BACKGROUND On August 11, 2011, GMH Tequesta Holdings, LLC was granted a site plan approval to utilize an existing 118,716 square feet three-story building and adjacent grounds as a Rehabilitation Facility. The application included a proposed landscape plan, and one (1) monument sign. The subject Site Plan Modification was reviewed by the Development Review Committee (DRC) on April 18, 2012. 1 Department of Community Development - Staff Report —Village Council hearing 06.14.12.GMH Tequesta Holdings LLC. The application was heard by the Planning and Zoninq Advisory Board on May 17, 2012 and voted 5-0 to recommend approval of the Site Plan Modification application. 1. STAFF ANALYSIS The proposed application does not increase the square footage of approved Rehabilitation Facility (75 units); and the number of existing parking spaces (147 spaces). The subject site plan modification includes the following changes: 1. Removal of two existing walks located along the east and west side of the clubhouse. 2. Addition of a pedestrian ADA gate at the main entrance. 3. Replacement of concrete pavement beneath building main entrance overhang to brick pavers. 4. Relocation of handicap parking closer to building entrance. 5. Removing and changing site lighting on the north, west and east areas (rear and side yards) (See attached Police Chief, Pete Pitocchelli, review letter). 6. Addition of fences and access gate on courtyard to provide access from four existing ground floor units located along the east side to pool/spa/pond areas per Florida Department of Health. Also, addition of walkways at the courtyard. 7. Removed koi pond equipment enclosure from the courtyard. 8. Change tennis court fence height from consistent 6 feet height all around to varying from 3 to 6 feet. 9. Landscape modification includes changes in planting and location that were reviewed by Village's landscaping consultant, Mr. Steve Parker, ASLA, (See attached review letter). 10. Changing building accent colors (See attached photos and rendering provided by applicant). 11. Relocation of generator to the northeast corner of building behind dumpster walls. 12. Reducing generator capacity from 1,500 KW to 100 KW. The Village's Code Section 78-180 (16) (i) states "The rehabilitation facility shall include a backup generator system. The system shall be sized for the building occupancy load and have a fuel source sufficient to operate the facility for a minimum of seven days". Please see following analysis: - Village Staff requested electrical engineering letter justifying reducing generator size from 1,500 KW to 100 KW; and defining areas that will have futl power capacity with the proposed generator including lighting, fans and air conditioning (See attached letter and follow up e-mail). - Since applicant indicated "Facility is no intended to be occupied under power outages for extended periods of time. The propased plan is to move the occupants to the lobby areas. Determine the extent of the event while providing for the occupants as they await transportation'; Village Staff requested documentation that describes protocol for the evacuation of the building in case of power outage (See attached Hurricane Planning Guide). - The proposed evacuation plan also needs to state that the areas served by the 100 KW generator can house the building occupancy load until evacuation time. The plan also needs to define means of transportation ensuring that it will not'burden the Village's EMS system. - The proposed evacuation plan needs to focus on power outaqes due to different reasons. - In case of hurricanes, the proposed evacuation plan needs to include that this facility is located in a Plan B evacuation area, and it should evacuate for all major Hurricanes of category 3 or higher in strength (per Palm Beach County evacuation provision). The applicant responded to these set of comments on a detail letter dated May 23, 2012 (See attached letter). Please notice that the proposed generator is currently in place. At buildina aermit phase, the aanlicant nrovided a Site P/an in aareement with areviouslv aauroved Q/ans by Villaae Council lAuaust 11, 20121. The same set of building plans included electrical drawings with the 100 KW generator. The applicant letter also explains the reasons the 100 KW erator system is already installed; and, the building accent color was changed prior to the subject site plan odification approval. 2 Department of Community Development - Staff Report —Village Council hearing 06.14.12.GMH Tequesta Holdings LLC. I have no issue with the proposed changes to the lighting for the East and South sides of the property. I understand the Developers concern for the surrounding communities and the extent of lighting that was proposed and its effect on them. I would make the following recommendations. The 25 foot' light poles on the west side along Dixie Hwy should remain, as should the one located on the North side of the building. I also recommend that the property located to the North of the Recreation area have at least 2-25 ft light poles. This area is not lighted and is extremely dark at night; without any lighting it becomes an area of opportnity. This lighting would enhance the ability of Officers driving by the compound to see if a.nyone was walking around the property. I feel these lighting recommendations create a more secure facility for the residents and employees. The comments, and our responses, follow: Comment 1: The proposed evacuation plan needs to state that the areas served by the 100 KVV generator can house the building occupancy load until evacuation time. RESPONSE: As previously stated in our May 15, 2012 /efter, licensing and Commission on Accredita#ion of Rehabilitation Facilities (CARF) guidelines requre Futures to maintain an evacuation plan settinq forth resident treatment and housing in the event ot a natural disaster emerqency situation or extended loss of power, If a situation arises thaf wil! cawse the bullding's electrical power suppfy to be interrupted for a significant period, the operational plan is to relocafe program residents at Futures' expense to temporry housing located outside of the Village ot Tequesta. The transportation will be provided by Futures-owned vehicles or other hired means of transportation, if necessary. That being said, the Futures facility will be equipped with a qenerator system that can provide temporary power for up to seven days to essential facilities and utilities to ensure residents remain in a safe and healthy environment for up to 7 days during an emergency or power outage. The evacuafion plan is still in draft form at fhis time and will nof be tfnalized until Futures submits ifs final applicafion for CARF accredifation and Licensing. The plan will be modlfied to include the Village's comments. 10003A.village.council.sub.052312.jcf ! Comment 2: The plan needs to define means of transportation ensuring that it will not burden the Village's EMS system. RESPONSE: A modified evacuation plan incorporating a transportation plan tor resident relocation by vehicles owned or contracted by the faci/ity will be submTtted to fhe Village at the time of Future's application submittal to CARF. Comment 3: The proposed evacuation plan needs to focus on power outages due to different reasons. RESPONSE: The moditied evacuation plan will also be revised to provide procedures for extended power outaqes due to emergency and non- emergency situations. Comment 4: In case of hurricanes, the proposed evacuation plan needs to include that this facility is located in a Plan B evacuation area, and it should evacuate for all major Hurricanes of category 3 or higher in strength (per Palm . Beach County evacuation provision). RESPONSE. The modified evacuation plan wil! also be revised to include the Palm Beach County evacuafion area classification and evacuafion provision for the property. Comment 5: Explain the reason the generator is already installed and the building already painted. RESPONSE: The 700 KW generator system currently located at the property was approved as part ot the building permit issued for the project earlier this year. Long order lead times, which are typical for this fype of equipment, required that the generator be ordered several months ago. This was prior to the subject site plan modification submittal which has aftempted to reconcile the generator sysfem detailed in the electrica/ drawinqs approved during buildinq permit review and that shown on the site plan during the previous site plan approval process. The current bui/ding paint colors are consistent with the renderings approved as part of GNIH Tequesta's previous site plan approval, excluding one accent co/or. This accent color applied to the building and then later removed after application because of its ' appearance. Please note that fhe modification requested as part of this modification request is to remove the one building accent color from the previously approved color scheme. !t is not to add new 10003A.village.council.sub.052312.jcf colors or replace any of the colors previously approved by fhe Village. Give guests receipts. 4. Arrange for facility personnel to assist guests out of the facility and onto arranged transportation. 5. Note in writing where you are taking the guests. (i.e. airport, hotel etc.). RECOVERY ISSUES A. The reentry policy for Palm Beach County into evacuation areas consists of the following phases: 1. Search and Rescue — Teams of emergency response, utility and public works Personnel will enter damaged areas to search for those who stayed behind. They will also be assessing utility damages and developing initial emergency access to evacuated areas. 2. Damage Assessment - Teams of people will enter the damaged area to determine the extenf and magnitude of damages to homes, business and public facilities. They also will be determining how safe it is to return to evacuated area and what will have to be done to make dangerous areas safe for those living or working there. 3. Limited Reentry — Those people living or having business in damaged areas will be allowed to return once health and safery concerns are addressed. It is at this point where you can go back and determine the extent of your facility's damage. Effots to repair or rebuild damaged facilities will also commence at this time. 4. Full Reentry — Once the damage has been repaired, those who do not live or work in the damaged area will be allowed to reenter. This would include tourists and seasonal visitors. B. Assume workig conditions will be primitive. Electricity and telephone service may be out for a while and you may also lose water, sewer and road access. C. Establish procedures for notifying your staff on when you want for them to return to work. Consider that the teiephone service may not be working. D. If necessary, establish a policy on layoffs in case your facility is damaged extensively and may be out of operation for an extended period of time. E. The comments, and our responses, follow: • Comment 1: The proposed evacuation plan needs to state that the areas served by the 100 KW generator can house the building occupancy load until evacuation time. RfSPONSE: As previously stated in our May 15, 20i21etter, licensing and Commission on Accreditation of Rehabilitation Facilities (CARF) guidelines require Futures to maintain an evacuation plan setting torth resident treatment and housing in the event of a natura! disaster emergency situafion or extended loss of power. !f a si#uation arises thaf will cause the building's elecfrical power supply to be interrupted for a signiticant period, the operational plan is to re/ocate program residents at Futures' expense to temporary housing located oufside of the Village of Tequesta. The transportation will be provided by Futures-owned vehicles or other hired means of fransportation, if necessary. That being said, the Futures facility wilt be equipped with a generator system thaf can provide temporary power for up fo seven days to essential facilities and utilities to ensure residents remain in a safe and healthy environment for up to 7 days during an emergency or power outage. The evacuation plan is still in draft form at this time and will not be finalized until Futures submits its final application for CARF accredifation and Licensing. The plan will be modified to include the Village's comments. 10003A.vil lage.counci I.s ub.052312.jcf r Comment 2: The plan needs to define means of transportation ensuring that it will not burden the Village's EMS system. RESPONSE: A modified evacuation plan incorporatinq a transportation plan for resident re/ocation by vehicles owned or contracted by fhe facility will be submitted to fhe Village at the time of Future's applica#ion submittal to CARF. Comment 3: The proposed evacuation plan needs to focus on power outages due to different reasons. RESPONSE: The modified evacuation plan will also be revised to provide procedures for extended power outages due to emergency and non- emergency sifuations. Comment 4: In case of hurricanes, the proposed evacuation plan needs to include that this facility is located in a Plan B evacuation area, and it should evacuate for all major Hurricanes of category 3 or higher in strength (per Palm Beach County evacuation provisian). • RESPONSE: The rrodified evacua#ion plan will also be revised to include the Palm Beach County evacuation area classification and evacuation provision for the property. Comment 5: Explain the reason the generator is already installed and the building already painted. RESPONSE: The 100 KW generator system currently located at the property was approved as part of the building permit issued for the project earlier fhis year. Long order lead times, which are typical for this type of equipmgnt, required that the generator be ordered several months aqo. This was prior to the subject site plan modification submittal which has attempted ta reconcile the generator system detailed in the electrical drawings approved during building permit review and that shown on the site plan durinq the previous site plan approval process. The current building paint colors are consisfent with the renderings approved as part of GMH Tequesta's previous site plan approval, exc/uding one accent co/or. This accent co/or applied to the building and then later removed atter application because of its appearance. Please note that the modification requested as part ot this modification request is to remove the one building accent color • from the previously approved color scheme. It is not to add new 10003A.village.council.s ub.052312.jcf • colors or replace any of the colors previously approved by fhe Village. Should you have any questions, please do not hesitate to contact our office. Sincerely, •._ lC , anice Cabrera-Frias, E.I.T.
