d�l�ctated authority over landscapino activities and
maintenance of landscaping under the County'6 COa5td1
Protection Ordinancs.
Tam. I am in supp�rt of the Village accepting Palm Beach County's
deleaated a�athority from FDEP and apglying jurisdiction within the
corgorate limits of Tequesta, thase rsQUlations set forth in the
t'otanty' s Go�stal Protect ion Ordinancs that spe�if ical ly address
mattFrs pertaining to landscaping activities a.:�d maint�nance of
landscaping. As �you are aware, the Villags already has in place
s�veral sets �f rsgulations that requlats all constructivn activitiss
within the coastal constructiQn zone and in the coastal high hazard
areas of the Village. Ths Villags also adopted Ord. 444 on 6-14-90
which adopted the Palm Beach County "Goastal Pratectian Ordinance" No.
90-2, as amended. In the case of overlapping or conflicts betwesn
regulations, the more stringent requirements would take precedsnt.
As I understand the requsst set forth in Bill Griffin's letter dated
April 12. 1994, the Village Council needs to formally accept Palm
Heach County's delegated authority to restore 7urisdiction under the
County's "Coastal Protection Ordinance". thsreby reestablishing
permittinq authority by Palm Beach County'6 Dept. of Environmental
Resources Management <ERM> over matters conc�rning landscaping
activities and 2andscape maintenance.

Deleqated Authority to Restore Jurisdiction Under the
County's Coastal Protection Ordinance
Attached hereto, please find correspondence from Bill Griffin,
Tequesta's representative on the Palm Beach Countywide Beaches and
Shores Council, regarding the above referenced subject. Since Mr.
Griffin needs an expedited answer regarding Tequesta's stance on
acceptance of Palm Beach County's Delegated Authority, please
review the same and make a recommendation in writing so that we can
include the same on the agenda for the Village Council Meeting
scheduled for April 28, 1994. Should you have any questions
regarding this matter, please feel free to contact Mr. Griffin or
the Village Attorney to clarify.
