REQUEST: Rezoning the subject annexed properties located on County Line Road, according

Per Palm Beach County Zoning Designations: Per Village of Tequesta Zoning Designations:
RS: Residential Single-ramily. R-1- Single Family Dweiling District.

The Village of Tequesta started an Annexation Strategic Plan (ASPA) in January 2011. As part of
the ASPA initiative, the Village trans��iitted to Palm 3each County an ap�lication for an Ericiave
Ir�terlocal Agreement annexation on May 1�, 2012. Per Chapter 171, F.S. the subjec:t five r5)
parcels met the definition of enclave, and the total annexed area is less than 10 acres. The
Village mailed letters to each property owner to communicate regarding the annexation
Interlocal Agreement.
On June 14, 2012, the Village Council approved the Interlocal Agreement with Palm Beach
County; the subject document was transmitted to Palm Beach County on June 18, 201�. On July
10, 2012, the Palm Beach County Board of County Commissioners (BCC) approved the Enclave
Interlocal Agreement, the annexation of the subject five (5) parcels became effective the same
date. The Local Plar,ning Agency (LPA) approved the subject rezoning on August 16, 2012
(voted 4-0). First Reading of Ordinance No. 11-12 was approved by Village Council on
September 13, 2012. Newspaper legal ads and written notices to property owners are
consistent with Florida Statutes requirements.

THREE TWO (1.32) ACRES MORE OR LESS OF LAND RECENTLY
ANNEXED INTO THE VILLAGE LOCATED AT COUNTY LINE ROAD, AND
AT 4412 AND 4480 COUNTY L1NE ROAD; PROVIDING THAT THIS REAL
PROPERTY WHICH IS MORE SPECIFICALLY DESCRIBED HEREIN SHALL
BE ASSIGNED THE VILLAGE ZONING DESIGNATION OF "R-1 SINGLE
FAMILY DWELLING DISTRICT"; PROVIDING THAT THE ZONING MAP OF
THE VILLAGE OF TEQUESTA BE AMENDED TO REFLECT THE PROPER
DESIGNATION FOR THIS REAL PROPERTY; PROVIDING A CONFLICTS
CLAUSE AND A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE
DATE; AND FOR OTHER PURPOSES.
WHEREAS, after duly noticed public hearings, held pursuant to Florida Statutes, the Village
Council does hereby find, determine and declare that the public health, safety and general welfare of
the citizens of the Village of Tequesta are best served by assigning that real property described
hereinbelow, located within the Village, the zoning designation of "R1 — Single Family Dwelling
District".
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, FLORIDA, THAT:
Se��tion 1: That certain real propvrty recently annexed itito the corp��rate limits of the
Village of Tequesta consisting of a total of approximately one point three two (1.32) acres more or
less, l�cated on County i,ine Road, is hereby zoned "Rl — Single Family Dwelling District", and is
legally described as follows:

25-00-001-1 f 3U, and 60-�2-40-25-OU-001-11311
Section 2: The Village Zoning Map is hereby amended to conform to this Ordinance, and
the appropriate officials of the Village are instructed to make the necessary changes to the official
Village Zoning Map.
Section 3: All Ordinances or parts of Ordinances in conflict be and the same are hereby

repealed.
Section 4: Should any section or provision of this Ordinance ar any portion thereof, any
paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder of this Ordinance.
Section 5: This Ordinance shall take effect immediately upon passage.
