I write to you on behalf of the Town Commission of the Town of Jupiter Islan,d (the
Town}. I understand the House of Representatives and the Senate aze considering legislation
which, from the Town's perspective, would remove a safs�uard which current benefits the
Town.
As the Town understands the above-referenced Iegislation, iarge scale developmen#
projects known as Develapments of Regianal Impact (URI} could be exempted from the
statutory review process wlv.ch has been in place since 1972. As you know, a DRI, 6y definition
is a project that is expected ta impact more than one county. See Fla. Stat. Sectio� 380.06(1):
Given that definitio�t, it is reasona.ble to assume that a proposed DRI would create impacts upan
the municipalities wluch are within the cvunty where the DRI is lacated. Of cancern is that the
legislation would allow countias to unilaterally exempt those projects which meet th.e threshold
ta be a DRI from the existing regional and state re�iew processes which have traditionally .
� provided mwucipaiities and adjacent counties with a significant oppartunity for
intexgovernmental eoorriination, and, more importantly coapera.tion.
If tlus legislation remains unchanged, a cvunty may determine that a DRI which may
have impacts on those local governments who participate in the Regional Pianning Couneils of
the state, and yet the DRI would not be subject ta Regional Planning Cawncil review. Instead,
the DRT would only be subject to a review by the s#ate ag�ncy formerl� icnown as the Sta.te
Planning Agency. As a result af last year's Community Plann�ng Act, this agency's revievv is

Dear Ms. Kryzda:
Attached is Resolution No. 679 that was unanimously passed by the Jupiter Island Town
Commission at a Joint Meeting attended by the Jupiter Island Commission and the City of
Stuart Commission on August 2, 2Q11. As you may be awaxe, the resolution passed by the
Town and a similar resolution passed by the City of Stuart was in support of the Martin
County's Commission's actions both past and future in ma.intaining compliance with the
County's current Comprehensive Growth Management Plan and the Urban Services Districts.
I ask that you share this letter and adopted resolution with your Commissioners so they can
see where Jupiter Island, along with the City of Stuart stand on these very important issues
facing Martin County.

WHEREAS, the amendment of the Plan to accommodate any DRI projects would
be a substantial change in the policy of Martin County and would result in residents who
currently reside within the Districts to participate in the financing of the expansion of
urban public facilities and services even though adequate land is available east of the
District boundaries for future development and redevelopment.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF
THE TOWN OF JUPITER ISLAND, MARTIN COUNTY, FLORIDA, AS FOLLOWS:
SECTION 1. The "whereas" clauses above are incorporated herein as the
findings of the Town Commission.
SECTION 2. The Town of Jupiter Island Town Commission respectfully requests
that the Martin County Board of County Commissioners (BCC) maintain the current
Primary and Secondary Urban Service Districts as established in the Martin County
Comprehensive Growth Management Plan. Furthermore, the Town Commission
respectFully requests that the BCC not establish any new "stand—alone" urban service
districts which would permit the expansion of urban public facilities and services west of
the District boundaries.. .
SECTION 3. This Resolution shall take effect immediately upon its adoption.

CUMPREHENSIVE GROWTH MANAGEMENT PLAN; AND

�, S, the Martin County Board of County Cammissianers has adopted a
Comprehensive Crowth Management Plan {the Plan) wtuch has previously been detenmined by
the state land plannimg agency of the State of Fbrida to be in cornpliance with Chapta 163, Part
II, Flarida Stahrtes; and -
WHERFAS, the Plan has established Primary and Secondary Urban Service Districts,
the urte� of which is to manage growth and to provide far the expansion of urban servic�s to
areas of the Couaty which are suitable f+or urbanization; and
WHEREAS, a concern exists that there remains an adequate inventory of acreage for
reside�ial a�i non residential grawfh within the Frimary and Seoondary Urban Service
Districts; and
. WHEREAS, the Plan caMains a Goal which provides that Martin County st�all dire�t
growth in a timely and efficient mann� to tl�se areas wl�re urban public faciiities and services
are available, or are progranamed to be available, at the levels of service adopted in the Plan's
Capital Improvemerrt Element; and
WHEREAS, the Primary and Secondary Urban Service Districts (the District} were
established by the Plan to regulate growth and to provide for urban publia facilities and services;
and

I am writing at the dlrection of the Ocean Breeze Park 1'own Council to thQnk
the Bodrd of County Commissioners for its, decades-long Commitment to the
Marfin County Growth Monagement Plan and more porticularly for its careful
sfiewardship of the Plan's Urban Services Boundaries (USBs). With regard to fihe
proposed Hobe Grove and Harmony DRIs, I am aware thc+t the Town of Jupiter
Island, Town of Sewoll's Point and Ci�ty of Stuart are on record in support of the

WHEREAS, the northern Palm Beach County municipal partners (and inciuding
unincorporated Palm Beach County) have inventoried land availabie to accommodate
the potential for eight million square feet of research and development uses which are
projected to potentially develop over a 30 year 6uild out period within a 10 mile radius of
Scripps Florida: and
WHEREAS, the development of these two DRIs, in particular the 2,945,000
square feet of research and development uses would add to the inventory and
potentially threaten fhe investment made by the Town, Pa{m Beach County, and the
State of Florida in developing the bio-technical uses the municipalities and Palm Beach
County have set aside to develop the "Scripps cluste�' in northern Palm Beach County.
WHEREAS, the development of these two DRIs, in particular the 8,300
residential units, would result in adverse REGIONAL impacts to the beach and boating
access facilities in northem Palm Beach County, which are located in the Town.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF JUPITER, FLORIDA, AS FOLLOWS:
Section 1. The whereas clauses are incorporated herein as true and correct
findings of the Town Council.
Section 2. The Town Council of the Town of Jupiter respectFully requests that
the Martin County Board of County Commissioners not approve the proposed Hobe
Grove and Harmony DRIs due to anticipated adverse REGtONAL impacts from the
developments on traffic and boat and beach access facilifies within the Town and the
anticipated adverse economic impacts to the Scripps Florida bio-technology cluster.
Section 3. The Town Council of the Town of Jupiter respectfufly requests that
the Martin County Board of Couniy Commissioners not approve any Comprehensive
Plan amendments associated with the proposed Hobe Grove and Harmony DRIs due to
anticipated adverse REGIONAL impacts within the Town identified in Section 2.
Section 3. This Resolution shall take effect immediately upon its adoption.
