A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, AUTHORIZING THE USE OF $1000.00 FROM
THE SPECIAL LAW ENFORCEMENT TRUST FUND TO BE USED TO
PAY THE ANNUAL MEMBERSHIP FEES ASSOCIATED WITH THE
PALM BEACH COUNTY LAW ENFORCEMENT EXCHANGE SYSTEM;
PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PiJRPOSES
WHEREAS the Chief of Police has certified that the request complies with the
provisions of Chapter 932, F.S.:
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOW5:
Section 1 "The Village Council herby adopts Resolution 7-12 authorizing the use of
$1000.00 from the Special Law Enforcement Trust Fund to be used to pay the annua.l
membership fees associated with the Palm Beach County Law Enforcement Exchange System

7he FY20].2 agency user contribution of $1,000 for the use and maintenance of the law Enforcement eXchange
{LEXI information sharing system from October 1, 2011— September 30, 2Q12 is now �ayable.
Ongoing funding contributions from local law enforcement agencies and other invoived agencies in Palm Beach
County are essential to the long-term sustainability of the LIX program. Project start-up costs have been largely
funded through UC grants, the Board of County Commissioners (ISS), and contributions from the Sheriff s Office.
However, funding responsibility for the annual operating casts associated with the LEX system is now solely the
responsibility of the member agencies based on the annual contributinn schedules approved by the LEX Executive
Committee in February 2008. A vote of the Committee this year again maintained the level of contribution
originally established.

Subject: FORFEITURE FUNDS FOR LEX DATA SHARING
I would request that the village council consider the use of forfeiture funds to support the
Palm beach County Law Enforcement Exchange (LEX) program so we may continue as a
member of this valuable program. LEX has established a membership cost based on the
size of the agency. Tequesta is considered a Category 1, which is an agency with 1-19
officers. The membership fee is one thousand dollars ($1,000).
The Florida Contraband Forfeiture Act allows agencies to use funds collected under the
Act as supplemental funding for authorized purposes; providing the expenditure will not
be used for the normal operating needs of the law enforcement agency. The funds can be
used for crime prevention, safe nei�hborhoods, dru� abuse education, or dru� prevention
pro�rams or such other law enforcement purposes which include defravin� costs of prot�acted
or complex investi�ations, providin� additional equipment or expertise...F.S.S. 932.7055(5)a.
The Palm Beach County Law Enforcement Exchange (LEX) is a data sharing initiative that allows
agencies to electronically search various agency records management system to find key
information on an activity (burglaries), a person (suspect or victim), property (stolen items), or
a vehicle.
Through the use of LEX an officer can see crimes trends in adjacent communities and county-
wide; thereby, allowing the agency to determine if crime prevention education is needed or a
specific area needs extra patrols to deter possible crimes. Lex is a very powerful search tool that
can be used in any investigation to determine a suspect list, look for property or persons, or
simply narrowing the investigation.
LEX operates as a 501(c)3 organization comprised of Palm Beach County Chiefs of Police and
the sheriff of Palm Beach County. I have attached a letter that briefly describes LEX and how it
operates for the expenditure or forfeiture funds.

prevent the continued use of contraband for criminal purposes as well as authorizi.ng agencies to

In accordance with F.S.S. 932.7055 of the Florida Cantraband Forfeiture Act, we are soliciting
municipal funding for crime prevention purposes to support a technolo�y enabled law
enforcement data sharing system �nown as Palm Beach County Law Enforcement Exchange, Inc.

The LEX system is used far enhancing the safety, security and efficiency for law enforcement
personnel. For the first time officers c�m electronically search various agency records
management systems to find key inforn�ation on an activity, a person, progeriy or vehicles. This
is done with a sin�le sign-0n to both local data sources, aud various state and federal systenas
such as DHSNN, FCIC, NCIC, CCIS and the Departme.nt af Cc►rrections. LEX will also serve as
an integral component for emergency response situations in Palm Beach County.
We are requesting appmpriation of Florida Contraband Forfeiture Funds in accordance with FSS
932.7055 ES)( c). Palm Beach County I,EX, Inc. certifies that funds grovided will be u�d only
for the purposes of fiuthering law enforcement informarion sharing. activities, that include the
following activities in the 2�10 fiscal year:

432.7055 Disposition of liens and farfeited property.--
(1) When a seizing agency obtafns a finaF judgment grantin� forfeiture of real property or personal property, it may
elett tn:
f a� Retain the property for the agenc�s �e,
(b) Selt ihe property at pub[ic auctian or by seaied bid to the highest bidder, except for real property which shoutd be
sold in a commere9alty reasonable manner after appraisal by tisting on the market; or
(c) Satvage, trade, or trans€er the property to any public or nonprofit organizatfon.
(2} Notwithstanding subsection (1), a seizing agency m�t destroy any image a�c! the medium on which the image is
recorded, including, but not limited to, a photograph, video tape, diskette, compact disc, or fixed disk made in
viotation of s. �10.145 when the image and the medium on which it is recor�d is ne longer needeci for an official
purpose. The agency may not sell or retain any image.
(3) If the forfeited property is subject to a[ien preserved by the court as providec! fn s. 932.703(6)(b), the agency
shalE:
(a) Sell the property with the proceeds being used tawards satisfaction of any liens; or
(b) Have the tien satisfied prior to taking any action authorized by subsection (7 t.
(4) The proceeds from the sate of forfeited property shall be disbursed in the fol[owirrg priority:
(a) Payment of the balance due on any tien preserved by tl� court in tFie forfeiture proceedings.
(b} Payment of the cost incurred by the seiz9ng agency in connection with the storage, maintenance, security, and
forfeiture of such property.
{c) Payment of court casts incurred in the forfeiture proceeding.
�(d) Notwithstanding any other provision af this subsection, and for the 20(�-2410 fiscal year onty, the funds in a
speciat !aw enforcement trust fund estabtished by the governing body of a municipality may be expended to reimburse

(c) The Division of Alcohotic Beverages and Tobacco, the procee� accrued pursuant to the Flor�da Contraband
Forfeiture Act shall be deposited into the Alcohotic Beverage and Tubacco Trust Fund or into #he department's Federal
Law Enforcement Trust Fund as provided in s, 561.027, as appkicabte.
(d} The Department of Highway Safety and Motor Vehicles, the proceeds accrued pursuant to the Ftorida Contraband
Forfeiture Rct shall be �posited into the Department of Highway Safety and Mator Vehides Law Enfarcement Trust
Fund as provided in s. 93Z.705(1)(a) or inta the c�partment's Federa! Law Enforcement 7rust Fund as provided in s.
932.705(1y(b}, as applitable.
(e) The Fish and Wild[ife Conservation Commission, the proceeds accrued pursuant to the provisions of the Ftorida
Contraband Forfeiture Act shall be deposited inta the State Game Trust Fund as provided in ss. 379•338• 379.339, and
374.3395 or 9nto the Marine Resources Con�rvation Trust Fund as provic�ed in s. 3T9.337.
(f) A state attorney's office acting within its judiciai circuit, the proceeds accrued pur�uant to the provisions of the
Ftorida Contraband Forfeiture Act shall be deposited into the State Attomey's Forfeiture and Irnrestigative Support
Trust Fund to be used for the investistaLion of crime and prosecution of criminais withirt the judiciat circuit.
(g) A schoot board security agency employing law enforcement officers, the proceeds atcrued pursuaRt to the
provisions of the Ftorida Contraband Forfeiture Ad shall be depasited into the Schoof Board !aw Enforcement 7rust
Fi�nd.
(h) One of the State University System potice departments acting within the jurisdiction of its employing state
university, the proceeds accrued pursuant to the provisions of the Florida Contraband Forfeiture Act shatl be deposited
into that state univer�ity's special law ertforcement trust fund.
(i) The Department of Agriculture a�d Corrsumer Services, the proceeds accrued pursuant to the provisions af the
Ftorida Contraband Forfeiture Act shai[ be deposited into the Agricultura! Laav Enfarcement Trust Fund or into the
department's Federai Law Enforcement Trust Fund as provided in s. 570.205, as appticabie.
(j} TFre Department of Military Affairs, the procee� accrued from federal forfeiture sharing pursuant to 21 U.S.C. ss.
881(e)(1)(A► and (3y, 18 U.S.C. s. 981(e)(2), and 19 U.S.�. s. 1616a shal( be deposited into the Amrory Board Trust
Fund and used for purposes authorized by such federat provisions based on the �partment's budgetary authority or
into the department's Federal Law Enfarcement Trust Fund as provided in s. 250.175, as applicabke.

arson suppression, arson investigation, and the funding of anti-arson rewards.

(B) Upon the sate af any motor veh#cEe, vesset, aircraft, reat praperty, or other property �eguiring a t9tte, the
appropriate age►scy shatt issue a trtle certifieate to the purchaser. Upon the request af arty 1aw enforceme�t agency
which eteets to retain titled property af[er forfeiture, the appropriate state agency shatt issue a titte certificate for
such property to said law enforcement agency.
(9) Neither the taw enforcement agency nor the entity having budgetary controt over the law enforcement agency
shalt anticipate future forfeitures or proceeds therefrom in the adoption and approval of the budget for the law
enforcement agency.
