Meeting Minutes
February 16, 2012
CALL TO ORDER AND ROLL CALL
The Village of Tequesta Planning and Zoning Advisory Board Sitting as the Local
Planning Agency held a regularly scheduled meeting at the Tequesta Village Hall, 345
Tequesta Drive, Tequesta, Florida, on Thursday, February 16, 2012. The meeting was
called to order at 6:05 p.m. A roll call was taken by Deanna Mayo, Assistant to the
Village Clerk, who noted the following were present: Chair James Hackett, Vice Chair
Michael Schmidt, Board Member Elizabeth Schauer, Board Member Steve Okun, and
Alternate Mitchell Miller. Also present were Acting Community Development Director
James Weinand, Village Attorney Keith Davis, and Assistant to the Village Clerk
Deanna Mayo. Board Member Eric Jotly and Alternate Edward Gigante were absent
from the meeting.
APPROVAL OF AGENDA
MOTION:
Vice Chair Okun moved to approve the agenda as amended to omit swearing in of
witnesses and ex parte communications. Board Member Schauer seconded the
motion. The vote on the mofion was as follows:
James Hackett - Yes
Michaei Schmidt - Yes
�lizabeth Schauer - Yes
Steve Okun - Yes
Mitchelt Miller - Yes
The motion therefore carried by unanimous 5-0 vote.
APPROVAL OF PREVIOUS MEETING MINUTES
MOT{ON:
Vice Chair Okun moved to approve the minutes of the November 3, 20� 1 meeting as
submitted. Board Member Schauer seconded the motion. The vote on the motion was
as follows:

OLD BUSINESS - None
NEW BUSINESS
Public Hearing to consider and make recommendations to the Village Council
with regard to the following:
1. ORDINANCE NO. 1-12
An Ordinance of the Village Council of the Village of Tequesta, Florida, providing
for the rezoning of certain real property within the corporate fimits of the Village
of Tequesta, Florida; which property consists of one point seven (1.7) acres, more
or less, of land recently acquired by the Village located at 479 Seabrook Road;
providing that this reaf property which is more specifically described herein shall
be re-zoned as "R/OP - Recreational/Open Space District; providing that the
Zoning Map of the Village of Tequesta be amended to reflect the proper
designation for this real property; providing a conflicts clause and a severability
clause; providing an effective date; and #or other purposes.
Board Member Schauer requested staff to find out who owned the stockade fence so
the Board could write to homeowners to improve their fences.
There were no comments from the public.
MOTION:
Vice Chair Okun moved to approve Ordinance No. 1-12 as submitted. Board Member
Schauer seconded the motion. The vote on the motion was as follows:

The motion therefore carried by unanimous 5-0 vote.
2. ORDINANCE NO. 2-12
An Ordinance of the Village Council of the Village of Tequesta, Florida, amending
the Village Code of Ordinances at Chapter 78, Zoning, Article I, In General,
Section 78-4. Definitions: By creating an entirely new definition for "Place of
Assembly", and Article VI, Schedule of District Regulations, Division 2, Schedule

of Use Regulations, by adopting regulations for assembly uses in each of the
Village's various Zoning Districts; and Article X, Off-Street and On-Street Parking
and Loading Regulations, Sec. 78-705. Required number of parking spaces, by
adopting parking regulations for assembly uses; and Article XI, Signs, Sec. 78-
740, General Restrictions; maximum size and number of signs by adopting sign
regulations for assembly uses in residential zones; providing that each and every
other section and subsection of Chapter 78, Zoning, shall remain in full force and
effect as previously adopted; providing a conflicts clause; a severability clause
and authority to codify, providing an effective date, and for other purposes
Acting Community Development Director Weinand advised this ordinance was designed
to eliminate legal problems and to make it uniform with the code. Village Attorney Davis
added this was motivated by a 2002 act of the Legislature which made the Tequesta
code in blatant violation of the law because churches were singled out. Attorney Davis
explained the sign code in regard to churches. Discussion ensued. Chair Hackett
suggested removing "place of worship" from the definition. Attorney Davis advised that
singling out a place of religion was the problem; which was not allowed. He explained
this code was modeled from the city of Palm Beach Gardens code, since they had had
an issue.
There were no comments from the public.
MOTION:
Vice Chair Okun moved to approve Ordinance No. 2-12 as submitted. Board Member
Schauer seconded the motion. The vote on the motion was as follows:

The motion therefore carried by unanimous 5-0 vote.

BOARD COMMENTS - None
ADJOURNMENT:
Upon motion by Board Member Okun; seconded by Vice Chair Schmidt, and
unanimously carried, the meeting was adjoumed at 6: 98 p.m.
