• Informational Workshop was conducted on August 13, 2012 at 6:00 pm .

The public workshop with property owners was an o�portunity to showcase the advantages of joining the
Village. It was a PR event that included a power point presentation, and a session of q&A where Council
members and Village staff answered questions and clarify expectations. In preparation of the workshop,
invitation letters were mailed to residents and HOA representatives with a summary of benefits of joining the
Village, and comparison table of taxes and fees that apply to their properties.
Summary of Annexation Workshop and Follow-Up
■ 13 residents of Nicole Circle attended the workshop.
■ Feedback Form results: 11 residents are in favor, 2 residents need more information.
■ Thank you letters were mailed to residents that attended the workshop (See attached letter).
■ After the workshop, information package was mailed to all residents that did not attend the workshop
along with the Feedback Form and a self addressed and stamped envelope.
■ CD is still in the process of receiving the Feedback Form from the residents.
■ Staff requested to the Supervisor of Election the number of registered voters in Area C which includes
the following subdivisions:
- Riverside Pines (Nicole Circle and Colette Drive�- 82 registered voters
- Riverside on the Loxahatchee — 20 registered voters
- River Pines and Unplatted Area —35 registered voters

■ Area C has a total of 137 registered voters. In order for a referendum to be successful, 51% of
registered voters would need to be in favor of annexing into the Village.
■ Up-to-date feedback from Riverside Pines indicates 21 reaistered voters in Favor, 9 reaistered voters
Opaosed, and 3 reqistered voters Need More Information (See attached table and mapJ.
FINAL REMARKS
■ Staff recommends to conduct an Informational Annexation Workshop with residents of River Pines
and Unplatted Area to listen their position toward annexation.
■ Staff will continue to receive the Feedback Form and reach out to residents of Riverside Pines.
4 COMMERCIAL PARCELS ON US HWY 1
As part of Area G there are 4 commercial parcels located on US Hwy 1 that are part of unincorporated Palm
Beach County. Staff has contacted to property owners, please see attached map and following summary:
■ PARCEL 1- 19600 US Hwy 1— Owner: Longenecker Samuel Trust (Leased to Budget Rental Cars and
Trucks). Property owner si�ned a voluntary annexation form on August 28, 2012 (See attached form).
■ PARCEL 2- 19590 US Hwy 1— Owner: Judith and Viktor Bardischewski (Judy's Hwy Cafe). Staff met with
owner to provide information, and explain benefits of joining the Village. Owner is considering
annexation, and is concerned with code enforcement, and hours of operation of his restaurant.
■ PARCEL 3- 19578 US Hwy 1— Owner: Bozzuto Capital (Leased to Budget Rental Cars and Trucks).
Property owner si�ned a voluntary annexation form on August 28, 2012 (See attached form and letter).
■ PARCEL 4— 19510 US Hwy 1— Owner: Mathew Vickery, (Realtor). Staff will meet with owner to
provide information, and explain benefits of joining the Village on September 5, 2012.
Chapter 171, Florida Statutes clarifies that "Involuntary annexations occur when a municipality seeks to annex
an area by passing an ordinance that schedules a referendum, or obtains consent from more than 50 percent of
the propertv owners on land coverin� more than 50 percent of the total land area (in areas whe� 2 there are no
registered electors)."
Since parcels 1, 2 and 3 are adjacent to each other, and there are no registered electors (they are commercial
properties); and, the Village has the consent from more than 50 percent of property owners on land covering
more than 50 percent of the total parcel area; then, Parcel 2 can be annexed throu�h an involuntary
annexation process. Prior to initiating an involuntary annexation, the Village must file an urban services report
with the eoard of County Commissioners. The report is required to contain plans for providing urban services as
well as setting forth the method of financing necessary improvements. The adoption of the ordinance of
annexation, requires two advertised public hearings.
FINAL REMARKS
■ Staff will continue meeting with property owners and learn about their interest to join the Village
voluntarily.
■ With regard to code enforcement, Mr. 1oe Petrick, Village Code Enforcement officer provided a
preliminary review of the subject 4 parcels (See attached document). Staff would need direction from
Village Council regarding extent and timeline of code compliance.

Village staff started process to amend the comprehensive plan Future Land Use map and the Zoning
map. The proposed amendments were heard by the LPA at the August meeting, and they will be
heard by Village Council at the September meeting (First Reading). The adoption hearing (Second
ReadingJ is scheduled for the October Village Council meering.

Re: INFORMATIONAL ANNEXATION WORKSHOP
Dear Homeowner:
Village Council and staff want to extend our sincere gratitude for taking the time to attend the
Informational Annexation Workshop on Monday, August 13, 2012. We started an open dialogue
with all the residents that attended the meeting. Our goal was to listen and understand your
concerns, and to provide answers to your comments and questions.
At the meeting, the Village provided a package with information about services that are offered to
our residents such as 24/7 neighborhood patrolling, 3-Minute response time for police service, and
fire protection without paying the County MSTU fee.
We are still making a sincere effort to reach residents from Colette Drive and Nicole Circle that
were unable to attend the Informational Meeting. We mailed the feedback form with a self
addressed and stamped envelope; and we are beginning to receive the forms back. As soon as we
receive most of the feedback forms, we will reach out to all of you regarding our next steps.
We would like to conrinue with this open communication through out this process, and welcome
questions by phone, e-mail or by meeting with us ar our office in the Village Hall. My e-mail is

Dear Mr. Bozzuto,
The Village of Tequesta is pleased to learn that you are interested in voluntarily annexing into the Village two (2)
commercial parcels located on US Highway 1. Per your request, I am providing you information that applies to both
parcels in terms of zoning and uses. I understand that both properties are currently leased to Budget Rental (forcars
and trucks), and once you annex into the Village you would like to continue this operation.
The Village's definition of "Motor Vehicle Dealer" includes the following language: "The sale or rental of used motor
vehicles as the principal primary purpose or function for which any building, land area or premises is utilized is
prohibited." The definition requires that a dealer possess a state DMV issued "franchised motor vehicle dealer
license". Therefore, unless each rental is of a brand new car, this is not a permitted use.
Also, both parcels will be assigned C-2 zoning district, and Section 78-177- (d) (13) (a) refers to "Size shall be
regulated with a minimum of two acres and a maximum of eight acres". Total acres for both parcel is only 0.4408
acres, the parcels do not meet the size requirement of a two (2) acres minimum. Per your request, please see
attached permitted and special exception uses in the C-2 zoning district.
Once you annexed into the Village, both parcels would be a non-conforming use and a non-conforming use of land.
You can continue the use of both parcels as Auto sales oi/and leasinq for autos and trucks operation and there could
be no structural alterations to any buildinq except those required by law (Sec. 78-94). Further, if the use was ever
discontinued for 90 days, it could not revert back, but instead would have to convert to a conforming use (regardless
of any lease agreement that may exist between the owner and the tenant).
