3. BACKGROUND
On November 10, 2011, the Village Council approved a site plan including an outdoor deck of 500 Sq.
Ft. located on an existing open landscaped area, retractable owning, bollards on the pedestrian
walkway within the parking lot, and landscaping on the deck perimeter. The Village Council granted a
waiver of 0.20 percent of open landscaped area as part of the Special Exception Use approval for the
outdoor deck expansion (October 13, 2011).
On April 12, 2012, a temporary Certificate of Occupancy was approved by the Village Council (see
attached minute notes). On May 4, 2012, the Village issued a Temporary Certificate of Occupancy to
allow the use of the outdoor deck (see attached document). The CO was conditioned to the approval
of a Site Plan Modification.
On July 16, 2012, the applicant filled for a Site Plan Modification application which includes the
following changes:
- Removal of a previously existing coconut palm; and update plan to reflect installed
landscape.
- Remove of approved awning.
- As built modification of the deck by 10 Sq. Ft. to include area occupied by the presently
removed coconut palm tree. Total proposed deck area is 510 Sq. Ft.
- Increase open space waiver from 0.20 to OZ1 to reflect current as-built deck (without the
coconut palm tree area).

• Pursuant to Section 78-394. Nonconforming Areas, the subject property was granted previous
waivers by Village Council. Even though the Village Code requires the minimum percentage of
landscaped open space to be 25 percent in the C-2 district, existing open {andscaped area is 6.62
percent because of previous approved waivers.

• This development application met the requirements set on Section 78-334 notice of hearing. The
notice of hearing will be advertised in the Jupiter Courier on August 5, 2012.

The meeting was called to order by Mayor Tom Paterno at 6:33 p.m. A roll call was
taken by Clerk Lori McWilliams. Present were: Mayor Tom Patemo, Uce Mayor Arena,

COMMUNICA7'IONS FROM CITIZENS
Harold Taylor, 13 Chapel Court, suggested a standard be developed to address the
appearance of residential landscaping. He noted repercussions experienced on his yard
from neglect of his neighbors yard. Attorney Davis assured that new language would be
addressed for residentia! landscaping and its proper upkeep.
Jim Hill, Corner Caf� 289 US1, discussed the open dedc at the restaurant, �elt the tree
was more of a hazard, and therefore made quick decisions. Attomey �avis exptained
that this item was approv� with conditions and any changes would require Council
approval. Manager Couzzo suggested changes in attempt to rectify the applicant's
mistake.
Consensus of Council agreed to allow the temporary conditional certficate
of occupancy and advised the ��plicar�t they w�re required to retum to
Council for approvai of the changes made.
Jane Pike, int�oduced herseff as a Repubiican Party Municip�! Gaucus System member
and noted she and Calvin Tumquest would keep track of happenings within the Village.
COMMUNICATIONS FROM COUNCIL
Council Member D'Ambra suggested the Easter Egg Hunt be open only to Tequesta
�esidents ci�e to the high number ofi a�endees and then �pen the mavie tu ar�yana wf�a
wished to attend.
Council Member Okun noted he would provide an update status on his branding
program efiorts.

At the direction of Staff, this.request is.to amend the approved site plan in-order to reflecX the as-
built conditibns on the. site. The existing shoppmg center comprises app�o�inately 5.55 acres and is
, located' at 281 US High�xray 1(southeast corner of US-1 and Waterway Road.)

�'�e Village Square Shopping Center was originally ,constructed in 1957. Addirional square footage
was added to t�ie pIaza in 1960, again in 1980, and _ more recendy irt 201�. The Village C.ouncil in
2010 approved a small expansion for West• Marine The request was to add only 3,574 SF to the rear
� of the e�sting center for inventory storage _space. In 2008, an application was submitted to repaint .
the building. At that time the Village Staff requested'some addirional Iandscape improvements to be '
within the site. Three addirional landscape islands were constructed within the paYking area per the
� Staff's direction. � � '
On Marc�h 6, 1997 tlie Village,C.ouncil grarited mulriple waiver requests consistent with sectior�s 78-
394(b) and 78 (identified as Ordinances No. 355 Section VII F.1x and No. 377(H}(2)(C)1, 3, 10,
and 11, on. Codeur Hearing Landscape Plan dated 12/12/96) which• permits relief to the Village's: '
'Parking and Landscape Requirements. Sections 78-394(b) and 78-645 encourage waivers for e�sting-
development that would otherwise be negatively impacted.by havii3g to �;neet' current parking and ,
landscape regulations. ' `
On November 10, 2012, the Village Councii approved the site plan. � for the outdoor seating area
which included a 500 SF deck, and a_.20 open space waiver. Again as proposed we are rec�uest
r� of that approval to reflect the as-built eonditions of the deck and landscaping.
