Subject: Consideration of Request for Erecting Permanent Identification Markers within
the Village of Tequesta Right-of-Way along Country Club Drive and the
Modification of the Village of Tequesta Nlartin County Entrance Marker to
include Identification Signage for a Subdivision Tequesta Country Club
Community per the Village of Tequesta Right-of-Way Procedures. Sande McKey
and Pat Hartley, agents for the Tequesta Country Club Community Association,

The Tequesta Country Club Community Association proposes a modification of the
identification markers along Country Club Drive in order to create a more encompassing sense of
Community for those homeowners along Country Club Drive who belong ta the Tequesta
� Country Club Community. The Village Council must review the application per the Village of
Tequesta Right-of-Way Procedures;
"Procedure for Approving Usage of Public Right-of-Way for Structures
and Signs — whenever a party proposes to use the public right-of-way for
placement of a permanent structure or sign, or temporary signage for an
e�rtended period of time, consideration of same sha11 be subject to review by
the Village Council_ The party shall submit a hold harmless agreement in a
form acceptable to the Village Council indemnifying the Village, along with a
sketch or site plan indicating the proposed use of the right-of-vuay. The
application shall be made prior to any application for a variance from the
Board of Adjustment or review by the Cammunity Appearance Board as may
be applicable. Approval by the Village Council of the agreement may be
conditianal, requiring variance approvals and site plan approvals prior to
execution of the agreement by the Village Manager."

VILLAGE OF TEQUESTA
RIGIiT-OF-WAY PROCEDURES
Procedure regarding proposed eonstruction �ctivities within public right-of-way and on
Village of Tequesta owned property.
The 1?epartment of Community Uevelopment shall oversee the administration of these procedures
and/or requirements. The Water System Manager shall ensure that the Tequesta Water
Department complies with all provisions of this policy
All proposed construction activity, excluding Village installed signage, shall be by permit,
including, but not limited to, new infrastructure/utility installation, alterations anc�/or repairs to
existing infrastructurelutilities, and/or other construction activities that aze proposed to be
constructed, altered and/or repaired and/or the installation andlor replacement of trees, shrubs,
signs, mailboxes, planters, ornamental decorations, etc. within V'illage public rights-of-way and/or
upon Viltage owned progerty shall be subject to_ Village ordinances, rules standards, policies and
. procedures and/or requirements as follows:
o Pursuant to Village of Tequesta Qrdinance 2U9 - any proposed new sewer�ge
syst�m sha11 require the prior appro�al of the Village Council. Approval by the Village
daes not at�solve applicant from requirements appearing below.
o Pre-Appiication Meeting - a pre-application rneeting may be required if it is
determined that the proposed proje�t must receive DRC review. If it is deteimined
that a DRC review is required then the DRC apptication and review process must be
foltQwed.
o Pc�-Consttvction Meeting Required - prior to any public agency, franchise utility
anci/or service provider, contractor, sub-contractor or individuat performing any work
within a public right-of-way and/or on V'illage owned property, a pre-construction
meeting may be required to be held with all affected parties. It shalt be the
responsibility of the contractor or er�tity seeking to perform said construction aetivities
(work) to contact the Department of Community Devetopment to deternune if a
meeting is required and to schedule the pre-construction meeting and to coordinate
same with the Department of Community Development.
o Construction Plans and Specifications Required - it shall be the responsibifity of an
applicant proposing to work within a public right-of-way and/or upon Viilage owned
groperty to submit to the Department of Community Development prior to permitting,
five (5) sets of all construction/'mfrastructure plans, drawings, engineering
specifications and construction specifications as may be appticable for the work being
proposed.
o Licensed Contractors and/or Sub-Contractors Required - it shall he the
responsibility of an applicant proposing to work within a public right-of-way and/or

upon Village owned property to hire property licensed contractors, sub-contractors,
companies and/or individuals to perform said work.
o Permits Required - permits are required for all proposed work by contractors, .
sub-contractors, companies, utility companies, andior individuats with the exception of
Viltage instalted signage. Pernut applications are avaiiabte at the Department of
Community Development.
o Franchised utiiity campanies may utilize praperiy trained and/or certified 'w-house
staff or personnel to perform work within public rights-of-way if not precluded from
doing so by a federal, state, county or Iocal requirement or regulation. This does not
relieve the entity from the review, approval and permitking process.
o Natice to Proceed Required - no construction work and/or activity shatt commence
within public rights-of-way until a"Notice to Proceed" has been issued by the Director
of Public Works. If the work is of a valid emergency nature(i.e. a life, heaith ancUor
safety concerri), the Director of Public Works shall be notified by phone : or,- in his
absence, notify the Director of Community Development. Pennission to proceed with
the ecnergeney work will be granted subject to all other requirements being complied
with during or immediately followin� the emergency work: ;
o Emergency VVork Procedures -
�Emergency work may proceed immediately
oProper notification as stated above shall be required
oProper constructian and safety measures shall t�e followed at atl times during
construction
�Pernut shalt be applied for in a timely manner followi�g emergency work.
o Notification of Affected Property Owaers - concunent with the issuance of a"Notice
to Proceed" by the Director of Public Vtiorks, the Public t�arks/Recreation Department
shatl provide written notification to the residents in the area of the V'�Ilage that are
affected by the proposed work to be performed within a public ri�ht-of-way:
o Inspections Required - right-of-way construction activity will be permitted and
inspected by the Building Department utilizing appropriate sta.ff at the direction Qf the
Building O�icial. Twenty-four hour notice is required prior to work commencing in
order tQ alert village officials of this pending work. (Emergencies witt be handted in an
expedited manner.j Deviations, amendments, etc. must be supported by written
documentation from permittee and subsequently approved by Vitlage staff. The

minimum inspections required shall be as set forth on the Department of Community
Development Inspection List. .
o Conditions to the Permit - conditions of the construction activity falling within the
purview of the Department of Public Works and the Tequesta Stormwater utility shall
be pmvided by the Director of Public Works to the Buitding Officiat for inclusion with
the appropriate pemuts. If a DRC process was instituted with this construction
activity, then each DRC member shatt provide any conditions as a result of their
respective departments purview of ttus construction activity.
o Standard Conditions (fist) - Conditions shall inctude, but not be limited tq the
following: �
l. RoacUpavement cuts are prohibited.
2. Cleantiness during construction_ activities' and ciean-up upon completion are:<._
requirements/conditions of the pertnit:
3. Appropriate provisions for signage that wams veiuculaz traffic of construction•
activities within the public rigtrt-of-way shalt be required. AII signage, must at .a
minimum, meet current DOT specifications. :
4. Apgropriate provision for barricades shali be required in order to protect and
properly detour pedestrian and vehicular traf�c.
5. Tests and testing - soil, sub-base and base compaetianldensity tests shall be
required in order to assure proper compaction under alI roadway, gaving, sidewalk
ancifor pathway areas affected by the construction wark per DOT specifications.
6. Test results shatl be provided to the Department of Community Development prior
to the pouring of any concrete and/or laying of any asphaltic surface.
7. Video taping and/or still photography must occur prior to work starting in order to
document existing conditions ger direction of the Director of Public Works.
S. A Maintenance of Traffic (MOT) plan must be submitted by the contractor at time
of permit appfication. The Department of Community Development shatl submit a
copy to the Police and Fire Departments.
9. All tra�ffic cornrol devices must compiy with the U. S. Department of Transportation
Traffic Control Manual. Use of flagpersons with DOT type approved vest and flag
shatt be required by the Village.

10. Orange traffc safety cones aze required in front and rear of all velucles and/or
equipment parked in right-of-way.
11. All de-waxering pernut appficants be advised that no water is to be pumped directly
onto the street. It must be done in a closed conduit or flexible hose to the nearest
catch basin or sufficient retentian aze� The Director of Public Works, or his
designee, must be on the site when the pump is started. All de-watering pumps
must be sufficiently mu�ed to comgly with applicable noise regulations.
12. All sewer pernut applicants, be advised tha.t the sewer lateral tie-in and/or clean-out
must be inspected before the pipe is covered.
13. All lift stations and similar structures within either easements or the right-of-way
shall be screened with landscaping as approved by the°::Village of Tequesta
Community Appearance Board and a permit shall be regui"red for the landscape
wark.
14. Other conditions as may be required as a result of a DRC revievv.
15. Issuance of : Right-of-Way pernuts do not relieve the applicant from obtaining
necessary Building Department germits. _ . .
o When proposed work is contemplated under a paved roadway or driveway, jack and
bore techniques shall be utilized by ail utilides, franchises, eQntractors and entities.
o When it is determined that jack and bore techniques aze impractical, the permittee shall
provide written notice to the public works director requesting a waiver to the jack and
bore requirements_ The public works director shall provide written response to said
request.
n Whenever road cuts are permitted pursuant to this po�icy, the utility or the utitity's
contractor shall conta�t the Building Department for inspections of the work at
apprQpriate intervals for compliance with V'illage standards and requirements
regarding the same with particular emphasis on construction review for proper
compaction. Village standards and requirements regarding road cuts, gatchir�g and/or
paving shall be equal to or exceed FDOT standards regarding the sarne.
o Whenever mad cuts are permitted, one lane of paved vehice�lar tra�ic will be maintained
� at all times. Exceptions will be allowed in justifiable pre-approved circumstances at
the discretion of the Director of Public Works.

o Right-of-Way activity of any significance, in the opinion of the Director of Public
Works, shall require the written notifica.tion of all affected adjacent property owners of
the forthcc�ming right-of-way disturbance. The Director of Public Works shall be
responsible for insuring compliance with this policy provision. Utility companies
andlor contractors may be required to make said notification in an acceptable manner.
o All utilities desiring to work within Village rights-of-way shall be required to return the
right-of-way and any improvements locat� therein to the condition which existed
prior to the undertaking of the said activity.
o Procedure far Approving Usage of Public Rig6t-of-Way for Shvctures and Signs
- whenever a party proposes to use the public right-of-way for placement of a
permanent structure or sign, or temporary signage for an extended period of time,
consideration of same shall be subject to review by the Village Council. The party
stiall submit a hold harmless agreement in a form acceptable to the Viltage Council .
indemnifying the Village, along with a sketch or site plan indicating the proposed use
of the right-of-way. The application shall be made prior to a� application for a
variance from the Boazd of Adjustment or review by the Community Appeaxance
Board as may be applicable. Approval by the Village Couincii of the agreement may be -�
conditional, requiring variance approvals and site glan approvals prior to execution of
- the agreement by the Village Manager. . _

RE: Permission to seek Municipal Approvals for Proposed Construction Activities
within Country Club Drive Right-of-Way
Dear Ms. Irwin:
This is to advise you that the Tequesta Country Club Community Association (TCCCA) is hereby
authorized to seek approvals from the Village of Tequesta for proposed improvements within the
Country Club Drive right-of-way, pursuant to the Tequesta site plan review procedures to: (1)
modify an existing wall sign at the border with Martin County, (2) construct a new wall sign in the
general vicinity of the Tequesta Country Club, Inc., (3) modify an existing monument sign located
south of the intersection of Starboard Way and Country Club Drive.
Additionally, TCCCA is hereby authorized to seek any necessary variances for the aforementioned
signage from the Village Council and/or Board of Adjustme�t as may be necessary.
This authorization letter is in no way to be construed as an approval of the modifications and
additions to be sought from the Village by TCCCA.
All costs and conditions imposed by virtue of these proposals are to be born by TCCCA.

GENERAL RELEA3E AND I�OLD HARMLESS AGREEMENT ,
WHEREAS, the Tequesta Country Club Cvmmunity Association, Inc., has applied for variance
with the Board of Adjustment of the Village of Tequesta authorizing constn►ction of three permanent sign
markers within the Village of Tequesta public road right-of-way;
WHEREAS, the condition of any said approval imposed by the Zoning Board of Adjushnent
requires the properly owner to enter into a hold harmless agreement with the Village indemnif}rir►g the
Village in the event of damages arising out of the Iccation of the signs and actions against the Village as a
result of the variance.
NOW, THEREFORE, it is agreed as follows:
1. This General Release and Hold Hamiless Agreement is given to the Village of Tequesta {hereinafter
referred to as the "Village'� by T'EQUESTA COLJNTRY CLi1B COMMiJNITY ASSOCIATION, INC.
(hereinafter refeired to as the "Owner", its representatives, successors and assigns) in consideration for
the Village granting the above-referenced variance to Owner. This variance refers to the pro�erty
located at T'EQUESTA COUNTRY CLUB SUBDIVISION, Tequesta, Florida.
2. Upon said approval, the Owner hereby remises, reteases, acquits, satisfies and forever discharges the
Village of and &om all and any manner of action or actions, cause and causes of action, reckoning,
controversies, damages, judgments, executions, claims and demands whosoever in law or in equity,
wMch the Owner ever ha�i, now had, or any suc�essor or assign of the Owner, herea8er, can,' shall, or
may have against the Village, for, upon, or by reason of any cause arising out of or in the event of �
damages as a result of or arising out of the loca�on of the signs and actions agau�st the Village as a
result of the variance.
3. The Owner hereby agrees to waive, defend and hold:harmless the Viltage of Tequesta from any claims
or demands, actions, judgments, or damages resulting from the variance. This agreement shall run with
the land.

3. This Agreement shall remain in effect during that period of time in wluch the

4. The ASSOCIATION sha�l prov�ide to the V�.T A.G� ax�d shall maintain �.n full fozce
and ef;fect for Che period of time the encroachments continue to exist, a policy of insurance insuring
the VII.,LAGI? in the manner specified herein. The VILLAG$ 0�' TEQUESTA shall be a named
insured, and f� Certificate of Tnsurance shall be provided to the 'VrL,LACxE prior to a permit being
granted for tt�e improvements, and annually each year thereafter, certifying the VILLAGE as a
named insured under a policy of insurance in a face amount of not less than $1,000,000.00 per
incident and per occurrence_
5. Ttie A,SSOCIATION shall bear alt costs o�maiz�tainix�.g the sxgn zzxazkers located
within the public right-of-way of the VILLAGE. In the event the ASSOCIATION fails to maintain
said improvernents to the satisfaction of the VTT.T,AGB, the VTT,LAGB is hereby authorized to
xn,aiz�t�zn said .'unproveixients az�,d to bill the .ASSOCIATION and/ox property owners within the
ASSOCIATIQN for the cost of said maintenance. In the event said costs are not paid within a period
of sixty (60) d ays subsequent to hilling, the VII.,LAGE is authorized to place a lien on the properties
loeated withu� the Tequesta Country Club Community Subdivision.

6. The AS SOCIATTON will provide for and shall remove the encroaching signs, at the
expense ofth�. ASSOCYATION, at any time such removal is raquired eitherb�cause of faiaure of the

because of ur►provements necessitated by the VII,LAGE or of any utility franchise.

II. PROCEDURE FOR APPROVING USAGE OF PUBLIC RIGHT-OF-WAY FOR
STRUCTURES AND SIGNS
A. MARKER # 1
Location: The marker will he placed in the same location as the existing
`tombstone' marker in the Village Right-of-Way to the rear of the property
line of 110 Yacht Club Place. The rear of the property abuts Cauntry Club
Drive and the adjacent homes to the north front onto Country Club Drive.
TCCCA proposes to place the marker ten (10) feet from the edge of
pavement of Country Club Drive and ten (10) feet from the edge of the
south property line of 115 Country Glub Drive. ,

B. MARKER #2
Location: TCCCA proposes to place the markers within the Village Right-
of-Way along Country Club Drive in front of the Tequesta Country Club.
There will be a marker on either side of Country Club Drive to create an
`entrance' effect. The markers will be set back six (6) feet from the edge of
pavement of Country Club Drive. �

Staff Comments: In consideration of Marker #Z, please consider the following:
■ The sign requires a variance to the terms of the Official Compr�hensive
Zoning Ordinance of the Village of Tequesta, Section XII, Sign Regulations,
Subsection (M)(2), Subdivision and Developrr�ent Signs, to allow for a height of
seven feet one and one-half inches (7' 1.5") in lieu of the Maximum six foot (6')
high permanent entrance sign as required by the code. TCCCA desires to make
an `impression' of an additional entrance into the Country Club Community.
■ The size of the sign and setback from the road requires the displacement of a
Village of Tequesta sidewalk, also within the right-of-way.
■ The FDOT requires a minimum setback width of six (6) feet along a twenty
five (25) mile per hour rural zone, the proposed marker is to be set at the
minimum required setback.
■ Staff recommends that if Council approves usage of the Village Right-of-Way
for the TCCCA signage at this location, that the signage should be modified to a
smaller height and width.

Location: TCCCA proposes to modify the existing Village of Tequesta
entra.nce marker at the Martin County � boundary. The columns on both
sides of the road will be widened to accommodate a`Tequesta Country
Club Community' Sign.

Staff Comments: In consideration of Marker #3, please consider the following:
■ The Tequesta Country Club Community Association desires to modify the
Village of Tequesta entrance markers in order to place signage on the column for
the `Tequesta County Club Community'. This could be considered private use of
public property. A consideration shauld be made of other homeowners
associations or subdivisions withi� the area, would this also be allowed for them.
■ Council could be setting precedence for allowing subdivisian to use the
Village of Tequesta Markers as additional entrance markers.
III. RECOMIV�NDATIONS
The following recommendations are to be conditions of approval of the
application:
1. TCCCA enter into the Hold Harmless Agreement recommended by the
Village legal advisor.
2. A variance must be considered for the height of Marker #2.
3. Any modifications to the signage that the Council recommends.
4. TCCCA is solely responsible for maintenance of their signs and any portion
of Village signage containing TCCCA signage.
