CALL TO ORDER AND ROLL CALL The Village of Tequesta Planning and Zoning Advisory Board, sitting as the Local Planning Agency, held a regularly scheduled meeting at the Tequesta Village Hall, 345 Tequesta Drive, Tequesta, Florida, on Thursday, September 20, 2012. The meeting was called to order at 5:32 p.m. A roll call was taken by Deanna Mayo, Assistant to the Village Clerk, who noted the following were present: Vice Chair Michael Schmidt, Board Member Elizabeth Schauer, Board Member Steven P. Eagen, Alternates Janet Strand and Sebastian Loaiza. Chair James Hackett and Board Member Eric Jolly were absent from the meeting. Also present were Community Development Director Nilsa Zacarias, Village Attorney Keith Davis, and Assistant to the Village Clerk Deanna Mayo. 2. APPROVAL OF AGENDA MOTION: Board Member Schauer moved to approve the agenda as submitted; Board Member Eagen seconded the motion, which carried by unanimous 5-0 vote. 3. APPROVAL OF PREVIOUS MEETING MINUTES MOTION: Board Member Schauer moved to approve the minutes of the August ?6, 2092 meeting as submitted. Board Member Eagen seconded the motion, which carried by unanimous 5-0 vote. 4. ORDINANCE NO. 14-12 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING CHAPTER 78. ZONING. ARTICLE IX. SUPPLEMENTAL REGULATIONS. AT DIVISION 1. GENERALLY. BY UPDATING THIS DIVISION TO ADD REGULATIONS REGARDING FINISHED FLOOR ELEVATION, THE USE OF ENERGY SAVINGS DEVICES, HOME OCCUPATIONS, MANUFACTURED HOUSING AND THE PLACEMENT AND SCREENING OF EMERGENCY GENERATORS AND OTHER MECHANICAL EQUIPMENT, AND BY REMOVING REFERENCES TO BROADCAST AND RECEIVING ANTENNA REGULATIONS AND SATELLITE DISH REGULATIONS FOR RE-LOCATION IN DIVISION 5; FURTHER AMENDING CHAPTER 78. ZONING. ARTICLE IX. SUPPLEMENTAL REGULATIONS. AT DIVISION 5. WIRELESS TELECOMMUNICATION TOWERS AND ANTENNAS. BY UPDATING THIS DIVISION TO RE-LOCATE CERTAIN REGULATIONS REGARDING BROADCAST AND RECEIVING ANTENNA AND SATELLITE DISHES FROM DIVISION 1 TO DIVISION 5, BY REVISfNG THtS DtVISION TO CORRECT CERTAIN INTERNAL INCONSISTENCIES, AND BY RE-NAMING Planning and Zoning Advisory Board sitting as the LOCAL PLANNING AGENCY MEETING MINUTES September 20, 2012 Page 2 of 2 THIS DIVISION ACCORDINGLY; PROVIDING THAT EACH AND EVERY OTHER SECTION AND SUB-SECTION OF CHAPTER 78. ZONING. SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. Attorney Davis explained that the Village Code was being updated in its entirety and additional improved language would be coming forth for the Boards approval. He offered clarification on several areas. Ms. Nilsa Zacarias, Community Development Director made note that the current Code does not cover generators. Member Strand suggested specifications be added to restrict test times. Attorney Davis responded that the Village noise ordinance could clarify limits which would pertain. MOTION: Board Member Schauer moved to approve Ordinance No. 94-12, Ordinance. Vice Chair Schmidt seconded the motion, which carried by unanimous 5-0 vote. 5. PUBLIC COMMENTS None 6. ANY OTHER MATTERS Ms. Nilsa Zacarias noted that Chair Hackett had contacted her about his unforeseen absence and, he had all intentions of being present at the next meeting. 7.
