The subject 1.76 acre parcel is located at 479 Seabrook Road. The property was acquired by the
Village in IVovember 2010, with the intent to develop this parcel as green space in this
predominantly residential area. The site has an existing abandoned train depot, which will be
relocaYed to the Town of Jupiter, per ar� agreement between �he two munici�alities.
On January 12, 2012, Village Council approved a Future Land Use map amendment from Low
Density Residential to Recreation and Open Space (Ordinance No.23-11). The current zoning
district of the subject property is Single Family Dwelling District (R-1), and the Village is
requesting to rezone the property Yo R/OP.

Staff Analysis
Table 1 presents an inventory of existing community and neighborhood parks located in the
Village of Tequesta. The Village currently has a total of 5 parks with a cumulative acreage of
54.41 acres. The Village's neighborhood park acreage is 9.41 acres including Remembrance
Park.

On January 12, 2012, Village Council approved Remembrance Park's Future Land Use map
amendment from Low Density Residential to Recreation and Open Space (Ordinance IVo.23-11�.
The future neighborhood park is suitable for the site, and it will provide recreational
opportunities for nearby residents. The proposed Recreation/Open Space (R/OP) zoning district
is compatible with the surrounding area as presented in Table 2 below.

Policy 1.2.1 of the Recreation and Open Space Element of the Comprehensive Plan requires all
properties utilized or targeted for recreation and open space purposes be zoned to the
Recreation/Open Space (R/OP) zoning district.
The rezoning of the subject property to R/OP will provide compliance with Policy 1.2.1, and
consistency with its current Future Land Use designation of Recreation and Open Space.
Develcpment on the subject site will be restricted to the �evelopment standar�s of Section
78.179 of the Village's Zoning Code for the R/OP zoning district.

AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, PROVIDING FOR THE REZONING OF CERTAIN
REAL PROPERTY WITHIN THE CORPORATE LIMITS OF THE VILLAGE OF
TEQUESTA, FLORIDA; WHICH PROPERTY CONSISTS OF ONE PO1NT
SEVEN (1.7) ACRES, MORE OR LESS, OF LAND RECENTLY ACQUIRED BY
THE VILLAGE LOCATED AT 479 SEABROOK ROAD; PROVIDING THAT
THIS REAL PROPERTY WHICH IS MORE SPECIFICALLY DESCRIBED
HEREIN SHALL BE RE-ZONED AS "R/OP — RECREATION/OPEN SPACE
DISTRICT"; PROVIDING THAT THE ZONING MAP OF THE VILLAGE OF
TEQUESTA BE AMENDED TO REFLECT THE PROPER DESIGNATION FOR
THIS 1�.EAL PROPERTY; PROVIDING A CONFLICTS CLAUSE AND A
SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; AND FOR
OTHER PURPOSES.
WHEREAS, after duly noticed public hearings, held pursuant to Florida Statutes, the Village
Council does hereby find, determine and declare that the public health, safety and general welfare of
the citizens of the Village of Tequesta are best served by re-zoning that real property described
hereinbelow, located within the Village, as "R/OP — Recreation/Open Space District".
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLACiE OF TEQUESTA, FLORII)A, THAT:
Section 1: That certain real property recently acquired by the Village of Tequesta
consisting of a total of approximately 1.7 acres, more or less located at 479 Seabrook Road, is hereby
re-zoned "R10P — Recreation/Open Space District", and is legally described as follows:
(See Exhibit 1 attached hereto for legal description and parcel control numbers)
Section 2: The Village Zoning Map is hereby amended to conform to this Ordinance, and
the appropriate officials of the Village are instructed to make the necessary changes to the official
Village Zoning Map.
Section 3: All ordinances or parts of ordinances in conflict be and the same are hereby
repealed.
Section 4: Should any section or provision of this Ordinance or any portion thereof, any
paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder of this Ordinance.
