Plan
The Palm Beach County Emergency Management Department has
requested the Village of Tequesta adopt the revised Local
Mitigation Strategy (LMS) Plan. The Village had previously adopfied
the LMS plan by Resolution 30-99/00. This Resolution will be sent to
the Emergency Management Department for them to include in
the revised LMS Plan.

RE: Adoption of the Revised LMS Plan
All Local Mitigation Strategy (LMS) programs across the U.S. are
being required by the Federal Emergency Management Agency
(FEMA} to bring their plans into compliance with the new federaf
guidelines introduced in response to the Disaster Mitigation Act of
2000. A"FEMA approved" LMS plan is required by November 1,
2004 in order far Palm Beach County and participating municipalities
to be eligible to apply for and receive pre and post disaster federal
mitigation funding.
After a very lengthy and involved revision process, in November of
2003 Palm Beach Gounty's plan was among the first in the U.S. to be
granted "conditional approval" by FEMA ... i.e. the plan was approved
conditioned upon completion of certain additional specified changes
and documented evidence of adoption of the revised LMS by all
participating jurisdictions. The required additional changes have now
been completed and submitted to the Florida Department of
Community Affairs and FEMA. We are now proceeding with the final
step of completing the adoption process at the municipal and county
levels and supplying evidence to FEMA in time to make the November
1st deadline.
Enclosed find the following:
' �. �� �� 1. A GD-ROM copy of the Revised Palm Beach County Unified
Local Mitigation Strategy Plan
2. A copy of the LMS municipal adoption resolution
3. A copy of the cross-walk document pairing the FEMA required
changes with the sections or pages changed and resubmitted.
Please do everything you can to expedite the adoption process. In
order to meet FEMA's deadline, we are establishing a deadline of
October 1 for receiving all executed adoption resolutions.
Municipalities not included in our FEMA submission package will likely
have to reapply for membership in the LMS and will be ineligible for
federal funding until they are reinstated in the program.
Far your informatian, a draft of the enclosed adoption resolution has
been reviewed and revised in accordance with recommendations
provided from the County attomey's office, the attorney's office
representing the League of Cities, and the Florida Department of
Community Affairs.
Your municipality is required to execute the new adoption resolution
even if it has a previously executed Interlocal Agreement on file with
the county. We have purposely kept the enclosed resolution shart and
straight forward in hopes af avoiding lengthy legal delays. The
resolution basically represents a recommitment to the LMS program
as modified by the Disaster Mitigation Act of 2000. It is essentially the
same resolution other communities will use.
� One significant change that should be noted is FEMA's more stringent
requirements for documented participation by all jurisdictions.
Accordingly, the LMS Steering Committee has introduced strict rules
on LMS meeting attendance, committee participation and project
submission.
While participation in the LMS is voluntary, we strongly recommend
� that no municipality withdraw from the program without first seriously
considering the potential costs, risks, and exposures that nan-
participation would bring.

A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, PALM BEACH COUNTY, FLORlDA, AUTHORIZING THE
VILLAGE OF TEQUESTA TO ADOPT THE REVISED UNlFIED PALM
BEACH COUNTY LOCAL MITIGATION STRATEGY PLAN; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Palm Beach County and its 37 municipaiities, worked together in
�998 and 1999 to devefop a multi-jurisdictional strategy known as the Unified Local
Mitigation Strategy Plan to create a more disaster resistant community; and
WHEREAS, the Federal Disaster Mitigation Act of 2000 (DMA2000) and the
Federal Emergency Management Agency (FEMA) require communities #o adopt a
hazard mitigation plan in order to be eligible to receive pre-disaster and post-disaster
federal funding for mitigation purposes; and
WHEREAS, Palm Beach County and its 37 municipalities have participated in
the Unified Local Mitigation Strategy (LMS) program since its inception in 1999 and a
majority of the 37 municipalities approved an Interlocal Agreement with Palm Beach
County concerning the LMS program (the "LMS Interlocal"); and
WHEREAS, the County and its 37 municipalities coordinated a public process to
revise and amend the Unified LMS plan to bring it into full compliance with new federal
guidelines established in response ta DMA2000 (the "Revised LMS Plan"); and
WHEREAS, Palm Beach County's Revised LMS plan was reviewed and
approved by FEMA and the Florida Department of Community Affairs contingent upon
the inclusion of mutually acceptable changes and the adoption of same by the Palm
Beach County and the municipalities; and
WHEREAS, the LMS Steering Committee recommends the formal adoption of
the Revised LMS plan by resolution pursuant to the terms of the LMS Interlocal.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VIt�AGE OF TEQUESTA, FLORIDA, THAT:
Section 1. The Village of Tequesta hereby approves and adopts the Revised
Unified Local Mitigation Strategy P{an in its entirety, as revised and approved by the
Locat Mitigation Steering Committee (the "Revised LMS Pfan") and agrees to be
governed by the Revised LMS Plan, which shall hereafter amend any LMS Interlocals
previously appraved by Village of Tequesta.
Section 2. The Village of Tequesta authorizes the Village Counci! to pursue
available funding opportunities for implementation of proposals designated therein, and
will, upon receipt of such funding or other necessary resaurces, seek to implement the
actions contained in the mitigation strategies.
Section 3. The Viflage of Tequesta will con#inue to participa#e in #he mu1t�-
jurisdictional LMS planning process, including reporting of progress as required ��
FEMA, the Florida Department of Community Affairs, and the LMS Steering Committse.
Section 4. The Village Council directs the Clerk to transmit an original of the
execufied Resofutian to the Palm Beach County Division of Emergency Management,
aftention Senior Mitigation Pianner (Tel. 712-6325), to be forwarded for filing in the
Office of the Circuit Court.
Section 5. This Resolution shall take effect immediately upon adoption.

INTERLOCAL AGREEMENT BETWEEN THE BOARD OF COUNTY
COMMISSIONERS, PALM BEACH COUNTY, FLORIDA, AND
VILLAGE OF TEQUESTA
THIS IN'TERLOCAL AGREEMENT is entered into this 26th day of Julv , 2000 by and between
the Board of County Commissioners, Palm Beach County, Florida (herein referred to as
"COUNTY"), and Villa�e of Te�uesta (herein refened to as "CITY"),
each one constituting a public agency as defined in Part I of Chapter 163, Florida Statutes.
WITNESSETH:
WHEREAS, Section 163.O1 of the Florida Statutes, known as the "Florida Interlocal
Cooperation Act of 1969," authorizes local governmental units to make the most efficient use of their
powers by enabling them to cooperate with other localities on a basis of mutual advantage and
thereby to provide services and facilities in a manner and pursuant to forms of governmental
organization that will accord best with geographic, economic, population and other factors
influencing the needs and development of local communities; and
WHEREAS, Part I of Chapter 163 of the Florida Statutes permits public agencies as defined
therein to enter into interlocal agreements with each other to exercise jointly any power, privilege,
or authority which such agencies share in common and which each might exercise separately; and
WHEREAS, in July of 1998, the State Department of Commuruty Affairs provided funding
and entered into an agreement with Palm Beach County to develop a countywide unified Local
Mitigation Strategy that will become part of a Statewide Hazard Mitigation Strategy; and
WHEREAS, the development ofthe countywide unified Local Mitigation Strategy required
the participation of all the local municipal governments within Palm Beach County; and
WHEREAS, the (Town, City, Village, etc.) entered into an interlocal agreement with Palm
Beach County to develop a countywide unified Local Mitigation Strategy, and assigned a voting
representative to the Local Mitigation Strategy Steering Committee, which is an advisory committee
to the Board of County Commissioners; and
WHEREAS, with the completion of the LMS planning process, each local government will
be in the possession of a strategy which will guide the priorities of rebuilding the community after
disasters; and

WHEREAS, communities that implement disaster resistant planning techniques
such as a Local Mitigation Strategy will receive more funding faster after a disaster tfian
those that have not undertake� a Locat Mitigation Strategy project. Furthermore, these
communities will be given a priority over those that have not implemented a mitigation
strategy when various mitigation funding sources are made available; and
WHEREAS, the Local Mitigation Strategy Steering Committee has developed a
countywide Local Mitigation Strategy that includes a description of countywide hazards
and vulnerabilities, a definition of critical facilities, a database detailing specific latitudinal
and longitudinal locations of those facilities, a method for conflict resolution betw�een
participants, a list of pre-identified and prioritized mitigation programs, projects and
initiatives, and a methodology to revise the prioritized list of mitigation programs, projects
and initiatives; and
WHEREAS, as required by the State of Florida Department of Community Affairs,
the Local Mitigation Strategy, including the specifics mentioned above, must be adopted
by Palm Beach County and by each local municipal government within the County.
NOW, THEREFORE, in consideration of the mutual covenants, promises and
representations herein, the parties hereto agree as follows:
SECTION 1. PURPOSE
To develop a strategy which will systematically guide the priorities of rebuilding after
a disaster including a method for conflict resolution between participants, a list of pre-
identified and prioritized mitigation programs, projects and initiatives, and a methodology
to revise the prioritized list of mitigation programs, projects and initiatives.
SECTION 2. GENERAL TERMS AND CONDITIONS
A. Both the COUNTY and the CITY agree to be governed by this Agreement,
as well as applicable State and Federal laws, rules and regulations.
B. Modification of this Agreement may be requested by either party. Changes
which are mutually agreed upon shall be valid only when reduced to writing, duly signed
by each party and attached to the original Agreement.
C. There is hereby created a committee to be known as the "Local Mitigation
Strategy Evaluation Panel° responsible for developing the draft list of prioritized Local
Mitigation Strategy projects. The Local Mitigation Strategy Evaluation Panel shall be
governed by the Palm Beach County Local Mitigation Strategy as approved by the

Steering Committee on September 30, 1999, attached hereto as Exhibit A and
incorporated herein by reference.
D. The parties agree to be governed by the Instructions for Evaluating Hazard
Mitigation Projects described by the Local Mitigation Strategy.
E. The parties agree to be governed by the Project Prioritization Methodology
as described by the Local Mitigation Strategy.
F. The COUNTY and the CITY agree to resolve any conflicts that may arise
from the development of the Local Mitigation Strategy by using the Local Mitigation
� Strategy Conflict Resolution Procedure attached as described by the Local Mitigation
Strategy.
G. Future prioritized project lists developed in accordance with the Local
Mitigation Strategy Proje�t Prioritization Methodology shatl be submitted to the COUNTY
for approval at least once per year. In the event that a prioritized list is not approved by
the COUNTY, the last approved prioritized list shall be deemed the governing list.
H. Future revisions of the Local Mitigation Strategy shall be submitted to the
COUNTY by resolution for formal adoption.
SECTION 3. LIABILITY
A. The CITY as a Florida municipality agrees to be futly responsible as setforth
in Section 768.28, Florida Statutes, for its own negligent acts or omissions or tortious acts
which result in claims or suits against the COUNTY and agrees to be liable to the limitss set
forth in Section ?68.28, Florida Statutes, for any damages proximately caused by said a�ts
or omissions. Nothing herein is intended to serve as a waiver of sovereign immuniiy by
the CITY to which sovereign immunity applies. Nothing herein shall be constn�ed as
consent by a State agency or subdivision of the State of Florida to be sued by third parties
in any matter arising out of any contract.
B. The COUNTY, as political subdivision of the State, agrees to be fully
responsible as set forth in Section 768.28, Florida Statutes, shall be fully responsible for
its own negligent acts or omissions or tortious acts which result in claims or suits against
the CITY, and shall be tiable to the limits set forth in Sectio� 768.28, F.S. for any damages
proximately caused by said acts or omissions. Nothing herein is intended to serve as a
waiver of sovereign immunity by the COUNTY to which sovereign immunity applies.
Nothing herein shall be construed as consent to be sued by third parties in any matter
arising out of any contract.
Nothing herein shatl be construed as a waiver of sovereign immunity by either party,
pursuant to Section 768.28, Florida Statutes.

SECTION 4. TERMINATION
This Agreement may be terminated without cause by either party to this Agreement
upon one hundred eighty (180) days written notice to the other party. Tennination wilt not
affect the opportunity to place projects on prioritized project lists.
SECTION 5. NOTICE AND CONTACT
A. All notices provided under or pursuant to the Agreement shall be in writing,
delivered either by hand or by first class, certified maii, return receipt requested, to the
representatives identified below at the address set forth below.

SECTION 6. ENTIRETY OF AGREEMENT
The parties agree that this Agreement sets forth the entire agreement between the
parties, and there are no promises or understandings other than those stated herein.
SECTION 7. INVAI.IDITY OF CLAUSES
The validity o� any portion, article, section, paragraph, provision, clause, or any
portion thereof of this Agreement shall have no effect upon the validity of any other part
or portion hereof.
SECTION 8. VENUE
To the extent allowed by law, the venue for any action arising from this Agreement
shall be in Palm Beach County, Florida.

. SEGTION 9. ATTORNEY'S FEES
Any costs or expenses (including reasonable attorney's fees) associated with the
enforcement of the terms and/or conditions of this Agreement shall be borne by the
respective parties, however, this clause pertains only to the parties to this Agreement.
SECTION 10. DELEGATION OF DUTY
Nothing contained herein shall be deemed to authorize the delegation of the
constitutional or statutory duties of the officers of the COUNTY and CtTY.
SECTION 11. EQUAL OPPORTUNITY PROVISION
The COUNTY and the CITY agree that no person shall, on the grounds of race,
color, sex, national origin, disability, religion, ancestry, marital status or sexual orientation
be excluded from the benefits of, or be subjected to, any form of discrimination under any
activity carried out by the performance of this Agreement.
IN WITNESS WHEREOF, the parties have executed this Agreement as of the date
set forth above.

for Review and Submission of Local Mrtigation Plans
to the State Hazard Mitigation Officer and FEMA Regional Office
Attached is a crosswalk reference document, which is based on the Final Draft Report State and Local Plan Interim Criteria Under the Disaster
Mitigafion Act of 2000, published by FEMA HQ and dated July 11, 2002. This document was based on the Disaster Mitigation Act of 2000 (P.L.
106-390), enacted October 30, 2000 and 44 CFR Parts 209 and 206 /nterim. Final Rule, published February 26, 2002.
The purpose of this Crosswalk is threefold:
1) To provide a tool to local jurisdictions in developing and submitting Mitigation Plans under Section 322 of the Disaster Mitigation Act of 2000. The
crosswalk can be used to assist local or multi jurisdiction entities in the process of developing and reviewing Local or Multi jurisdictional plan(s).
Each Local or Multi-jurisdictional plan should be reviewed by the pertinent local jurisdictional entity prior to submitting the plan to the respective
State. In addition as stated in the Interim Final Rule §201.6(d)(1) "Plans must be submitted to the State Hazard Mitigation Officer for initial review
and coordination. The State will then send the plan to the appropriate FEMA Regional Office for formal review and approval." The local jurisdiction
must fill out column 3 prior to submitting the plan for formal review and approval. ,

There were several inaccuracies found within the
profiling section of the plan. The following
comments are provided for you information.
1) Page 3-11 states that Hurricane Andrew
"dumped 10 inches of rain leaving many buildings
extensively water damaged." This statement
directly follows a paragraph that identifies the
aspects of storm surge. 1f the statement is meant
to illustrate storm surge it does not as rain is
precipitation not storm surge. However, if it is
meant to illustrate how precipitation leads to severe
flooding then it should be listed with all the other
tropical events under flooding.
2) A dam/levee failure is listed as a seismic hazard
when it is actually a technological hazard that can

The Loxahatchee River is the southernmost tributary of the Indian River Lagoon and includes the Northwest Fork of the Loxahatchee
River, the first nationally designated Wild and Scenic River in Florida. This historic watershed, over750 square miles, has been reduced
by flood control basins and drainage districts to approximately 277 square miles in southern Martin and northern Palm Beach Counties.
The region's population is nearing 80,000, and most of those residents live in the coastal communities of Hobe Sound, Tequesta, Jupiter,
Palm Beach Gardens and Juno Beach.
Water quantity and quality influence the aquatic and wetland ecosystems in the watershed. Water is a limited resource necessary, not
only for public use, but to conserve natural areas and protectwetlands. Fresh waterthat historically reached the Wild and Scenic River
began being diverted at the turn of the last century to provide drinking water to Palm Beach. In the 1950s, the headwaters of the river
were drained for agriculture and other urban land uses. Today, even more water is being diverted for human consumption. Over the
past 50 years, four river miles of cypress swamp have been replaced by mangroves due to saliwater intrusion resulting from diminished
freshwater flow. Wetlands have been intentionally drained and/or filled, or simply degraded through water diversion and a lowered water
table. Changes in hydrology have allowed invasive exotic plants to move into areas that were once high quality wetlands. Meanwhile,
the environmental quality of the Loxahatchee River has been negatively influenced by pollution entering waterways via point and non-
point sources. Some of the waterways in the river system are impaired waters that do not meet their designated uses.
The Loxahatchee River Preservation Initiative (LRPI) is the outgrowth of a watershed management effort that the Florida Department of
Environmental Protection spearheaded in 1996. The LRPI was formed in 2000 with the single purpose of seeking out funding assistance
for projects that would improve and protect the natural resources within the watershed. Several key projects, critical to preserving the
long-term health of the Loxahatchee, have not been implemented due to lack of resources and other regional priorities taking
precedence. Urban stormwater improvements and the restoration of other tributaries including the estuarine portion of the river system
are emphasized in the Loxahatchee River Preservation Initiative. Urban residents and river users will be the primary beneficiaries of our
efforts to improve the water quality of the Loxahatchee. Over the past three years, the LRPI has been instrumental in kick starting $12
million dollars in water quality enhancement projects. Within 2005, it is hoped that the momentum to restore this valuable resource will
continue as much work remains to be completed.
