Staff has contacted to property owners, please see following summary: ■ PARCEL 1- 19600 US Hwy 1— Owner: Longenecker Samuel Trust (Leased to Budget Rental Cars and Trucks). Propertv owner si�ned a voluntary annexation form on August 28, 2012 . ■ PARCEL 2- 19590 US Hwy 1— Owner: Judith and Viktor Bardischewski (Judy's Hwy Cafe). Staff met with owner to provide information, and explain benefits of joining the Village. Owner decided not to annex to the Village. Staff initiated involuntary annexation process in compliance Florida Statutes provisions. ■ PARCEL 3- 19578 US Hwy 1— Owner: Bozzuto Capital (Leased to Budget Rental Cars and Trucks). Propertv owner signed a voluntary annexation form on August 28, 2012. ■ PARCEL 4— 19510 US Hwy 1— Owner: Mathew Vickery, (Realtor). Staff explained benefits of joining the Village on September 5, 2012. At this point, the Owner has not decided to annex or not with the Village. Chapter 171, Florida Statutes clarifies that "Involuntary annexations occur when a municipality seeks to annex an area by passing an ordinance that schedules a referendum, or obtains consent from more than 50 percent of the property owners on land coverin� more than 50 percent of the total land area (in areas where there are no registered electors)." Since parcels 1, 2 and 3 are adjacent to each other, and there are no registered electors (they are commercial properties); and, the Village has the consent from more than 50 percent of property owners on land covering more than 50 percent of the total parcel area; then, Parcel 2 can be annexed throu�h an involuntary annexation process. Prior to initiating an involuntary annexation, the Village must file an urban services report with the Board of County Commissioners. The report is required to contain plans for providing urban services as well as setting forth the method of financing necessary improvements. The adoption of the ordinance of annexation, requires two advertised public hearings. Per Village of Tequesta Future Land Use and Zoning Designations: C: Commercial C-2: Community Commercial AREA C I Riverside Pines (Colette Drive and Nicole Circle)- Summary of Annexation Workshop and Follow-Up ■ 13 residents of Nicole Circle attended the workshop. ■ Feedback Form results: 11 residents are in favor, 2 residents need more information. ■ Thank you letters were mailed to residents that attended the workshop (See attached letter). ■ After the workshop, information package was mailed to all residents that did not attend the workshop along with the Feedback Form and a self addressed and stamped envelope. ■ CD is still in the process of receiving the Feedback Form from the residents. ■ Staff requested to the Supervisor of Election the number of registered voters in Area C which includes the following subdivisions: - Riverside Pines (Nicole Circle and Colette Drive)- 82 registered voters - Riverside on the Loxahatchee — 20 regisrered voters - River Pines and Unplatted Area — 35 registered voters ■ Area C has a total of 137 registered voters. In order for a referendum to be successful, 51% of registered voters would need to be in favor of annexing into the Village (See attached table). ■ Up-to-date feedback from Riverside Pines indicates 21 reqistered voters in Favor, 9 reaistered voters OQaosed, and 3 repistered voters Need More Information (See artached rable and mapJ. FINAL REMARKS ■ Staff recommends to conduct an Informational Annexation Workshop with residents of River Pines and Unplatted Area, and Riverside on the Loxahatchee to listen their position toward annexation. ■ Staff will continue to receive the Feedback Form and reach out to residents of Riverside Pines. ■ Staff met with Mr. and Mrs. Nelson at their home (4392 Colette Drive) on September 12, 2012. ■ Staff also met or had phone conversations with other residents looking for clarifications. ■ Please see attached referendum process flowchart. SCOPE Communi Develo ment Director, Mana er, and Council Members PROCEDURE Outlined below GUIDELINES RESPONSIBILITIES Assi ned Task Com leted 1. Community Prepare report setting forth the plans to Development provide urban services to any are to be annexed according to F.S. 171.042 — Prere uisites to annexation. 2. Community File copy of report (not fewer than 15 Development days prior to commencing annexation procedures under F.S. 171.0413) with Board of County Commission where municipality is located. 3. Community Mail written notice to each person who Development resides or owns property to be annexed not less than 10 days prior to first public hearing. Notice requirements is outlined in F.S. 171.042. 4. Clerk Publish legal notice of 1S public hearing (meeting to be held at least 7 days after the advertisement) 5. Clerk First Reading of Annexation Ordinance on next available Council agenda (Ordinance to come from attorney or Community Development). 6. Clerk Publish legal notice of 2" public hearing (meeting to be held at least 5 days after the second advertisement) 7. Clerk Second Reading of Annexation Ordinance on following month's Council agenda (Public Hearing). Processing Referendum Annexations Page 2 ELECTION PROCEDURES • A vote of the registered electors of the area proposed to be annexed will be heid. o The Village may also choose to submit the ordinance of annexation to a separate vote of the Village's registered electors. • The referendum will be conducted at the expense of the Village. • Referendum shall be held at the next regularly scheduled election following final adoption of Ordinance OR at a special election. • Vote of the registered electors of the area proposed to be annexed. Vote not to be held sooner than 30 days following the final adoption of annexation ordinance. • Notice referendum at least once each week for 2 consecutive weeks immediately preceding the date of the referendum. Notice requirements: outlined in F.S. 171.0413 • Election will be held under the same procedures as its Municipal Election and will be coordinated with the Supervisor of Elections Office. • Ballots shall offer the choice "For annexation of property described in ordinance number of the Village of " and "Against a annexation of property described in ordinance number of the Village of " in that order. • If referendum is held only in the area proposed to be annexed and receives a majority vote, the annexation shall become effective on the effective date s ecified. 8. Clerk After annexation is "Final," send notice and certified copies to Department of State, Palm Beach County and Clerk of the Circuit Court. Clerk 9. Community Annually or semi-annually, Village Development Boundary Ordinance to update the legal /* Clerk description in the Village Charter should be adopted. This should include all annexations that occurred during previous period (year or 6 months). At the rneeting, the Village provided a�oackage with information about services that are offered to our residents such as 24/7 neighborhood patrolling, 3-Minute response time for police service, and fire protection without paying the County MSTU fee. We are still making a sincere efforfi to reach residents from Colette Drive and Nicole Circle that were unable to attend the Informational Meeting. We mailed the feedback form with a self addressed and stamped envelope; and we are beginning to receive the forms back.
