SUBJECT: Request for Waiver of Voluntary Annexation Fees
This request is for waiver of voluntary annexation fees by Baldino's, as discussed at a
previous Village Council meeting. Staff and Council Member Humpage provide the
attached backup for your review and consideration.

I originally brought this subject to your attention at the April
C'ouncil Meetir�g and ho�e at this time we may come to some
consideration on the issu� �Vly interest i.s eacpanding the
geographical boundaries of the �llage and while doing so,
increase the V'�Ilage tnac hus� N'e mu.st continue tn look "down
the road" and be sure our Vllage is�nancinlly sound and able
to continue providing its' taac payers with the outstanding services
they now enjoy.
These services are provided though the use of taxpayer dollars
and as we all know will become more costly in years to com�
Each year the cost of doing business and the cost of living
increase and we must insure the �llage has sufficient revenues
to meet these increase� 11�one af us wants to rai.se tax�s sv
increasing the tax base is an excellent alternativ�
One of tl�e difficulties facing those individuals who choose to
voluntarily annex inta the Vllage is the fe� The b�tsic fees set by
the Village are:
Comprehensive plan amendment ............... �5000.00

These fees, set by t�ie �llage, represent the cost o time and
advertising required for the ann�ation. They do not accurately
reflect our actual cosz Most municipalities make a distinction
between a larrge parcel annezation, over 1 D acres, and a small

purcel, less t�iun 1 fl acre� It is my understanding thut small
parcel costs rarely �ceed $2,500.00, while large parcels ean
easily exceed the $7,000.00. We need to reconsider this issue.
� would suggest you consider this thoughz While a one-time fee
of advertising and sta ff overhead would be involved, you will
increase your tax base for the continuum. �t is this thought
process that will allow us to increase Tequesta's tax base with a
nunimum one time waiver,

�iave seen before, to help you in this endeavor. 1V�any other
munici�alities do this on a regular basis and have been most
helpful to me with this research. I have also spoken to our own
staff in the Departmen# of Community Development w�eo may
also be of great assistance to you with your questions.

Of late I have been checking with other cities and towns to find how they �
handle their annexation fees My interest was peeked by a gentlemen who i
owns a local business and wishes to annex into the Village. As his
property is contiguous with the Village, annexation is possible. One of the
problems he has incurred were the fees The cost is basically �7, 000. 00
plus advertising. If the Village were to waive the fees, we would recover
tltose costs in about eighteen months ( via property taxes) and continue to
receive tax dollars annually.
Here are tjie jurisdictions and their approach to "[�OLUNTARY"

As you know, the taw firm of Moyle, Flanigan, Katz, Raymond & Sheehan, P.A.,
represents Mr. and Mrs. Sal Batdino, the owners of Baldino's Italian Restaurant located at 19708
U.S_ Highway One. Tt�e p�upose of this correspo�ence is to request that we be placed ott the July
Village Council meeting agenda to request a waiver of all Village fees with respact to annexation.
That would include the fees associated with the Comprehensive Land Use Plan and Zoning
designations. The Baldinos are anxious to expand their restaurant and would like have the fee
matter r�esolved �s soon as possible.

SCHEDULE OF FEES AND ADNIINISTR.ATIVE COSTS
RE LAND DEVELOPMENT, ETC.*
Sea 16•1. Adoption and purpose. :
, _ (a) The application and filing fee schedule is hereby adopted.
Provisions contained herein shall constitute the fees chaxged by
the Village of Tequesta for various land development activities.
Such fees shall cover all administrative costs and additional costs
incurred by the village as part of and during the processing and
review of the various activities. This chapter shall generally be
referred to as the "fee schedule"..
(b) The purpose of this fee schedule is to provide a centralized
listing within the Code of Ordinances which establishes a range
of fees and charges as determined by the village and administered
by the building official in the processing and review of applica-
tions for activities such as, but notlimited to, land development.
This chapter may, from time to time, be amended by the village
council.

Sec. 16-2. Administrative costs.
(a) To cover all administrative costs incurred by the village,
the applicant shall pay a base application fee as determined by
the building official and established herein by the village council.

Sec. 16-3. Additional costs.
To cover all additional administrative costs, actual or antici-
pated, including, but not limited to, engineering fees, consultant
fees and special studies, the applicant shall compensate the
village for all such costs prior to the processing of the application
or not later than thirty (30) days after final application approval
whichever is determined as appropriate by the village.

Dear Commissioner Humpage:
As you know, this firm represents Sal and Louise Baldino, the owners of Baldino's Italian
Restaurant located at 19708 U.S. Highway One. The subject property is currently outside the
corporate limits of the V'illage of Tequesta. Mr. and Mrs. Baldino asked that I inquire as to the cost
and processing time for annexation into the Village. During our irutial meeting with staff, we were
informed that although the Annexation process was free, the Comprehensive Land Use Plan
Amendment and Rezoning designation require filing fees of approximately $7,000.00.
For camparison purposes, I contacted o�'icials in the Village of Palm Springs (Paul Nicoletti,
Esq.), City of Palm Beach Gardens ( Kara Irwin), Town of 3upiter (Steven Mayer) and Tov+m of Juno
Beach (Damian Peduto) to deternzine what filing fees were associated with each municipality. In
each instance, all four (4) jurisdictions indicated that filing fees are waived for voluntary Annexation,
Comprehensive Land Use Plan Amendments and Rezonings. However, there is one small exception.
Jupiter requires that $1,200.00 be placed in a Town escrow account to pay for costs associated with
legal advertising and natice to surrounding property owners. Any unused monies aze returned to the
applicant.

If a municipality is truly seeking to offer incentives to property owners for voluntary
Annexation, I believe it is typical throughout Palm Beach County that the maj ority of municipalities
would be willing to waive the three (3) fees in order to expand their corporate boundaries, further
their tax base and provide a greater level of municipal services for new residents through the
Annexation process.
