The following is attached to this memorandum:
1) Contractual Service Agreement, JLH & Associates.
2) Resolution No. 14-04/05 to authorize contractual agreement.
Jack Horniman currently provides planning consulting services to the Village of Tequesta and the
DepaYtment of Community Development. These services include technical guidance in the
adininistration of the compxehensive plan; technical issues that may arise in site plan reviews and the
current review of village's oxdinances and regulations.
Ivlr. Horniman assist CaYOI Lux in planning applications and the reviews that are necessary for
preparation for hearings before the Planning and Zoning Board and Village Council. Mr. Horniman
also provides assistant to the Utility Depaxttnent in the management of storm water as it relates to
the comprehensive plan.
Mr. Hornunan fees have increased this year from ninety dollars per hour to one hundred dollars per
hour. Mr. Hoxniman said that was due to added expenses that he incurs during the course of his
service.
Mr. HoYnunan budget (001-150-531.322) is thiYty two thousand dollars (32,000.). Mr. Horniman
understands that his services ase of value to the village and that his time must be maximized.

VII.LAGE OF TEQUESTA
CONTRACTUAL SERVICES AGREEMENT
THIS AGREEMENT is made tlus day of , 2004 by and between the Village of Tequ�sta (the
"Village"), a Florida municipality, and JLH Associates, (the "Contractor").
WHEREAS, the Villag� nceds to obtain professional planning and zoning setvices in_the Department
of Community Development on a part-time basis; and,
VVF�REAS, the Yllage has authorized the Village Manager to secure such services on a part-time '
basis from a qualified independent contractor, and,
WHEREAS, the Village Mauager finds that the Contractor possesses the necessary skills,
qualifications and abilities to provide the planning and zomng services neaded by the Village,
NOW TI-iEREFORE, in consideration of the mutual covenants, pro�nises and conditions contained
herein, and other good and valuable consideratioq the parties hereto do covenant and agree as follows:
I. SERVICES
A. The Village hereby retains the services of JLH Associates to provide planning and zoning
servioes for the Village of Tequesta.
B. The dates and times associated with Contractor's performance shall be determined by
the Director of the Department of Community Development and JLH Associates pursuant
to this Agreement .
II. STATUS OF CONTRACTOR
� A Contractor understands and agrees to provicie all s�rvices herein as an independent
contractor and not as an employee, agent or servant of the Village.
B. Contractor understands that he will not be entitled to any health, dental or life insurance,
workers' compensation coverage or other benefits which may be applicable to certain
other employees of th� Village.
C. Conbractor voluntarily waives and forfeits all rights any Contractor had or may have as
� a classified employee of the Village.
III. TERM
A Contractor's services hereunder shall commence on October lst, 2004, and continue
through September 30, 2W5. This contractual agreement may be extended for an
ad�ditional period of time agreed upon by both parties in writing.
B. Nothing in this Agreement shall prevent, limit, or otherwise interfere with the right of
JLH Associates to resign at any time from its position with the Village by providing at
least one (1) month written nodce giving a reasonable date of ternunation of such Agree- `
ment such that the V llage shall have an opportunity to fill said vacancy.
C. Nothing in this Agreement shall prevent, limit, or otherwise interfere with the right of
Village to terminate the services of JLH Associates at any time by providing at least
one (1) month written notice stating the date of ternunation of services.
IV. HOURS OF SERVICE AND COMPENSATION
A The hours of service to be provided by the Contractor hereunder shall be as agreed upon
by Contractor and the Director of the Deparanent of Communiry Development.
B. The Contractor shall be paid in monthly installments at the regular rate of $100.00 per hour
for services provided.
C. The V'illage shall oompensate for other reimbursable expenses, if necessary, with the
prior a�r�val of the Director of the Department of Community Development (e.g. out-of-
pocket support services
D• t1s an Inc�epenc�ent Contractor, Contractor shall reoeiv� a 1099 IRS Tax Form fro the
Village, and the Village will report monies earned by the Contractor to the IltS. Con-
tractor shall be responsi'ble for all a�licable taxes.
N. M ISCELLANEOUS
A This contract sets forth all terms and conditions for the provision of services hereunder
and no modificarion shall be made to this Agreement without the express written con-
sent of the parties hereto.
B. This Agreement shall be constn�ed in accordance with the laws of the State of Florida.
Venue for any litig�tion sl�all be in Palm Beach County, Florida.
IN WiTNESS WHEREOF, the undsrsigned parties t�ave executed this Agreement on the
13th day of February, 2004.
