Y 1V W J1.Q�ULVJ .-� LVVJ \/11V 1 V✓ VVV�1V11 V✓ . 1J111111V IJKl1J11u1V 1 tAbv 1 Vl ✓ Select Year: 2005 Go The 2005 Florida Statutes Title_XII Chapte�_185 View �ntire_Chapter MUNICIPALITIES MUNICIPAL POLICE PENSIONS 185.05 Board of trustees; members; terms of office; meetings; tegat entity; costs; attorney`s fees.-- For any municipality, c�iapter plan, tocat law municipality, or tocal taw plan under this chapter: ° (1) in each municipatity described in s. 185,03 there is hereby created a board of trustees of the munitipal potice officers' retirement trust fund, which shatl be solely responsible for administering the trust fund. Effective October 1, 1986, and thereafter: (a) The membership of the boasd of trustees for chapter plans shalt consist of five members, two of whom, uniess otherwise prohibited by taw, shall be legal residents of the municipality, who shatt be appointed by the legistative body of the municipality, and two of whom shall be police officers as defined in s. 185.02 who shatt be etected by a majority of the active patice officers who are members of such plan. With respect to any chapter plan or local taw plan that, on January 1, 1997, allowed retired police officers to vote in such etections, retirees may continue to vote in such elections. The fifth member shall be chosen by a majority of the previous four members, and such person's name shatl be submitted to the legislative body of the municipality. Upon receipt of the fifth person`s name, the legislative body of the municipality shatt, as a ministerial duty, appoint such person to the board of trustees as its fifth member. The fifth member shatt have the same rights as each of the other four members appointed or etected as herein provided, shatl serve as trustee for a period of 2 years, and may succeed himsetf or hersetf in office. Each resident member shatt serve as trustee for a period of 2 years, un(ess sooner replaced by the legislative body at whose pteasure the member shatl serve, and may succeed himself or hersetf as a trustee. Each potice officer member shatl serve as trustee for a period of 2 years, unless he or she sooner teaves the employment of the municipatity as a police officer, whereupon the legislative body of the municipality shalt choose a successor in the same manner as an original appointment. Each potice officer may succeed himself or herself in office. (b) The membership of boards of trustees for locat taw plans shall be as follows: 1. If a municipality has a pension ptan for police officers only, the provisions of paragraph (a) shall apply. 2. If a municipality has a pension plan for police officers and firefighters, the provisions of paragraph {a) shalt apply, except that one member of the board shall be a potice officer as defined in s. 185.02 and one member shall be a firefighter as defined in s. 1_75.032, respectivety, etected by a majority of the active firefighters and potice officers who are members of the ptan. http://www.leg.state.fl.usiStatutesiindex.cfm?App mode=Display_Statute&Search String=... 9/1i2005
