CALL TO ORDER AND ROLL CALL The Village of Tequesta Board of Adjustment held a regularly scheduled Public Hearing at the Village Hall Council Chambers, 345 Tequesta Drive, Tequesta, Florida, on Monday, March 12, 2012. The meeting was called to order at 6:58 p.m. A roll call was taken by Deanna Mayo, Assistant to the Village Clerk. Present were: Chair Steve Pullon, Vice Chair Paul Brienza, Alternate Ward Bertholf, and Alternate Randy Kaye Garvey. Board Members Jon Newman, Vi Laamanen, and Bernard Ward were absent from the meeting. A1so in attendance were Acting Community Development Director James Weinand, Attorney Jennifer Gardner Ashton, and Assistant to the Village Clerk Deanna Mayo. II. APPROVAL OF AGENDA Board Member Bertholf moved to approve the agenda as submitted. Board Member Garvey seconded the motion. The vote on the motion was: Steve Pullon — for Paul Brienza - for Ward Bertholf - for Randy Kaye Garvey - for The motion was therefore passed by unanimous 4-0 vote. III. OLD BUSINESS IV. NEW BUSINESS Var. 2-12 Request for relief from Sec. 78-284 to allow the installation of a privacy fence forward of the building front, where the aode prohibits fences to be located forward of the adjacent or nearest portion of the building front. The applicant is'v�iiifiam B, Tayfor. The add�ess of th� prope�ty is �f'i Gewitt Pl�ce. The legal description of the property is Lots 1— 3, Noit Gedacht Subdivision. The property is located in Zoning District R-1A. Attorney Ashton read aloud Variance 2-12. A. Swearing-In of Witnesses Board of Adjustment Meeting Minutes March 12, 2012 Page 2 Assistant to the Viltage Clerk Deanna Mayo swore in Harvey Wise, Ernie Carrere, William Taylor, and William B. Taylor. B. Disclosure of Ex-Parte Communications Chair Pullon and Board Member Brienza each disclosed they had visited the site but had spoken to no one. Members Garvey and Bertholf each stated they had had no ex-parte communications.. C. Testimony of Witnesses and Cross Examination, if any William B. Taylor, owner of the property, requested a privacy fence for safety of his children along his property line next to an access strip of land to the water frequently used by neighboring residents and their pets. Public Comment Bill Taylor, 1 Bayview Court, neighbor, stated he had no objection to the fence, but felt the Areca hedge should remain on the east side of the fence. Ernie Carrere, 106 Go{fview, commented Mr. Taylor was the owner of the fence, and this was a unique circumstance which really would not be seen. The applicant advised several species of plants had been considered, and his landscaper had recommended Areca palms. Bill Taylor withdrew his objection. D. Finding of Fact Based Upon Competent Substantial Evidence MOTION Vice Chair Brienza moved to approve the request for a variance for the privacy fence on the property located at 11 Dewitt Place, Tequesta, Florida. Board Member Bertholf seconded the motion. The vote on the motion was: Steve Pullon — for Paul Brienza - for Ward Berthotf - for Randy Kaye Garvey - for The motion was therefore passed by unanimous 4-0 vote. ANY OTHER MATTERS Chair Pullon announced that Vi Laamanen and Bernard Ward would not be continuing on the Board. Acting Community Development Director Weinand advised an item would be placed on the April Village Council agenda to make Alternate Bertholf a regufar member of the board. VII. ADJOURNMENT Board Member Bertholf moved that the rneeting be adjourned at 7:29 p.m. Vice Chair Breinza seconded the motion.
