The subject property is located within the Single family Dwelling (R-lA) zoning district. Please place this item on the May 13, 1999 Council agenda. The variance request is for approximately 14.8 feet in lieu of the twenty- (20) foot setback, at the southeast corner/side yard. The applicant intends to build an addition onto the existing church structure that will e�rtend into the corner/side yard, where plans submitted with the variance application indicate that the proposed addition will encroach into the required cornerlside yard setback approximately 5 feet 2 inches. The subject property is approximately 4.41 acres and there appears to be room for an addition to the rear of the existing church structure where this proposed addition is indicated on the plans submitted with this application. Also enclosed are the required checks, in the amount of five hundred dollars ($500) and one-thousand dollars ($1000), respectively. We hope that these submittals will enable you to publish the required legal notices and be prepared to hear our petitions at the Village Council meeting on May 13th. We are currently in the process of preparing our response to the questions and comments made by the Development Review Committee, as referenced in Ms. Irwin's letter dated April 6th. As you know, some of these comments require extensive work to respond pcoperly and accurately but we will do our best to meet your schedule. We now anticipate that we will submit our Site Plan Review application during the week of April 19th. Anschutz J For the First Presbyterian Church of Tequesta , First Presbyterian Church of Tequesta Attachment to Application For Variance The following facts respond specifically to the six criteria required under the section titled "Justification of Variance." 1. There are several conditions in this case which are special and peculiar to the land and structures involved and which are nor applicable to other land, structures, or buildings in the same zoning area, including the following: a. The adjacent street, Point Road, is located far to the east of the center of the right- of-way, so the smal! corner of the proposed building which intrudes into the set back area is still over 50 feet from the paved area of the street. b. The proposed building will be substantially further from the street than other similar nearby buildings. These other buildings do meet the required set back dimensions. c. The corner of the building intrudes into the set back area only 5 feet 2 1/2 inches and has an area of approximately 40 square feet. To put this in context, the total area between the building and the street is about 7500 square feet, making the intrusion only about one-half of one percent of the total area available. 2. Although we are responsible for the proposed design, the requirements of the Florida Department of Health, which has responsibility for the design and operation of preschools, dictated to a large extent the size of the classrooms and the lavatories. 3. The granting of the variance will not grant us any special privilege since the location of the building provides substantially more open area than the buildings on the other three corners. 4. The literal interpretation of the provisions of the ordinance would work undue � hardship on because we desperately need more classroom space for our Sunday School and our community Preschool and this proposal keeps all of these activities in close proximity to existing classrooms and offices. It also provides an enclosed, much- needed play area for the children during the week. 5. We believe that the requested variance will make possible the reasonable and proper use of the land since there is no other location on our property as well-suited. 6. The new building will be an attractive addition to both our complex and the surrounding area.
