ORDINANCE NO. 3-12
AN ORDINANCE OF THE VQ.LAGE COUNCII.. OF THE VQ.LAGE OF
TEQUESTA, FLORIDA, AMENDING 1'� VQ.LAGE CODE OF
ORDINANCES AT C'AAPTER 74. UTILITIES. AT ARTICLE II. WATER
SERVICE. DIVISION 3. WATER CONSERVATION AND REGULATION.
BY REPEALING TffiS DIVISION IN ITS ENTIRETY AND RESERVIIVG
IT FOR FUTURE USE; PR4VIDING TAAT EACH AND EVERY
OTHER SECTION AND SUBSECTION OF CHAPTER 74. SHALL
REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED;
PROVIDING A CONFLICi'S CLAUSE, A SEVERABILiTY CLAUSE AND
AUTHORITY TO CODIFY; PROVIDING AN EFFEGTIVE DATE; AND
FOR OTHER PURPQSES.
WHEIlt�AS, the Village Council of the Village of Tequesta has adagted Ordinance -12, _
which, among other tirings, restructures the Village Code of Ordinances by reloc�ting the
village's water shortage regulations into Chapter 50. Nafival Re.gource Protection; and
WHEREAS, said relocation require.s that the former "water conservation and
regu.lamonlocated at Chapt:er 74, Article II, Division 3 be repealed and reserved for firture use;
and
WHEREAS, the Village Council believes that these revisions to the Village's code are in
the best interests of the Village of Tequesta, and will promote the public health, safety and
welfare.
NOW,1'HEREFORE, BE 1T ORDAINED BY THE VII.LAGE COUNCII.. OF THE
VII.LAGE OF TEQUESTA, PALM BEACH COUNTY, FLURIDA, AS FOLLOWS:
Section 1: Chapter 74. Utilities. of the Code of Qrdinances of the Village of Tequesta
is hereby a�ten,ded at Article II. Water Service. Division 3. Water Conservation �d Regulation.
by repealing ttris division in its entirety, Sections 74101 through 74109 inclusive, and reserving
same for future use. The Village Council hereby directs the Village Clerk to ensure that the text
of Article II. Water Service. Division 3. Water Conserv�ation aad Regulation be removed from
the Village Code, aud to further ensure that the table of contents for Chapter 74 is properly
amended to reflect said repeal.
��h'on 2: Each and every other section and subsection of Chapter 74. Utilities. shall
remain in fiill force and effect as previously enacted.

Section 3: Ali Ordinances or parts of Ordinances in conflict herewith be and the same
are hereby repeatea.
Section 4: Should any Section or provision of this Ordinance or any portion thereof,
any paragraph, sentence or word be cleclared by a Court of competent jurisdiction to be invalid,
such decision sLall not affect the validity of the remainder of this Ordinance.
Section 5: Specific authority is hereby granted to codify this Ordinance.
=6: This Ordinance shall become effective immediately upon passage.
