HomeMy WebLinkAboutMinutes_Board of Adjustment_08/13/2012 BOARD OF ADJUSTMENT PUBLIC HEARING MEETING MINUTES AUGUST 13, 2012 CALL TO ORDER AND ROLL CALL The Village of Tequesta Board of Adjustment held a regularly scheduled Public Hearing at the Village Hall Council Chambers, 345 Tequesta Drive, Tequesta, Florida, on Monday, August 13, 2012. The meeting was called to order at 6:00 p.m. A roll call was taken by Deanna Mayo, Assistant to the Village Clerk. Present were: Vice Chair Paul Brienza, Board Member Randy Kaye Garvey, Board Member Matt Belger, Alternate Leslie Dasher who arrived at 6:02 p.m., and Alternate Ward Bertholf. Chair Steve Pullon and Board Member Jon Newman were absent from the meeting. Also in attendance were Community Development Director Nilsa Zacarias, Attorney Jennifer Gardner Ashton, and Assistant to the Village Clerk Deanna Mayo. APPROVAL OF AGENDA MOTION Board Member Belger moved to approve the agenda as submitted. Board Member Bertholf seconded the motion. The vote on the motion was: Paul Brienza — for Randy Kaye Garver - for Mait Be/ger - for Ward Bertho/f - for The motion was therefore passed by unanimous 5-0 vote. 1. Approval of Minutes of July 9, 2012 Meeting MOTION: Board Member Belger moved to approve the agenda as submitted. Board Member Bertholf seconded the motion. The vote on the motion was: Paul Brienza — for Randy Kaye Garver - for Matt Be/ger - for Ward Bertholf - for The motion was therefore passed by unanimous 5-0 vote OLD BUSINESS - There was no old business to come before the Board. NEW BUSINESS Board of Adjustment August 13, 2012 Page 2 SWEARING IN OF WITNESSES All those intending to offer testimony in tonight's case were sworn in. EXPARTE COMMUNICATIONS Vice Chair Brienza, Board Member Garver, Board Member Belger, and Board Member Bertholf each reported they had visited the site and had spoken to no one. Board Member Dasher reported she had had no exparte communications. 2. Var. 8-12 Request for variance in order to construct additions onto an existing single-family structure: Relief from Sec. 78-95 to allow enlargement of a non-conforming building; Relief from Sec. 78-143 to allow a front setback of 24.6 feet where the code requires a minimum of 25 feet. The applicant is Jason and Jenny DeArellano. The address of the property is 7 Pinetree Circle, Tequesta, Florida 33469. The legal description is Lot 42, Plat of Ridgewood Homes. The property is located in Zoning District R-1. l"he Village Attorney read the Request for Variance into the record. A representative of Malt Construction testified on behalf of the applicant and offered background information for the application. Karen Schumer, 23 Pinetree Circle, indicated she had no objection to the application. It was reported that Richard Gadde, 14 Pinetree Circle, had spoken with Community Development Director Nilsa Zacarias and supported the change. MOTION: Board Member Belger moved approval of VAR 8-12. Board Member Bertholf seconded the motion. ANY OTHER MATTERS Board of Adjustment August 13, 2012 Page 3 There were no other matters to come before the Board. ADJOURNMENT Board Member Bertholf moved that the meeting be adjourned at 6:09 p.m. Board Member Belger seconded the motion.
