Per F.S. 171.061, areas annexed into a municipality are subject to municipal taxes and debts immediately upon
the annexation being effective. The annexed property is not subject to municipal ad valorem taxes for the current year
if the effective date falls after the tax has been levied. Pursuant to this statute, and AG080-33 which applies it to a
similar annexation case as our current enclave annexation, property annexed into the Village is subject to municipal ad
valorem tax IF the effective date of the annexation is prior to the municipal levy of such tax.
For the purposes of this explanation, the levy of tax occurs when the Village Council sets the millage rate for
Village property (in September at the final budget hearing). Therefore, the property recently annexed would be subject
to municipal Village ad valorem tax for the 2012-2013 fiscal year.
That being said; however, it is my further understanding that although the Village can assess municipal ad
valorem tax upon the newly annexed property on County Line Road, pursuant to the process used by the property
appraiser and tax collector, it will not be until the 2013-2014 fiscal year tax bill that the properties actually get the bill
and have to pay.
There is no provision in the law that would allow the Village to receive a pro-rata share of county tax to cover
the provision of services that occurs between the effective date of the annexation and the assessment of municipal
taxes.
As it relates to solid waste collection, Sec. 171.062(4) provides that the franchisee holding an exclusive
collection service franchise in an unincorporated area may continue to provide service to property annexed into a
municipality for the duration of the franchise agreement, or S years, whichever is shorter, If a number the level of
service is at least equal to that provided within the municipality, and the rates are "reasonable." IF the franchisee and
the municipality cannot agree on cost, the statute requires arbitration. The municipality has the choice to allow the
franchisee to continue providing service pursuant to its existing franchise agreement; or if the franchisee refuses to
provide the required level of service within 90 days from the effective date of the annexation, the municipality may
terminate the franchise agreement as it relates to the annexed property. I have inserted below a copy of this statute
for your convenience and review.
Effects of annexations or contractions.— 171.062
An area annexed to a municipality shall be subject to all laws, ordinances, and regulations in force in that
municipality and shall be entitled to the same (1) privileges and benefits as other parts of that
municipality upon the effective date of the annexation.

If the area annexed was subject to a county land use plan and county zoning or subdivision regulations,
these regulations remain in full force and effect until (2) the municipality adopts a comprehensive plan
amendment that includes the annexed area.
An area excluded from a municipality shall no longer be subject to any laws, ordinances, or regulations in
force in the muni (3)cipality from which it was excluded and shall no longer be entitled to the privileges
and benefits accruing to the area within the municipal boundaries upon the effective date of the exclusion.
It shall be subject to all laws, ordinances, and regulations in force in that county.
A party that has an exclusive franchise which was in effect for at least 6 months prior to the initiation of
an annexation to provide solid waste collection (4)(a) services in an unincorporated area may continue to
provide such services to an annexed area for 5 years or the remainder of the franchise term, whichever is
shorter, if:
The franchisee provides, if the annexing municipality requires, a level of quality and frequency of service
which is equivalent to that required by the municipality 1. in other areas of the municipality not served
by the franchisee, and
The franchisee provides such service to the annexed area at a reasonable cost. The cost must include the
following as related to providing services to the annexed 2. area:
Capital costs for land, structures, vehicles, equipment, and other items used for solid waste management;
a.
Operating and maintenance costs for solid waste management; b.
Costs to comply with applicable statutes, rules, permit conditions, and insurance requirements; c.
Disposal costs; and d.
A reasonable profit. e.
If the municipality and the franchisee cannot enter into an agreement as to such cost, they shall submit the matter of
cost to arbitration.
A municipality, at its option, may allow the franchisee to continue providing services pursuant to the
existing franchise agreement. (b)
A municipality may terminate any franchise if the franchisee does not agree to comply with the
requirements of paragraph (a) within 90 days after the effective (c) date of the proposed annexation.
A party that has a contract that was in effect for at least 6 months prior to the initiation of an annexation
to provide solid waste collection services in (5) an unincorporated area may continue to provide such
services to an annexed area for 5 years or the remainder of the contract term, whichever is shorter.
Within a reasonable time following a written request to do so, the party shall provide the annexing
municipality with a copy of the pertinent portion of the contract or other written evidence showing the
duration of the contract, excluding any automatic renewals or so-called '�evergreen" provisions. This
subsection does not apply to contracts to provide solid waste collection services to single-family residential
properties in those enclaves described in s. 171.046.

I. Timeline Up-to-Date
The Village of Tequesta started an Annexation Strategic Plan (ASPA) in January 2011. The following
phases were part of the process up-to-date:
•Phase 1- Annexation Report - Includes 10 potential annexation areas - Report
submitted on April 14, 2011.

• The above timeline indicates that up to this point Council approach was to proceed with specific areas
one at a time. Currently, all efforts are focused on Area C(Nicole Circle and Colette Drive) and Area J
(5 parcels on County Line Road).
To further expedite annexation efforts, Council would need to direct staff to start the process with
other target areas. Please see attached map including all 10 potential annexation areas; and, a
summary table of taxable values and ad valorem taxes per Village miilage rate (Phase 1 report). Staff
can also provide a prioritization of potential annexation areas based on an in-depth analysis of (1)
existing conditions, (2) required Level of Services; and, (3) a cost/benefit projection of each area.

with a summary of benefits of joining the Vitlage, and comparison tabfe of taxes and fees that apply
to their properties (see attached information�.

Per Chapter 171 F. S., each strategy has a different process and timeline as follows:
Ae !lOLUNTARY AfVNEXAT'ION PROCESS
� The owners of real property in an unincorporated area, which is contiguous to a municipality

� Upon determination by the Village that the petition bears the signatures of all owners of
property in the area proposed to be annexed, the Village may, at any regular meeting, adopt a
nonemergency ordinance to annex said properties and redefine the boundary lines of the
� Village to include said properties. Said ordinance shall be passed after notice of the annexation
has been published at least once each week for two (2) consecutive weeks.

• • The ordinance must include a map which clearly shows the annexed area and a complete legal
description of that area by metes and bounds. Land shall not be annexed through voluntary
annexation when such annexation results in the creation of enclaves.
• The notice shall give the ordinance number and a brief, general description of the area
proposed to be annexed. The description shall include a map clearly showing the area and a
statement of the complete legal description by metes and bounds.
• Not fewer than 10 days prior to publishing or posting the ordinance notice, the Village must
provide a copy of the notice, via certified mail, to the Palm Beach County Board of the County
Commissioners.
• An ordinance adopted under this section shall be filed with the clerk of the circuit court and
the chief administrative officer of the county in which the municipality is located and with the
Department of State within seven (7) days after the adoption of such ordinance.
B. REFERENDUM/INVOLUNTARY
• Involuntary annexations occur when a municipality seeks to annex an area by passing an
• ordinance that schedules a referendum, or obtains consent from more than 50 percent of the
property owners on land covering more than 50 percent of the total land area (in areas where
there are no registered electors).
• Prior to initiating an involuntary annexation, a municipality must file an urban services report
with the Board of County Commissioners. The report is required to contain plans for providing
urban services as weil as setting forth the mPthod of financing improvements.
• Prior to th� adoption of the ordinance of annexation, the munic�pality shall hold at least two
advertised public hearings. Prior to the ordinance of annexation becoming effective, a
referendum on annexation shall be held, and, if approved by the referendum, the ordinance
shall become effective 10 days after the referendum or as otherwise provided in the
ordinance, but no more than one (1) year following the date of the referendum.
• The referendum on annexation shall be called and conducted and the expense paid by the
governing body of the annexing municipality.
• The referendum on annexation shall be held at the next regularly scheduled election following
the final adoption of the ordinance of annexation or at a special election called for the specific
purpose. The referendum shall not be sooner than 30 days following the final adoption of the
• ordinance.

• FINAL REMARKS
