REQUEST: Rezoning the subject annexed properties located on County Line Road, according
to the following chart and attached map:

BACKGROUND
The `✓illage af T�qGesta started ar An^zxation Strategic Plan iASPA; i� Ja;�uary 2011. A� �ar: cf
the ASPA initiative, the Village transmitted to Palm Beach County an application for an Enclave
Interlocal Agieement annexatior� on May 14, 2012. Per Chapter 171, F.S., the subject �ive (5)
parcels met the definition of er�ciav�, and tliz total a��nExed area is less than 10 acr�s. The
Village mailed letters to each property owner to communicate regarding the annexation
Interlocal Agreement.
On June 14 2012, the Village C� �uncil approved the Interlocal Agreement with Palrn Beach
County; the subject document was transmitted to Palm Beach County on June 18, 2012. On July
lU, 2012, the Palm Beach County doard of County Commissioners (B�C) appr�ved the tnclave
Interlocal Agreement, the annexation of the subject five (5) parcels became effective the same
date. The Local Planning Agency (LPA) approved the subject rezoning on August 16, 2012
(voted 4-0). First Reading of Ordinance No. 13-9 2 was approved by Village Council on
September 13, 2012. Newspaper legal ads and written notices to property owners are
consistent with Florida Statutes requirements.

THAT THIS REAL PROPERTY WHICH IS MORE SPECIFICALLY DESCRIBED
HEREIN SHALL BE ASSIGNED THE VILLAGE ZONING DESIGNATION OF
"R-2 MULTIPLE FAMILY DWELLING DISTRICT"; PROVIDING THAT THE
ZONING MAP OF THE VILLAGE OF TEQUESTA BE AMENDED TO REFLECT
THE PROPER DESIGNATION FOR THIS REAL PROPERTY; PROVIDING A
CONFLICTS CLAUSE AND A SEVERABILITY CLAUSE; PROVIDING AN
EFFECTIVE DATE; AND FOR OTHER PURPOSES.
WHEREAS, after duly noticed public hearings, held pursuant to Florida Statutes, the Village
Council does hereby find, determine and declare that the public health, safety and general welfare of
the citizens of the Village of Tequesta are best served by assigning that real properly described
hereinbelow, located within the Village, the zoning designation of "R2 — Multiple Family Dwelling
District".
NOW, THEREFORE, BE IT O�DAP.�iED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, FLORIDA, THAT:
Section 1: That certain real property recently annexed into the corporate limits of the
�Iil�age of' Tequesta cons� sting of a total of approximately 0.8 acrec, r:lore or less iQCateci �t 4534 and
4518 County Line Road, is hereby zoned "R2 — Multiple Family D��elling District", and is legally
described as follows:
(See Exhibit 1 attached hereto for legal description- PCN # 60-42-40-25-00-001-0170 and 60-42-40-
2�-00-001-0010)
Section 2: The Village Zoning NIap is hereby amended to conform to t��is Ordinance, and
tre appropriate officials ^f the Village are instn�cted to ma.ke the necessary char�es to the official
Village Zoning Map.
Section 3: All Ordinances or parts of Ordinances in conflict be and the same are hereby
repealed.

Section 4: Should any section or provision of this Ordinance or any portion thereof, any
paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder of this Ordinance.
Section 5: This Ordinance shall take effect immediately upon passage.
