HomeMy WebLinkAboutDocumentation_Local Planning Agency_Tab 03_01/17/2013 DRAFT PLANNING AND ZONING ADVISORY BOARD SITTING AS THE LOCAL PLANNING AGENCY MEETING MINUTES December 20, 2012 CALL TO ORDER AND ROLL CALL The Village of Tequesta Planning and Zoning Advisory Board Sitting as the Local Planning Agency held a regularly scheduled meeting at the Tequesta Village Hatl, 345 Tequesta Drive, Tequesta, Florida, on Thursday, December 20, 2012. The meeting was called to order at 5:32 p.m. A roll call was taken by Deanna Mayo, Assistant to the Village Clerk, who noted the following were present: Acting Chair Michael Schmidt, Board Member Elizabeth Schauer, Board Member Steven P Eagen, Alternate Janet Strand, and Alternate Sebastian Loaiza. Also present were Community Development Director Nilsa Zacarias, Village Attorney Keith Davis, and Assistant to the Village Clerk Deanna Mayo. Chair James Hackett and Board Member Eric Jolly were absent from the meeting. APPROVAL OF AGENDA MOTION . Board Member Schauer moved to approve the agenda as amended to add a discussion item under Any Other Matters. Board Member Eagen seconded the motion, which carried by unanimous 5-0 vote. APPROVAL OF PREVIOUS MEETING MINUTES MOTION Vice Chair Schauer moved to approve the minutes of the September 20, 2012 meeting as submitted. Board Member Loaiza seconded the motion, which carried by unanimous 5-0 vote. ORDINANCE NO. 20-12 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES AT CHAPTER 78, ZONING, AT ARTICLE IV, NONCONFORMING USES; BY REVISING THE REQUIREMENTS FOR MAINTAINING, ENLARGING OR EXPANDING NONCONFORMING USES AND NONCONFORMING STRUCTURES TO ALLOW GREATER LATITUDE IN MODIFICATIONS TO NONCONFORMING STRUCTURES, AND BY RE-NAMING THIS ARTICLE ACCORDINGLY; PROVIDING THAT EACH AND EVERY OTHER SECTION AND SUBSECTION OF CHAPTER 78, ZONING, SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; � PLANNING AND ZONING ADVISORY BOARD SITTING AS LOCAL PLANNING AGENCY MEETING MINUTES December 20, 2012 Page 2 of 3 PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. Attorney Davis explained this ordinance would allow home additions without going through the Board of Adjustment by so long as the non-conforming portion of the home was not increased. A structure with a non-conforming use could be maintained but could not have additions or expansions to the building. Attorney Davis explained he would be adding language requested by the Village Council to allow the Village Manager leeway to act in catastrophic Village-wide situations, and would be approved at a later date. MOTION Board Member Schauer moved to approve Ordinance No. 20-12 as submitted. Acting Chair Schmidt seconded the motion, which carried by unanimous 5-0 vote. ORDINANCE NO. 1-13 AN ORDINANCE OF THE VILLAGE� COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, ADOPTING A SMALL SCALE AMENDMENT TO ITS COMPREHENSIVE DEVELOPMENT PLAN IN ACCORDANCE WITH THE MANDATES SET FORTH IN SECTION 163.3187, ET SEQ., FLORIDA STATUTES, PURSUANT TO A VILLAGE INITIATED AMENDMENT NO. LUPA 1-13 WHICH PROVIDES FOR AN AMENDMENT TO THE FUTURE LAND USE MAP, DESIGNATING ZERO POINT SEVEN THREE (0.73) ACRES MORE OR LESS OF LAND RECENTLY ANNEXED INTO THE VILLAGE LOCATED AT 19578, 19590 AND 19600 U.S. HIGHWAY #1, AS "COMMERCIAL"; PROVIDING FOR COMPLIANCE WITH ALL REQUIREMENTS OF CIiAPTER 163, FLORIDA STATUTES; PROVIDING A CONFLICTS CLAUSE AND A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. Village Attorney Davis explained the purpose of the ordinance. MOTION Acting Chair Schmidt moved to approve Ordinance No. 1-13 as submitted. Board Member Eagen seconded the motion, which carried by unanimous 5-0 vote. ORDfNANCE NO. 2-13 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, PROVIDING FOR THE REZONING OF CERTAIN REAL PROPERTY WITHIN THE CORPORATE LIMITS OF THE VILLAGE OF TEQUESTA, FLORIDA; WHICH PROPERTY CONSISTS OF ZERO POINT SEVEN THREE (0.73) ACRES MORE OR LESS OF LAND RECENTLY ANNEXED INTO THE VILLAGE LOCATED � PLANNING AND ZONING ADVISORY BOARD SITTING AS LOCAL PLANNING AGENCY MEETING MINUTES December 20, 2092 Page 3 of 3 AT 19578, 19590 AND 19600 U.S. HIGHWAY #1; PROVIDING THAT THIS REAL PROPERTY WHICH IS MORE SPECIFICALLY DESCRIBED HEREIN SHALL BE ASSIGNED THE VILLAGE ZONING DESIGNATION OF "C-2 COMMUNITY COMMERCIAL DISTRICT"; PROVIDING THAT THE ZONING MAP OF THE VILLAGE OF TEQUESTA BE AMENDED TO REFLECT THE PROPER DESIGNATION FOR THIS REAL PROPERTY; PROVIDING A CONFLICTS CLAUSE AND A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. MOTION Board Member Schauer moved to approve Ordinance No. 2-13 as submitted. Board Member Eagen seconded the motion, which carried by unanimous 5-0 vote. PUBLIC COMMENT - None ANY OTHER MATTERS Board Member Schauer requested removal of storm shutters after a hurricane be added to the Village Code.
