At the request of Mayor Pat Watkins, I am attaching for your inforrnation a request from
Northern Palm Beach County Improvement District (NPBCID} requesting Council's
support and consideration for their proposed legislation. This request was received recently
in the mail and since this item is time sensitive this would preclude Council from placing on
the December 9, 2004 Regular Council Meeting agenda. The Mayor is planning on
bringing this item up under Any Other Matters, for Council's consideration at the
November 18, 2004 Council Meeting.
This proposed legislation is to provide for Popular Election of Two Board Members. The
NPBCID is requesting a letter of support for the proposed local bill (Attached).

The Nc�rthern Palm Beach County Improvement District Board of Supeivisors is asking
your municipality or county, to support the proposed amendment to its enabling
legislat;on which will provide for popular election of two Board Members. Enclosed is a
legislative summary for y�ur review. Thank you in advance for your support.

The proposed legislation cha.nges No:thern's voting process to include popular election
of two £ioard Members out of the total five. Three seats will continue to be filled from
the one acre one vote system. The new systam includes all constituents, whether they are
large landowners, or residents wha own and rent their homes.

Request for Support continued.
Proposed Local Bill Summarv
On Wednesday, October 27, 2004, the Committee recommendations were
presented to the Board of Supervisors in the form of proposed legislation.
The amendments to the charter would accomplish the following:
1. Terms of the Board of Supervisors would increase from three to
four years.
2. The qualifications for Supervisor will require, among other things,
ownership of property in the State of Florida, residence within the
District or ownership of property within the District.
3. Three members of the Board will be elected by District landowners
on a one acre/one vote basis.
4. Two members of the District Board will be elected at large by
popular vote at the general election in November.
5. One of the popularly elected Board members must reside north of
PGA Boulevard. One member must reside south of PGA
Boulevard.
6. In the event a Board member loses eligibility to maintain a seat
during their term, the defect must be cured within 30 days or the
seat becomes vacant. Remaining Board members will appoint a
new Board member to occupy the seat until the next general
election.
7. The annual landowners meeting to elect Board members on a one
acre/one vote basis will be changed from June to November to
conform to the time of the general election.
8. The bill provides that the Board may vote itself compensation not
to exceed $500.00 per month. The compensation level must be
approved by at least four members of the Board.

7 compensation for the board of supervisors; amending section 6
8 relating to annual landowners meetings; providing an effective
9 date.

11 Be it Enacted by the Legislature of the State of Florida:
12
13 Section l. Section 4.(B) of Chapter 2000-467, Laws of Florida, is amended to read:
14 (B) Said Board of Supervisors shall consist of five persons, who, except as herein
15 otherwise provided, shall hold office for the term of �4 years and until their successors shall be I
16 duly elected and qualified.
17 Section 2. Section 4.(D) of Chapter 2000-467, Laws of Florida, is repealed. °+�

19 Section 3. Sections 4.(D), (E), and (F) are created to read:
20 (D) Board of Supervisor Elections. Upon the effective date of this act, the following
21 procedures shall apply to the election of inembers, including appointees, to of the Board of
22 Supervisors of the District:

1 (1) The terms of two (2) board members which expire in 2005 shall be
2 extended until the date of the general election in 2006. The seats shall be denominated seat 1
3 and seat 2 respectively. Seat 1 shall be filled for a term of 4 years pursuant to section 6.(A) of
4 this act. Seat 2 shall be converted to a non-partisan elected boaxd member as defined by Chapter
5 105, Florida Statutes. Candidates for this position shall qualify with the Palm Beach County
6 Supervisor of Elections pursuant to Chapter 105, Florida Statutes, and shall be elected for a term
7 of four years by a plurality of the District electors voting in said election. "Electors" shall mean
8 registered voters as defined by Section 97.041, Florida Statutes. Board members shall take
9 office within ten (10) days of election and shall serve until expiration of their term, resignation,
10 removal or election of a new board member for that position.
11 (2) The term of the board member which expires in 2006 shall be extended
12 until the date of the general election in 2006. The seat shall be denominated seat 3. That
13 position shall then be filled for a term of four (4) years as prescribed by Section 6.(A) of this act.
14 The board member shall take office within ten (10) days of election and shall serve until

16 position.

5 (E) Qualifications. Beginning with the general election in 2006, Board of Supervisor
6 qualifications shall be: a
7 (1) The two (2) members of the board elected by electors shall be residents
8 and electors of the District as defined by Section 3.(D)(1) of this act. One (1) Board member
9 shall be a resident whose residence is located north of PGA Boulevard and one Board member
10 shall be a resident whose residence is south of PGA Boulevard. For candidates that reside within
11 the District and west of the current terminus of PGA Boulevard at the Beeline Highway or east
12 of the terminus of PGA Boulevard at Highway U.S. #l, residency location shall be determined
13 by extending the center line of PGA Boulevard at the a�pliclble �oint oi terminu5 due west to
14 Lake Okeechobee, and due east to the Atlantic Ocean. In the event any board member that is
15 elected by the electors fails to maintain residency within the District, the member shall notify the
16 District within ten 10 days of their loss of residency. Failure to reestablish residency within
17 thirty (30) days of its loss will create an automatic vacancy for their Board of Supervisors
18 position.
19 (2) The three (3) Board members elected pursuant to Section 6.(A) of this act
20 shall be residents of the State of Florida. The board member that is elected to seat 3 shall be a
21 resident of the District or own property within the District. Failure to maintain residency or land
22 ownership requirements as stated herein requires notification of the District within ten (10) days

1 of loss or residency or land ownership. Failure to cure the qualification deficiency within thirty
2 (30) days of notice will create an automatic vacancy.
3 (3) Candidates that do not collect campaign funds shall not be obligated to
4 appoint a campaign treasurer or establish a depository pursuant to Section 106.021, Florida
5 Statutes.
6 (F) Vacancies. In the event of any vacaney on the board, a qualified individual shall
7 be appointed by a simple majority vote of the remaining members of the board. The appointee
8 shall serve until the next general election. At that election, the position shall either be open for
9 election for a full term or the remainder of the vacated seat, whichever is appropriate.
10 Section 4. Current Section 4.(E) and (� are relettered (G) and (H).
11 Section 5. Section 5 of Chapter 2000-467, Laws of Florida, is amended to read:

1 (A) Each year during the month of �eN�vember, beginning with the month of �
2 -�€r�-November 2006, a meeting of the landowners of the District shall held for the purpose of
3 electing Supervisors *^ +^'�° *'^° �'�^� ^+ {',° N°*;r; � and hearing reports of the Board
4 of Supervisors; provided, however, that a meeting of the landowners shall be held during the
5 month of -3��e—�Nove�nber, for the purpose of receiving reports of the Board of Supervisors I
6 and considering any matters upon which the Board°of Supervisors may request the advice and
7 views of the landowners. The Board of Supervisors shall have the power to call special meetings
8 of the landowners at any time to receive reports of the Board of Supervisors or consider and act
9 upon any matter upon which the Board of Supervisors may request advice. Notice of all
10 meetings of the landowners shall be given by the Board of Supervisors by causing publication
11 thereof to be made for 2 consecutive weeks prior to such meeting in some newspaper published
' 12 in Palm Beach County. The meetings of the landowners shall be held in some public place in
13 said County, and the place, day, and hour of holding such meetings shall be stated in the notice.
14 The landowners when assembled shall organize by electing a Chair who shall preside at the
15 meeting. The Secretary of the Board of Supervisors shall be the Secretary of such meeting. At
16 all such meetings each and every acre, or any fraction thereof, of land in the District except
17 publicly owi�ed prc�pet�ty a�ainst which the district c�oes not levy assessments shall represent one
18 share, and each owner shall be entitled to one vote in person or by written proxy for every acre,
19 or any fraction thereof, of land owned by him or her in the District. The person receiving the
20 highest number of votes for Supervisor shall be declared and elected as such Supervisor. Those
21 landowners present or voting by proxy shall constitute a quorum at any meeting of the
22 landowners.
23 Section 7. This act shall take effect upon becoming law.
