NEWELL, COMMUNITY DEVELOPMENT SUBJECT: ALLEY ABANDONMENT (ZAINO'S PROPER'I'I') DATE: SEPTEMBER 2, 2003 CC: � Maxilyn Zaino, owner and applicant, hereby xequest of the Village Council to abandon the portion of ally that is located on the east boundary and adjacent to lots 1 through 7, block 3 of the Jupiter Heights Subdivision (see enclosed survey). Mrs. Zaino has contracted with the services of Karlin Daniels & Associates, Inc. to auction the property in late September 2003. I have met with the representative of this firm to discuss the zoning issues that plague the property. Mrs. Zaino is aware that the Village of Tequesta is ready to proceed with a condemnation and demolition of the existing building. This action has prompted the decision to auction the property. Back�round Prior to this decision, I have met with several parties that were expressing an interest in the property. In the end, it was the zoning issues that cause the parties to lose interest in the property. The problem is the setback requirements that the ally requires. The alley is considered a public right of way and has a setback requirement that effectively divides the properry in half. Thus creating a development obstacle to the site. If the property becomes one parcel with the abandonment of the alley and the placing of the entire individual lots under a unity of tifle a single commercial parcel will be created. This will enhance the salability of the property. The existing alley that transverses block three is impexceptible when one drives behind the buildings that face US One. The alley is not clearly discernable. Recommendation After evaluating the property and the history that surrounds this site, I would support and xecommend the abandoning of the portion of the alley that is associated with the property. I am basing my recommendation on the removing the obstacles that exist concerning the property. This action will lead to a successful auction and the conversion of the site into a productive commercial property. Discussions with the Department of Community Development have led to the request for abandonment of the alley that divides the pxopexty. It would benefit the ownex and the Village to unite the sepaxate lots into one paxcel for development.
