Thanks to your currenz participation, Palm Beach County has been able to
undertake essentiai community development and housing assistance activities in
specific municipalities and the unincorparated areas. The Village's continued
participation will allow it or its residents the opportunity to apply for funding for

activities such as:

� housing rehabilitation
• emergency repairs to housing
• mortgage subsidies for first-time homebuyers
• capital improvement projects
• economic development initiatives
To participate in the Urban County Program, the Village must notify HCD and
HUD in writing of the Village's official decision to do so and must execute an
Interlocat Coo�eration Agreement with Falm Beach County. Your participation

Enclosed are five (5) Interlocal Cooperation Agreements for approval and
'� �` execution by your governing officials. HCD must also have evidence that the
V'illage Commission has authorized the Agreement. This must be either a certified
Resolution or a conformed copy of the Minutes from the meeting at which the
Agreement was approved. Either document must be an original with the actual
signatures and a raised seal. HCD must receive the documentation no later than
Frida,X, June 25, 1999 in order to be approved by the Palm Beach County Board
of County Commissioners and to meet HUD's deadline.

AND THE VILLAGE MANAGER TO EXECUTE THE SAME ON
BEHALF OF THE VILLAGE.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1. The Interlocal Cooperation Agreement between

NOW, TI�R�FO,RE, the parties hereby agree as Follows:
1. The COTJI�TY and the MUTIICIPALITY wiU cooperate so that the COUNTY may txpp�d
CDBG and HOM� funds for elig�ble activities witt�in the MUNICIPALITy duriag gederal
Fiscsl Years 2Q0�, 2001, 2002 ('iacluding program inc�me generated from expenditure of such
funds) under Title I of the Housing and Community De"elopmcnt Act of 1992 and Titfe II of
Naticnal Affor�dat�te Housing Act of 1990, and receive funds under'these Acts_
Z. The COUNTY. and the MUi�TIC1PAi,iTy v�r's11 cooperate to undertake� or assist in
undataking, com�tiunity renewsi attd lower income housing assistance activities, specifically
. , urbaa raiewsl:amd�pablidy assisted housing.
3. With the.MUNICIPALITY'S assistance, the COUAITY wilt prepare a Consolidated Pian
� as raluired b3► the II.S. Department of Housing and Urban Development (HUD). The
COUNTYwill.unde�take or assist in undertaking a11 professional and administrative services .

ag�ree to take ftill responsibility and assume all o6ligations of an applicant under the Housiag

and Cut� Act of 1992. The COLTIVTY and the MUrTICIPALTTY agree
that the COt1N�Yis �eneby allowed to undertake or assist in undertaking essential community
dev�lop�meaE �;housing assistance activities within the MUrTICIPALITY; however, the
CO[TIV�`x' 1�,'fii�al responsibitity for selecting activities and annually submitting the

compliance with the urban county's certification required by Section 104(b) of Title I of the
Iious+ng aad. Ci�mnauuty Development Act of 1974, as amended, including Title VI of the Civit
Rights Ac� of 2964,_Title VIII ofthe Civil Rights Act of 1968, The Fair Housing Aat, Sxtion
109 of Tide I of th� Housing and Community Development Act of 1974, The Americans with
Disabilities Act o� 1990, end othe,r appficable laws. ,

grants under the•SmaU.Gities or State CDBG Programs from appropriations for �scal Years

fnrr�e � 1aw et►�prcemeat agencies within its jurisdiction against anyr individuals engaged in
non-violent cevil ri�hts demonstrations; and a policy of enforcing applicable State and loca!
laws against plrysieal(y barring entrance to, or exit &om a facility or location which is the
sub of such non-violent civil rights demonstrations within jurisdictions. The COUNTY
shall not use CDBG or HOME funds for activities in or in support of any MUIVICIPALITY
tl�at dces �t affir�natiyely further fair housing within its own jurisdiction or that impedes the
COUNTY'S. ac��n� �o comply with its fair housing certiHcation.

� 8. Pursuant to 24 :CFR 570.501(b), the MUIVICIPALITY is subject to the same requirements

9. The MUNICIPALTTY shall be responsible for notifyidg the COUNTY of any modificatioa
a�d/or c,�ange in�the use of a�r real property (from that planned at the time of acquisidon or
improvet�t, incltu�ting disposition) acquieed or improved in whole or in part with CDBG or
HQME fiu�ds tpat:is:within corttrol of the MUNICiPALITY. Notificadon of the COUNTY
st�all tak�pl�tce:�i�tui� ten (lU) days of said modification or change.
In the event titist said real property as described above is sold, conveyed or transferred
a� ttc�'`t,i��`o����i�itian �nd/or improvement, and said real property is sold, conveyed or
�etce� foc iisage which does not qualify as eligible under CDBG or HOME reguladons,
t}�e COUIVTI` shall be reimbursed in an amou�rt equal to the cu�rent fair market value (less arry
portion thereof attributable to expenditures of non-CDBG or non-HOME funds) af the
