SITTING AS THE LOCAL PLANNING AGENCY
MEETING MINUTES
November 3, 2011
CALL TO ORDER AND ROLL CAIL
The Village of Tequesta Planning and Zoning Advisory Board Sitting as the Local
Planning Agency held a regular{y scheduled meeting at the Tequesta Village Half, 345
Tequesta Drive, Tequesta, Florida, on Thursday, November 3, 2011. The meeting was
called to order at 6:05 p.m. A roll call was taken by Deanna Mayo, Assistant to the
Viffage Clerk, who noted the following were present: Chair James Hackett, Vice Chair
Michael Schmidt, and Board Member Steve Okun. Also present were Acting
Community Development Director James Weinand, Village Attorney Keith Davis, and
Assistant to the Village Clerk Deanna Mayo. Board Members Elizabeth Schauer, Eric
Jolly, and Alternates Edward Gigante and Mitchell Miller were absent from the meeting.
APPROVALOFAGENDA
MOTION
Vice Chair Schmidf moved to approve the agenda as submitted. Board Member Okun
seconded the motion, which carried by unanimous 3-0 vote.
NEW BUSINESS
Public Hearing to consider and make recommendations to the Village Council
with regard to the following:
1. ORDINANCE NO. 18-11
An Ordinance of the Village Council of the Village of Tequesta, Florida, amending
the Village Code of Ordinances at Chapter 78, Zoning. Article IX, Supplemental
Regulations, Division 2, Site Plan Review. Amending this division by modifying
certain criteria relative to outside agency approvals, fire flow requirements,
sidewalk requirements, survey requirements, traffic study requirements, signage
requirements, and lighting requirements, providing that each and every other
section and subsection of Chapter 78 shall remain in full force and effect as
previously adopted, providing a conflicts clause, a severability clause, and
authority to codify; providing an effective date; and for other purposes.
Village Attorney Davis explained most of the proposed changes to Ordinance No. 18-11
were housekeeping; Chief Weinand added the changes were specific for use with site
plan review; otherwise everything was basically the same.

2. ORDINANCE NO. 19-11
An Ordinance of the Village Council of the Village of Tequesta, Florida, amending
the Village Code of Ordinances at Chapter 78, Zoning, Article IX, Supplemental
Regulations, Division 3, Special Exception Uses. Amending this division by
revising certain criteria to be more compatible with the site plan review process,
and by providing revised procedures for small scale revisions and an optional
pre-application process, providing that each and every other section and
subsection of Chapter 78 shall remain in full force and effect as previously
adopted, providing a conflicts clause, a severability clause, and authority to
codify, providing an effective date, and for other purposes.
Attorney Davis explained the proposed changes in Ordinance No. 19-11 provided
changes to the special exception process, making the administrative process easier for
minor amendments. This ordinance also removed some of the special exception items
and placed them into Ordinance No. 18-11. A new provision added review for an
optional pre-application review process for a new special exception, to allow the
appficant to go through an informal process to gauge public approval before they spent
a lot of money. The recent application from Corner Cafe was discussed as an example.
Chief Weinand explained the use had to be approved before an application could go to
site plan review. Chair Hackett expressed concern modifications could be made by staff
after approval by Village Council. Staff explained this was only for use; an application
had to go to Council for site plan approval. Attorney Davis suggested additional
language to Sections 363, 364: "or any previous development order or previous
conditions of approval". Chair Hackett recommended lowering either the dollar amount
or the square footage criteria. Vice Chair Schmidt recommended extending the time
period from 12 months to 18 months.
MOTION
Vice Chair Schmidt moved make the following recommendations to Village Council:
1. To reduce the percentage of small scale interior expansion to 10% of the original
approved specia! exception site square footage, having construction cost of /ess than
$50,000 once within any 18 month period.
2, To reduce the percentage of smal/ sca/e exterior expansion to 10% of the original
approved special exception site square footage, having construction cost of /ess than
$50,000 once within any 98 month period.
Board Member Okun seconded the motion. The vote on the motion was as follows:
James Hackett - Yes
Michael Schmidt - Yes
Steve Okun - Yes
The motion therefore carried by unanimous 3-0 vote.

3. ORDINANCE NO. 21-11
An Ordinance of the Village Council of the Village of Tequesta, Florida, amending
the Village Code of Ordinances at Chapter 78, Zoning, Article I, In General, at
Section 78-6 Enforcement Officer Violations, penalties. By amending this section
to revise the penalty provisions in conformance with the Code Enforcement
Special Magistrate process, and Article III, Appeals and Variances at Sections 78-
63, Appeal Procedure and Section 78-64 Stay of Proceedings Pending Decision
on Appeal. By amending these sections to revise the Village's administrative
appeal process, providing that each and every other section and subsection of
Chapter ?8 shall remain in full force and efFect as previously adopted; providing a
conflicts clause, a severability clause, and authority to codify, providing an
effective date, and for other purposes.
Attorney Davis recalled the Tequesta Towers application and explained this ordinance
would revise that appeal process to specific action the Village would take as opposed to
a comment on a staff report, and clean up the code enforcement ordinance.
4. ORDINANCE NO. 22-11
An Ordinance of the Village Council of the Village of Tequesta, Florida, adopting
an amendment to its comprehensive development plan in accordance with the
mandates set forth in Section 163.3184(3), F/orida Statutes, pursuant to a Village
initiated amendment No. LUPA 1-11 which provides for an amendment to certain
portions of the text found in the Future Land Use Element updating said element
in compliance with FEMA requirements for lowest floor elevation, providing for
transmittal to the State Land Planning Agency; providing a conflicts clause, a
severability clause and authority to codify; providing an effective date, and for
other purposes.
5. ORDINANCE NO. 23-11
An Ordinance of the Village Council of the Village of Tequesta, Florida, adopting a
small scale amendment to its Comprehensive Development Plan in accordance
with the mandates set forth in Section 163.3187, et. seq., Florida Statutes,
pursuant to a Village initiated amendment No. LUPA 2-11 which provides for an
amendment to the Future Land Use Map and fhe existing Land Use Map, re-
designating one point seven (1.7) acres, more or less, of land recently acquired
by the Village of Tequesta, located at 479 Seabrook Road, from "low density
residential" to Recreation and Open Space", providing for compliance with all
requirements of Chapter 163, F/orida Statutes, providing a conflicts clause, and a
severability clause; providing an effective date, and for other purposes.

6. ORDINANCE NO. 24-11
An Ordinance of the Village Council of the Village of Tequesta, Florida, amending
its Comprehensive Development Plan to update the Capital Improvements
Element Five Year Capital Improvements Schedule as provided in Section
163.3177(3)(b), Florida Statutes, providing that the text, as amended or revised,
shall be substituted for an replace in fuil the existing text in the adopted Capital
Improvements Element; providing for transmittal of a courtesy copy of the
adopted amendment to the State Land Planning Agency; providing a conflicts
clause and a severability clause; providing an effective date, and for other
purposes.
Attorney Davis explained Ordinances 22-11 and 23-11 were amendments to the
Comprehensive Plan and would help with insurance rates, and 24-11 was technically
not a Comprehensive Plan amendment any more, but was in the Capital Improvements
Element.
MOTION
Board Member Okun moved to approve Ordinance 18-11; Ordinance 21-11; Ordinance
22-19; Ordinance 23-11; and Ordinance No. 24-11. Vice Chair Schmidt seconded the
motion. The vote on the motion was as fol/ows:
James Hackett - Yes
Michael Schmidt - Yes
Steve Okun - Yes
The motion therefore carried by unanimous 3-0 vote.
ADJOURNMENT
Upon motion by Board Member Okun; seconded by Vice Chair Schmidt, and
unanimously carried, the meeting was adjoumed at 6:38 p.m.
