GMH Tequesta Holdings LLC 3. BACKGROUND On August 11, 2011, GMH Tequesta Holdings, LLC was granted a site plan approval to utilize an existing 118,716 square feet three-story building and adjacent grounds as a Rehabilitation Facility. The application included a proposed landscape plan, and one (1) monument sign. The subject site plan modification was reviewed by the Development Review Committee (DRC) on Apri118, 2012. 1. STAFF ANALYSIS The proposed application does not increase the square footage of approved Rehabilitation Facility (75 units); and the number of existing parking spaces (147 spaces). The subject site plan modification includes the following changes: 1. Removal of two existing walks located along the east and west side of the clubhouse. 2. Addition of a pedestrian ADA gate at the main entrance. 3. Replacement of concrete pavement beneath building main entrance overhang to brick pavers. 4. Relocation of handicap parking closer to building entrance. 5. Removing and changing site lighting on the north, west and east areas (rear and side yards) (See attached Police Chief, Pete Pitocchelli, review letter). 6. Addition of fences and access gate on courtyard to provide access from four existing ground floor units located along the east side to pool/spa/pond areas per Florida Department of Health. Also, addition of walkways at the courtyard. 7. Removed koi pond equipment enclosure from the courtyard. 8. Change tennis court fence height from consistent 6 feet height all around to varying from 3 to 6 feet. 9. Landscape modification includes changes in planting and location that were reviewed by Village's landscaping consultant, Mr. Steve Parker, ASLA, (See attached review letter). 10. Changing building accent colors. Apalicant needs to provide proposed color sample. 11. Relocation of generator to the northeast corner of building behind dumpster walls. 12. Reducing generator capacity from 1,500 KW to 100 KW. The Village's Code Section 78-1.80 (16) (i) states "The rehabilitation facility shall include a backup generator system. The system shall be sized for the building occupancy load and have a fuel source sufficient to operate the facility for a minimum of seven days". Please see following analysis: - Village Staff requested electrical engineering letter justifying reducing generator size from 1,500 KW to 100 KW; and defining areas that will have full power capacity with the proposed generator including lighting, fans and air conditioning (See attached letter and follow up e-mail). - Since applicant indicated "Facility is no intended to be occupied under power outages for extended periods of time. The proposed plan is to move the occupants to the lobby areas. Determine the extent of the event while providing for the occupants as they await transportation ; Village Staff requested documentation that describes protocol for the „ evacuation of the building in case of power outage (See attached Hurricane Planning Guide). - The proposed evacuation plan also needs to state that the areas served by the 100 KW generator can house the building occupancy ioad untif evacuation time. The plan also needs to define means of transportation ensuring that it will not burden the Village's EMS system. - The proposed evacuation plan needs to focus on power outages due to different reasons. - In case of hurricanes, the proposed evacuation plan needs to include that this facility is located in a Plan B evacuation area, and it should evacuate for all major Hurricanes of category 3 or higher in strength (per Palm Beach County evacuation provision). 2 Department of Community Development -Staff Report— P&ZAB Public Hearing 5.17.12. Signage The applicant requested to the Village Council a waiver to allow the existing monument sign located toward Old Dixie Highway to remain. The waiver was approved, and included the use of both sides of the existing monument sign, and an exposed area of 18 square feet per each side. FINAL REMARKS • This development application met the requirements set on Section 78-334 notice of hearing. The notice of hearing was advertised on May 7, 2012. • The following items need to be addressed by the applicant: - The proposed evacuation plan needs to state that the areas served by the 100 KW generator can house the building occupancy load until evacuation time. - The plan needs to define means of transportation ensuring that it will not burden the Village's EMS system. - The proposed evacuation plan needs to focus on power outages due to different reasons. - In case of hurricanes, the proposed evacuation plan needs to include that this facility is located in a Plan B evacuation area, and it should ate for all major Hurricanes of category 3 or higher in strength (per Pal eac oun evacuation provision). I have no issue with the proposed changes to the lighting for the East and South sides of the property. I understand the Developers concern for the surrounding communities and the extent of lighting that was proposed and its effect on them. i would make the following recommendations. The 25 foot' light po�es on the west side along Dixie Hwy should remain, as should the one located on the North side of the building. I also recommend that the property located to the North of the Recreation area have at least 2-25 ft light poles. This area is not lighted and is extremely dark at night; without any lighting it becomes an area of opportunity. This lighting would enhance the ability of Officers driving by the compound to see if anyone was walking around the property. Below please find our responses to the Department of Community Development DRC comments received April 20, 2012, for the above referenced project: Communitx Development Comment 1: Provide engineering calculations to justify reducing generator size from 1,500 , KW to 100 KW. The proposed generator shall be sized for the building occupancy load. The Village's Code Section 78-180 (16) (i} states "The rehabilitation facility shall include a backup generator system. The system shall be sized for the building occupancy load and have a fuel source sufficient to operate the facility for a minimum of seven days." RESPONSE: Please see project electrical engineer's response, atfached. Comment 2: Clarify requirement from Florida Department of Health to provide fences and gates for four existing ground floor units located in the courtyard. Provide detail of proposed fence. RESPONSE: FA.C. Chapter 64E-9 tor Public Swim►ninq Pools sr�d Bathing Places, Section 64E-9.006(2)(h) states: "All public poo/s sha/l be surrounded by a minimum 48 inch high fence or other substantial barrier approved by fhe department. The fence shall be continuous around the perimeter ot the pool area that is not otherwise blocked or obstructed by adjacent buildings or strucfures and shall adjoin with itself or abut to the adjacent members. " The gates provided adjacent to the ground floor units were added to fhe p/ans to comply with this code section durinq permitting of the poo/ and spa with the Palm Beach County Health Department, the county authority delegated by the �lorida Department ot l�ealth to review and approve plans. A detail ot the proposed fence and gate is provided on Sheet C-5. Comment 3: With regard to landscaping, the Village adopted Ordinance No. 6-12 "Florida � Friendly Landscaping" at the April 12, 2012 Council hearing. Within five years. GMH will need to com�ly with new landscapina arovisions included in said Ordinance RESPONSE: GMH acknowledges the future landscape requirements for the site. Comment 4: The proposed landscape plan was reviewed by Steve Parker, ASLA, the Village's landscape architect consultant, and prepared the attached comments. RESPONSE: Please see below for responses to landscape comments. Comment 5: With regard to the proposed lighting plan, Chief of Police, Pete Pitocchelli presented the attached comments. RESPONSE: Please see be/ow for responses to lighfing comments. Comment 6: Confiirm that there are not modifications to the building structures in terms of architecture, color and/or materials. FiESP011iSE: The previously propo�ed accent colors have been revised to re�lace the darkest of the accent colors with the darkest of the main building colors. The chanqe was made for aesthetic reasons atter test-painting a portion of the building. This modification was brought to the attention ot the Village Council within the last thirty days, who commented on and had no issue with the color change. RESPONSE: Per the Village of Tequesta landscaping requirements as part of the previous site plan approval, the leve/ of p/antings around the perimeter were provided to completely screen the property from view of the public right-of-way. As such, additional lighting within the property would not facilitate any addifional surveillance by otficers driving by the compound. The requirements for little to no light spill along the property boundary would also limit the amount of available visibility. At this time, GMI°I would respectfully request no�tQhave.to provide the additional light poles at the north side ot the site, but is planning on reevaluating the Ilqhting in this area upon comp/etion of construction. Nonetheless, GMH understands the importance ot maintaininq a secure facility for residents and employees and as part of the special exception application to the Village, submitted a detailed security plan for the site. Included in the security plan is fwenty- four hour on-site security and twenty-four hour patient supervision by licensed nursing statf. GMH will a/so be implementing the following external security systems to enhance the safety and protection of the Center, Center staff, clients and Village residents; a perimeter fence, alarm systems, and, most notably, monitored and recorded twenty-tour hour video surveillance of the Center perimeter. Landscapinq Comment 1: Seven (7) Sabal Palms were eliminated at the new generator location. The applicant should ciarify the palm plantings in this area. R�SPONSE: The label for the (5) A/exander Palms indicated has been moved to identify the trees located just south ot the existing door. Comment 2: The plan needs to be updated to show the new pedestrian gate and irrigation well locations. The areas served are the common area corridors on the 1 2" and 3� floors. The elevators, main lobby area, kitchen, adjacent dining �� room and the ganged bathroom facilities are also powered under the generator. The areas served have full power capacity which includes lights receptacles, fans and air conditioning systems. The kitchen facility and all refrigeration is provided for under EM power. — In short the entire facilities, with the exception of residential suites and auxiliary spaces, have emergency power. Monitor Phase (1 June through 30 November-Hurricane Season) A. The duty manager should be required to tune into weather reports at least finrice daily; once in the morning and again in the evening. B. Plans must be prepared/reviewed to protect employees, families, guests and the facility. C. Make sure every guest receives a copy of the Hurricane Plan letter (Appendix A or B) at the front desk. D. Identify residential facility to evacuate guests 2. Warning Phase A. Upon issuance of a Hurricane Watch for Palm Beach County by the National Hurricane Center, your Hurricane Evacuation Plan should be activated. B. Staff who live in evacuation zones or mobife homes should be released for 4-6 hours to prepare their families and homes for the storm. C. All property guests will be advised of the watch by notice (Appendix C). D. Future reservafiions for the next 72 hours should be notified of the Watch. 3. Response Phase A. When an evacuation order is issued, all internal preparedness plans must be completed as soon as possible. B. All must be prepared to assist and support your guests in every way possible. 4. Recovery Phase A. As soon as the storm has passed, key staff will assemble to begin recovery operations and damage assessment. B. All staff must be prepared to assist with recovery efforts. SUGGESTED COMMAND CENTER ACTION CHECKLIST q. 72 - 48 Hours before forecasted hurricane landfall: 1. Initiate tracking the hurricane on the tracking map. 2. Review hurricane plan. 3. Department managers review individual responsibilities. 4. Review department staff responsibilities. 5. Check supplies and equipment. B. 48�24 Hours before forecasted hurricane landfall depending on storm strength: 1. Activate command center if local authorities are considering evacuation or a Hurricane Watch has been issued by the National Hurricane Center. 2. Call in Executive Committee or Emergency Coordinator and managers. 3. Initiate log of actions taken to implement hurricane plan. 4. Schedule for possible guest evacuation. 5. Schedule evacuation transportation if necessary. 6. Issue information flyers to all g�ests. 7. Prepare rooms, outside areas, windows and guest facilities to minimize possible injury and/or damage. 8. Notify incoming groups and guests with reservations of potential hurricane situation. 9. Prepare vital records and equipment for evacuation. 10. Establish record system to monitor guest departures. C. 24 Hours before forecasted hurricane landfall, a Hurricane Warning is issued, or the Governor or Board of County Commissioners orders evacuation: 1. Review alt actions taken to identify any shortfalls. 2. Insure that all guests are aware of the situation 3. Review responsibilities to insure all preparations have been made. 4. Secure excess baggage and equipment to higher floors of the facility. 5. Implement guest evacuation plan. 6. Secure facility. D. Tropical Storm Consideration: 1. If a tropical storm is foren� the Execut ve Commitee o Eme gency Coo dinator n or order has been given, a decides not to e��acaate, continue to operate interior restaurants and lounges. 2. Warn guests not to go outside, onto balconies and advise them to stay away from windows. 3. Consider organizing some recreational activity for those quests that stay so that they will not become distraught or wander outside the facility. SUGGESTED MANAGEMENT RESPONSIBILITIES 1. Identify resources needed to evacuate and protect the facility. 2. Arrange for transportation of guests and staff. 3. Establish a decision making mechanism to protect the guests, employees and property that considers the following factors: A. Severity of storm. B. Danger imposed (from flooding, winds, etc.). C. Date/time of greatest danger (example, if the storm is expected during nighttime, then more time may be needed far preparation). D. Number of guests in the facility. E. Condition of facility and equipment. F. Transportation available. G. Staff on call. H. Financial considerations I. Legal considerations. J. Communication with Emergency support available (police, fire, emergency medical). K. When to establish command center. L. Assignment of responsibilities for management and staff. 11A. Notification of guests. N. Storage and receiving of food, supplies and equipment for emergency use. O. Arrange for adequate transportation and shelter if evacuation is required P. Preparation of facility grounds and buildings. Q. Designated areas to be used if the decision is made to stay with the facility. R. Staff scheduling of 24-hour emergency operations. S. Housekeeping: Pull drapes in all guest rooms, place patio furniture in the guest rooms, place pool furniture in the pool, move lobby furniture to second floor (if feasible), fill bathtubs with water, assemble in one area all post storm cleanup equipment, assemble blankets and pillows for guest comfort if needed. 2. Develop games for guests if the decision is made not to evacuate, move electronics games to upper floors (if feasible), evacuate gift shop or sales items to an upper floor, assist Housekeeping in securing outside equipment. 4. Security: Post security at exits until guests leave. 5. Kitchen: Place all perishable food items in the cooler/freezer unit, plan menu for command center and post storm cleanup crew, obtain vehicle for food storage and transportation if necessary to move in evacuation. 6. Engineering: Secure facility, turn off water, gas and electricity as necessary, obtain additional fuel for portable generator(s), start and check portable generator(s) and electrical service at predetermined time. 7. Accounting: Print hard copies of all records and secure them, remove records to a secure upper floor or evacuate them to secure safe location, secure all cash and maintain a record of cash received, double wrap records in plastic if dry storage is not available. 8. Personnel Department: Secure employee personnel and guest files and either remove them to a secure upper floor or evacuate to a safe location, help with employee family needs where appropriate. Notify incoming groups and guests with reservations of hurricane status. SUGGESTED GUEST EVACUATION PROCEDURES 1. Notification: A. Notify all guests as soon as possible once the decision has been made to evacuate. B. Notify all guests via a flyer placed under each room door, announcements through the telephone, or other means (see attachment for suggested notice). C. Request guests notify their families on their evacuation (i.e. where they are going). D. Have information available (maps showing evacuation routes) at convenient location. E. Notify incoming guests by telephone not to come. 2. Evacuation: A. Guest with transportation: 1. Urge guest having vehicles to leave the facility with their baggage as soon as possible. 2. Have facility personnel assist in guest departure by advising what routes to use to leave the county or area. B. Guest without transportation: 1. Determine the number of guest requiring transportation. 2. Arrange for enough vehicles to evacuate guests. 3. If necessary, secure all excess baggage in secure area on upper floors. Give guests receipts. 4. Arrange for facility personnel to assist guests out of the facility and onto arranged transportation. 5. Note in writing where you are taking the guests. (i.e. airport, hotel etc.). RECOVERYISSUES A. The reentry policy for Palm Beach County into evacuation areas consists of the following phases: 1. Search and Rescue — Teams of emergency response, utility and public works Personnel will enter damaged areas to search for those who stayed behind. They will also be assessing utility damages and developing initial emergency access to evacuated areas. 2. Damage Assessment - Teams of people will enter the damaged area to determine the extent and magnitude of damages to homes, business and public facilities. They also will be determining how safe it is to return to evacuated area and what will have to be done to make dangerous areas safe for those living or working there. 3. Limited Reentry — Those people living or having business in damaged areas will be allowed to return once health and safety concerns are addressed. It is at this point where you can go back and determine the extent of your facility's damage. Efforts to repair or rebuild damaged facilities will also commence at this time. 4. Full Reentry — Once the damage has been repaired, those who do not live or work in the damaged area will be allowed to reenter. This would include tourists and seasonal visitors. B. Assume working conditions will be primitive. Electricity and telephone service may be out for a while and you may also lose water, sewer and road access. C. Establish procedures for notifying your staff on when you want for them to return to work. Consider that the telephone service may not be working. D. If necessary, establish a policy on layoffs in case your facility is damaged extensively and may be out of operation for an extended period of time. E. Establish who will conduct a damage assessment of your facility. F. Identify who will handle insurance claims. This includes notification of insurance companies. G. Establish procedures for repairing damaged facilities. Remember that selecting contractors for repair or restoration is your responsibility, not the insurance companies. An accurate damage assessment and the use of local contractors will help speed up the restoration of your property. H. Establish backup procedures for purchasing equipment and supplies needed to recover. If you use a computer for record keeping, think about a backup if the electrify is ou . Count on delays in procuring local equipment and building supplies. I. Establish criteria to determine when your facility can be reopened. The proposed generator shall be sized for the building occupancy load. The Village's Code Section 78-180 (16) (i) states "The rehabilitation facility shall include a backup generator system. The system shall be sized for the building occupancy load and have a fuel source sufficient to operate the facility for a minimum of seven days." RESPONSE: Please see project elecfrical engineer's response, attached, Comment 2: Clarify requirement from Florida Department of Health to provide fences and gates for four existing ground floor units located in the courtyard. Provide detail of proposed fence. RESPONSE: F.A.C. Chapter 64E-9 for Public Swimming Pools and Bathing Places, Section 64E-9.006(2)(h) states: "All public poo/s shall be surrounded by a minimum 48 inch high fence or other substantial barrier approved by fhe department, The fence shall be continuous around the perimeter of the pool area that is not otherwise blocked or obstructed by adjacent buildings or structures and shall adjoin with itself or abut to the adjacent members. This modification was brought to the attention of the Village Council within the last fhirty days, who commented on and had no issue with the co/or change. No additional modifications to the building architecture, co/or and/or materials have been made. 10003A. dre.com. resp.042612.jcf Police Department Comment 1: After review of proposed lighting changes to the plans for the GMH project I would like to make the foliowing recommendations. I have no issue with the proposed changes to the lighting for the East and South sides of the property. I understand the Developers concern for the surrounding communities and the extent of lighting that was proposed and its effect on them. I would like to make the following recommendations. The 25 foot light poles on the west side along Dixie Hwy should remain, as should the one located on the north side of the building. I also recommend that the property located to the North of the recreation are have at least 2-25 ft light poles. This area is not lighted and is extremely dark at night; without any lighting it becomes an area of opportunity. This lighting would enhance the ability of Officers driving by the compound to see if anyone was walking around the property. I feel these lighting recommendations create a more secure facility for residents and employees. RESPONSE: Per the Village of Tequesta landscaping requirements as part ot the previous site plan approval, the leve/ of plantings around the perimeter were provided to completely screen the property from view of fhe public right-of-way. As such, additional lighting within the property wou/d not facilitate any additional surveillance by otficers driving by the compound, The requirements for little to no light spill along the property boundary woufd also limit the amount ot available visibility. At this time, GMH wou/d respectfully request not to have to provide the additional light po/es at the north side ot the site, but is planning on reevaluating the lighting in this area upon comp/etion ot construction. Nonetheless, GMH understands the importance of maintaining a secure facility for residents and emp/oyees and as part of the special exception application to the Village, submitfed a detailed security plan for the site. lncluded in the security plan is iwenty- tour hour on-site security and twenty-tour hour patient supervision by licensed nursinq staff. GMH will also be implementing the tollowing external security systems to enhance the safety and protection of the Center, Center staff, clients and Village residents: a perimeter fence, alarm systems, and, most notably, monitored and recorded twenty-four hour video surveillance ot the Center perimeter. Landscaping Comment 1: Seven (7) Sabal Palms were eliminated at the new generator location. Per the label, Five (5) Alexander Palms are noted to be planted in this area, however, 10003A. d re. com . res p.042612.j cf they're not graphically shown. The applicant should clarify the palm plantings in this area. RESPONSE: The label for the (5) Alexander Palms indicated has been moved to identify the trees located just south of the existing door. Comment 2: The plan needs to be updated to show the new pedestrian gate and irrigation well locations. RESPONSE: The pedestrian gate and irrigation well locations have been added to fhe landscape plans. Comment 3: The majority of the landscape changes and reduction in plant material is on the interior of the site and will not be visible from off-site. RESPONSE: Applicanf concurs with this statement.
