or matter to which the 5ign is directed;
(5) All temporary political signs shall be removed within seven days after the date of the
eleetion� referendum or matter to which the sign is directed. If the signs are not timely
removed, the village may enter upon the property where the si�n i� iocated and remove
th� sign at the property owner's expense; provided that, prior to the removal by the
villag�, the village shall, within the seven-day period, send by hand delivery or certified
mail, return receipt requested, to the addresses of the owner of each property on which
the temporary political sign is located and to the owner as listed on the current tax rolls
of the county, a notice of noncompliance stating that the village shall remove the sign at
the property owner's expense if the sign is not removed within the seven-day period
following the clection, referendum or matter ta which the sign is directed. Each s'tgn not
removed prior to expiration of the seven-day period shall constitute an abandon�d sign
nat requiring a hearing prior to its removal by the village. The cost of removal by the
village shall be as set by resolution of the village council and kept on file in the village
clerk's office, which cost shall be assessed against the property owner and may be
' lev(ed upon the property upon which the violating sign was located. However, no cos# of
, removal shall be �ssessed against the pcoperty or property owner if the property owner
oan �onclusively prove to the village manager, or fiis designEe, that he was not
' responsible for the temporary political sign and had no knowledge of the temporary sign
. being ptaaed ar rnaintained on his property.

(g) Signs on windows or doors. Signs on shop windows, display windows, or doors or
other windows shalt be subjeet to the fo{lowing: Permanent signs sha11 be permitted to
be erected or painted upon any window or door as provided for in this article. Any such
sign permitted shail be part of the overa{I sign area permitted and shal! not exceed 30
percent of the window or door area.
(h) Outdoor merchandising disp/ays. No outdoor merchandising dispiay o� e# banners
or other merchandising materiai shalt be permitted except for temporary special
community-wide events or new business openings and then oniy by special permission
of the viilage manag�r upon a determination that the proposed di�play will be in the best
interests of the heatth, safety and welfare of the citizens of the viilage.
(i) Reserved parking spaoe signs. No signs identifying or designating parking spaces
as reserved for individual tenants, businesses and/or property owners �hall be ailowed.
Signs identifying handicapped parking spaces per state, coun#y and municipal
requirerrients are exempt from this a�ti�le;
� (j) Off-premise or b�llboard signs. No off-premise or billboard �igns shall be p�rmitted
exaept as set forth at �ec, 78-740(a).
' (k) Signs plaaed on public properly. No signs placed, attached, posted, or located, on
or to any t�ee, utility pole, street light, sidewaik, curb, fire hydrant, bridge or any other
public property, shall be permitted; exaept that public utility, convenience, and warning
` signs are p�rmitted ifi approved and erected by governmental agenoies having
I jurisdiction over the applicable property;
� (I) Moving si�ns. No signs in motion, inctuding swinging, rotafiing or revolving signs
i shall be pennitted;
� (m) O�cial �ign�. No si�ns which copy or im�tate official signs or which purport to have
official status sha11 be permitted;
: (n) �igns with illega! messages. No signs whi�h display any obscene or illegal written
or graphic message shaN be permitted;
(o) Si.gns interfering w'tth buildings. No signs which obstruct or interfere with any door,
#ite exit, stairway, ladder or opening intended to provide light, air, ing�ess or egress for
any building shall be permitted;
{p) Signs cr�eating traffic safety or fire hazarr/s. No signs which consti#ute a firaffic
safety or fre hazard, by re�son of size, loc�ation, coloring or method of illumination,
which obstruot the vision of motorists or pedestcians; or which obstruct oc detract from
any offcial traffic control deviaes or utifize the words "stop", "look", "danger", or any
other word or phrase, symbol or character in �uch a manner as to interfere wifh, mislead
or confuse traffic shall be permitted;
(q) Cube signs. No cube sign or advertising structure comprised of (A�) four faces, with
copy on three (3) or more faces shall be perrnitted; ,
j (r) Air�� search liyhts. No airaraft search lights promoting, advertising, or bringing
attention to a business, enterpri�e, or even# shall be peRnitted�unless annroved in
' iunction with a snecial events dermi .
Sec. 78-746. Decorative signs.
(This �ection shall remain in futt force and effect as previously adopted]
Sec. 7$-747. Bond and liabitity insurance for sign contractors.
