RESOLUTION NO 3-13
A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, FLORIDA, AUTHORIZING THE
VILLAGE MANAGER TO PROVIDE A LETTER OF
AUTHORIZATION TO THE FLORIDA EAST COAST RAILWAY
(FEC) TO BILL THE VILLAGE OF TEQUESTA FOR GRADE
CROSSING MAINTENANCE, TEQUESTA DRIVE MILEPOST
281-4,096' —FDOT#272373Y AND ACCEPTING RESPONSIBILITY
FOR THE COST OF THE CROSSING MAINTENANCE;
APPROPRIATING $130,000 ADDITIONAL FUND BALANCE IN
CAPITAL PROJECTS FUND #303 AND INCREASING THE
CAPITAL PROJECTS FUND #303 2013 BUDGET BY $130,000;
PROVIDING AN EFFECTIVE DATE; AND FOR OTHER
PURPOSES.
WHEREAS, in accordance with the terms of the agreement between the FEC and the
Village dated October 26, 1989, the cost of the crossing maintenance is the responsibility
of the Village; and
WHEREAS, the FEC has submitted an outline to be used as an estimate for the cost of
the crossing maintenance of $130,000 (Exhibit A, attached); and
WHEREAS, the Village agrees to be responsible for the actual costs of the maintenance
which may be different than the estimate; and
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1: The Village Council of the Village of Tequesta, Florida, hereby approves
and the Village Manager to provide a letter of authorization to the FEC to bill the Village
for the grade crossing maintenance as described in the attached E�iibit A.
Section Z: This Resolution shall take effect immediately upon passage.

NOTICE OF INTENT TO WORK

Dear Mr. Couzzo:
This is in reference to my letter dated July 31, 2012, listing the crossings scheduled for
maintenance in the year 2013. The above-referenced grade crossing has declined to the point of
requiring maintenance. This crossing was completely rebuilt in 2006, and will not require a new
track panel at this time. The Railway plans to remove the crossing panels, surface through the
crossing and replace the panels and asphalt. We have scheduled this work to begin on March 17,
2013.
In accordance with the terms of the agreement dated October 26, 1989, the cost of the crossing
maintenance is the responsibility of the Village. The costs to the Village are as outlined in the
enclosed estimate, however this is an estimate only and all charges for which the Village is
resr�onsible shall be billed on �n actual cost basis.
Please review the enclosed estimate, and if acceptable, please acknowledge this letter by
providing a letter of authorization against which we may bill for this work. In the interim, our
Roadmaster, Mr. Kenny Robinson, will be in contact to coordinate the scheduling of the work.
