HomeMy WebLinkAboutMinutes_Board of Adjustment_03/12/2012 BOARD OF ADJUSTMENT PUBUC HEARING MEETING MINUTES MARCH 12, 2012 CALL TO ORDER AND ROLL CALL The Village of Tequesta Board of Adjustment held a regularly scheduled Public Hearing at the Village Ha{{ Council Chambers, 345 Tequesta Drive, Tequesta, Florida, on Monday, March 12, 2012. The meeting was called to order at 6:58 p.m. A roll call was taken by Deanna Mayo, Assistant to the Village Clerk. Present were: Chair Steve Pulion, Vice Chair Paul Brienza, Alternate Ward Bertholf, and Alternate Randy Kaye Garvey. Board Members Jon Newman, Vi Laamanen, and Bernard Ward were absent from the meeting. . Also in attendance were Acting Community Development Director James Weinand, Attorney Jennifer Gardner Ashton, and Assistant to the Village Clerk Deanna Mayo. APPROVAL OF AGENDA MOTION: Boarol Member Bertholf moved to approve the agenda as submitted. Board Member Garvey seconded the motion. The vote on the motion was: Steve Pullon — for Pau/ Brienza - for Ward Bertholf - for Randy Kaye Garvey - for The motion was therefor�e passed by unanimous 4-0 vote. �I. APPROVAL OF PREVIOUS IV�EETING MINUTES: June 20, 2011 MOTION: Board Member Brienza moved to approve the June 20, 2011 meetings. Board Member Bertholf seconded the motion. The vote on the motion was: Steve Pu/lon — for Paul Brienza - for Ward Bertholf - for Randy Kaye Garvey - for The motion was therefore passed by unanimous 4-0 vote. OLD BUSINESS None Board of Adjustment Meeting Minutes March 12, 2012 Page 2 NEW BUSINESS 2. VAR. 2-12 Request for relief from Sec. 78-284 to ailow the installation of a privacy fence forward of the building front, where the code prohibits fences to be located forward of the adjacent or nearest portion of the building front. The applicant is William B, Taylor. The address of the property is 11 Dewitt Place. The legai description of the property is Lots 1— 3, Noit Gedacht Subdivision. The property is located in Zoning District R-1A. Attorney Ashton re�d aloud Variance 2-12. Swearing-In of Witnesses Assistant to the Village Clerk Deanna Mayo swore in Harvey Wise, Ernie Carrere, William Taylor, and William B. Taylor. Disclosure of Ex-Parte Communications Chair Pullon and Board Member Brienza each disclosed they had visited the site but had spoken to no one. Members Garvey and Bertholf each stated they had had no ex-parte communications. William B. Taylor, owner of the property, requested a privacy fence for safety of his chifdren along his property line next to an access strip of land to the water frequently used by neighboring residents and their pets. Bill Taylor, 1 Bayview Court, and neighbor, stated he had no objection to the fience, but felt the Areca hedge should remain on the east side of the fence. Ernie Carrere, 106 Golfview, commented Mr. Taylor was the owner of the fence, and this was a unique circumstance which realfy would not be seen. The applicant advised several species of plants had been considered, and his landscaper had recommended Areca palms. Bill Taylor withdrew his objection. MOTION: Vice Chair Brienza moved to approve the request for a variance for the privacy fence on the property located at 91 Dewitt Place, Tequesta, Florida. Board Member Bertholf seconded the motion. Acting Community Development Director Weinand advised an item would be placed on the April Village Council agenda to make Alternate Bertholf a regular member of the board. ADJOURNMENT MOTION: Board Member Bertholf moved that the meeting be adjourned at 7:29 p.m. Vice Chair Breinza seconded the motion.
